AN ORDINANCE AMENDING THE ZONING ORDINANCE
FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER
OF THE INDIANA EAST-WEST TOLL ROAD AND THE
U.S. 31 BYPASS IN THE CITY OF SOUTH BEND, INDIANA
BE IT ORDAINED By the Common Council of the City of South Bend,
INDIANA:
SECTION I. Ordinance No. 4990-68, as amended, which ordinance is
commonly known as the Zoning Ordinance of the City of South Bend, Indiana,
be and the same hereby is amended in order that the zoning classification
of the following described real estate in the City of South Bend, St.
Joseph County, State of Indiana:
That portion of the Southeast 1/4 of Section 19, the
Northwest 1/4 and the Southwest 1/4 of Section 20,
the Northwest 1/4 of Section 29, and the Northeast
1/4 of Section 30, all being a part of Township 38
North, Range 2 East, German Township, St. Joseph
County, Indiana, located to the East of the East
right-of-way line of the U.S. 31 Bypass and to the
South of the South right-of-way line of the Indiana
East-West Toll Road, containing 449.86 acres.
be and the same is hereby established as "B" Height and Area.
SECTION II. This ordinance shall be in full force and effect
from and after its passage by the Common Council, approval by the mayor,
and legal publication.

We the undersigned make application to the Common Council of the City of South Bend,
Indiana to amend the zoning ordinance as herein requested.
1) The property sought to be rezoned is located at:
Southeast corner of the Indiana East-West Toll Road and the U.S. 31 Bypass.

4) It is desired and requested that this property be rezoned
from "A" Height and Area
to "B" Height and Area
5) This rezoning is requested to allow the following:
The Protective Covenants established by both the Redevelopment Authority and the
Redevelopment Commission for the Blackthorn Corporate Center intend to allow
buildings up to three (3) stories in height. The "A" Height and Area district
limits the height of buildings to two and one-half (2 1/2) stories. The proposed
ordinance will allow the office park to be developed in the manner that it was
originally intended.
6) Attached is a copy of (a) legal description of the property; (b) a list of names and
addresses of all property owners within 300 feet of the petition property; and (d)
addressed, stamped envelopes for all property owners within 300 feet of the petition
property.
