ORDINANCE NO. 83 6 - 93 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA,AMENDING CHAPTER 18,ARTICLE 6, SECTION 18-57 OF THE SOUTH BEND MUNICIPAL CODE BY AMENDING SAID SECTION ADDRESSING THE PENALTY FOR FAILURE TO DISPLAY ADDRESS STREET NUMBERS,AND ADDING THE PENALTY TO SECTION 2-213 ADDRESSING SCHEDULE OF ORDINANCE AND CODE VIOLATIONS STATEMENT OF PURPOSE AND INTENT Chapter 18, Article 6 of the South Bend Municipal Code is entitled "House Numbers". It has been in effect since 1962 and sets forth the address numbering system utilized by the City. The City Engineer is charged with the responsibility to assign numbers according to the plan. Section 18-55 provides that the owner or occupant of every house or business is required to "place the number assigned to his lot or part of lot by the City Engineer in a conspicuous place on the side of or above the front door of such house or building." This section further provides that the numbers be not less than three (3)inches in length and "so made and marked as to be distinctly and easily read." Public safety concerns have been raised by the many residential and business buildings which have no street address on their buildings. Discussions have taken place with the Police and Fire Departments who believe that street address markings as called for by current ordinance are not only needed but necessary in order to provide public safety services to such locations. Additionally, many local taxicab companies have also voiced concern over the lack of street address markings. The following ordinance would set forth a monetary penalty provision for failure to properly have the street address numbers displayed conspicuously on a building. Proposed paragraph (c)incorporates the current provisions of Section 18-57 and gives the City additional leverage in seeking compliance by property owners. It is believed that with the cooperation of the citizens of our City, that they will make sure that their home or business is in compliance with this public safety requirement. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,INDIANA, as follows: Section I. Chapter 18, Article 6, Section 18-57 of the South Bend Municipal Code shall be amended to read in its entirety as follows: Sec. 18-57 Penalty for Failure to Display Address Street Numbers. Anyone violating any of the provisions of this Article may be subject to the following penalties: (a) Fifteen Dollars ($15.00) for the first violation as set forth in Section 2-213(a). Such violation shall be considered an ordinance violation and the fine shall be payable through the City's Ordinance Violation Bureau. (b) Twenty-Five Dollars ($25.00) for all subsequent violations in the same calendar year. Fourth District LinasSlavinskas As you may be aware, the City has requirements that Fifth District every owner of property have displayed conspicuously, the street address on their buildings. Thomas Zakrzewski Sixth District I have received many calls and in particular calls from many taxi cab owners and operators informing me that Sean Coleman there are literally hundreds, if not thousands of At Large persons who have not complied with this Ordinance. Loretta Duda I am recommending that the Ordinance take effect on At Large August 1st to allow home owners and business owners to Eugene Ladewski comply without being subject to a penalty. I am At Large further recommending that there be a Fifteen Dollar ($15. 00) fine, payable through the Ordinance Violation Bureau and if the person has failed to comply, thereafter that the fine be increased to Twenty-five Kathleen Cekanski-Farrand Dollars ($25. 00) . Council Attorney I seriously believe that there may be a serious public safety risk with regard to all of the buildings which are not properly posted. I have had ongoing discussions with members of the Police Department and the Fire Department who are also in support of this Bill.
