F 102- 9.3 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING ARTICLE 14 OF CHAPTER 2 OF THE SOUTH BEND MUNICIPAL CODE BY ADDING A NEW SECTION 2-169.2 ENTITLED "CONSOLIDATED BUILDING DEPARTMENT ENTERPRISE FUND" STATEMENT OF PURPOSE AND INTENT In December, 1991, the South Bend Common Council and the St . Joseph County Council approved the execution of an interlocal agreement between St . Joseph County and the City of South Bend for the consolidation of building departments and the establishment of the Consolidated Building Board. The St . Joseph County/South Bend Building Department has been in operation since January, 1992, and is achieving the stated goal of providing better service to the citizens of South Bend and St. Joseph County by providing for consistent interpretation and implementation of building and zoning codes and consistent and combined licensing and registration for the building trades . It is the intent of the City of South Bend and St . Joseph County that the costs of the operation of the Consolidated Building Department on a continual basis be financed and recovered primarily through user fees . It is the goal of the City and the County that the Consolidated Building Department be self-sufficient . Accordingly, it is appropriate that an enterprise fund should be established for the St. Joseph County/South Bend Building Department. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS : Section 1 . Chapter 2, Article 14 of the South Bend Municipal Code is amended to add a new section as follows : Sec. 2-169.2 Consolidated Building Department Enterprise Fund. A consolidated building department enterprise fund is established to receive monies and fees and to pay expenses, including depreciation, related to the operation of the St . Joseph County/South Bend Building Department . Such fund will be subject to full accrual accounting, and will be operated in accordance with the interlocal agreement between St . Joseph County and the City of South Bend executed December 31, 1991, as amended. Section 2 . This Ordinance shall be in full force and effect from and after its adoption by the Common Council, approval by the Mayor and legal publication. Horton August 16, 1993 Mr. Steve Luecke President South Bend Common Council 4th Floor, County-City Building South Bend, IN 46601 Re: Bill Amending Chapter 2 of the South Bend Municipal Code to Create the "Consolidated Building Department Enterprise Fund" Dear Steve: I am attaching for filing a bill amending Article 14 of Chapter 2 of the South Bend Municipal Code to create a new section entitled "Consolidated Building Department Enterprise Fund. " As you know, in December, 1991, the South Bend Common Council and the St . Joseph County Council approved the execution of an interlocal agreement for the consolidation of building departments . Since January, 1992, the St . Joseph County/South Bend Building Department has been in operation and has been providing better and more consistent service to the citizens of South Bend and St . Joseph County at a lower cost. It has always been the intent of the City and the County that the costs for the operation of the Consolidated Building Department on a continual basis be financed and recovered primarily through user fees . It is the goal of the City and the County that the Consolidated Building Department be self-sufficient . For these reasons, it is appropriate that an enterprise fund should be established for the St. Joseph County/South Bend Building Department . The establishment of this fund will not necessitate any changes in the interlocal agreement between the City and the County which governs the operation of the Consolidated Building Department .
