GAMMON Approved and signed by me 911.)1-1) 19 93 o '- Mayor • • ORDINANCE NO. g3 90?- 9,.3 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ESTABLISHING CHARGES FOR NONRECURRING SERVICES RENDERED BY THE CITY OF SOUTH BEND WATER WORKS AND AMENDING CHAPTER 17, ARTICLE 4, SECTION 17-47 OF THE SOUTH BEND MUNICIPAL CODE STATEMENT OF PURPOSE AND INTENT The City of South Bend, Indiana, last established a schedule of rates and charges for services rendered by the South Bend Water Works by Ordinance Nos . 8305-92 and 8357-93, which were passed on October 12, 1992, and February 22, 1993, respectively. The new schedule of rates and charges was approved by the Indiana Utility Regulatory Commission (IURC) by Order dated January 27, 1993, in Cause No. 39554 . This new schedule of rates and charges did not change the previously established charges for certain nonrecurring services, including disconnect for nonpayment, reconnection, bad checks, service initiation, frozen meter, inspection and testing of backflow prevention devices, meter downsize, and damaged or lost meter. The nonrecurring service charge for disconnect for nonpayment, reconnection, bad checks, service initiation, and frozen meter have been in effect for over twelve (12) years . The nonrecurring service charges for services rendered in connection with inspection and testing of backflow prevention devices pursuant to the Cross Connection Control Program (Ordinance No. 8356-93) , meter downsize, and damaged or lost meter have not previously been set forth in the Water Works' schedule of rates and charges, but should be so set forth. On June 15, 1993, the Board of Water Works Commissioners adopted Resolution Number 11-1993, finding that the proposed nonrecurring service charges are nondiscriminatory, reasonable, and just . The Resolution Number 11-1993 recommended that the South Bend Common Council enact the nonrecurring charges as set forth in the proposed amendments to Section 17-47 of the South Bend Municipal Code. The proposed charges for the aforementioned nonrecurring services have been filed with the IURC as the approval of the IURC is necessary before the proposed nonrecurring service charges may be imposed. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS : Section I . Chapter 17, Article 4, Section 17-47 of the South Bend Municipal Code shall read in its entirety as follows : Sec . 17-47 Nonrecurring Charges . (a) Deposits : Security deposits, payable upon service initiation and • • refundable upon service termination, shall be no more than one-sixth of the estimated annual bill for each meter size . Governmental entities shall be exempt from deposits . (b) Tap Charges : The charge for main taps shall be at the Utility' s cost . The charge for installation of a 1-inch tap shall be $185 . 00, which shall include the installed tapping valve and the material for the curb valve and box, but shall not include any service line. Charges for taps larger than 1-inch shall be at cost . (c) Other Nonrecurring Charges : Disconnect for nonpayment $ 7 .50 $11 . 00 Reconnection 5 . 00 8 . 00 Bad Checks 7 .50 11 . 00 Frozen Meter (1" and smaller) 15 . 00 37 . 00 Service Initiation 12 .00 20 . 00 Meter downsize (1" and smaller) 32 . 00 Inspection and testing fee for backflow prevention devices; 1 .5" or smaller 50 . 00 Inspection and testing fee for backflow 75 .00 prevention devices; 2" and larger Damaged or lost meter At cost depending upon size and type of meter. Section II . All ordinances in conflict with the provisions of this Ordinance are repealed upon this Ordinance becoming effective as set forth in Section III herein. Section III . The Ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor, legal publication, and approval by the Indiana Utility Regulatory Commission of the nonrecurring service charges appearing in the Ordinance. Ordinance Nos. 8305-92 and 8357-93, which were passed on October 12, 1992, and February 22, 1993, respectively, codified the charges presently being assessed for certain nonrecurring services . The nonrecurring service charges for disconnect for nonpayment, reconnection, bad checks, frozen meter, and service initiation have remained constant for over twelve (12) years. The South Bend Water Works is seeking an increase in the aforementioned nonrecurring service charges as the cost of administering such services exceeds the charges presently imposed. The Ordinance further provides for the nonrecurring service charges to be imposed for meter downsize, the inspection and testing fees for backflow prevention devices, and a damaged or lost meter charge. These proposed nonrecurring service charges are presently pending before the Indiana Utility Regulatory Commission. As stated in the Statement of Purpose and Intent for Ordinance No. 55-93, the proposed nonrecurring service charges must be approved by the Common Council and the Indiana Utility Regulatory Commission (IURC) . The proposed nonrecurring service charges which appear in Ordinance No. 55-93 are presently pending before the IURC on a thirty (30) day filing procedure.
