The Board of Public Works, at its meeting held on April 14, 2020, approved the above
referenced amendment to separate Olive Street reconstruction into two (2) phases, in the
amount, not to exceed $14,525, with a new total of $495,525.

Contract Amendment No. 2
Project: Olive Street Reconstruction — Phase 1
From Prairie Avenue to 220 ft north of railroad south of Tucker Drive

This Contract Amendment is made and entered to this Contract between the City of South Bend Board of
Public Works (hereinafter referred to as "LPA") and Lawson -Fisher Associates P.C. (hereinafter referred
to as "CONSULTANT").
WHEREAS, the LPA and CONSULTANT did February 24, 2015 enter a Contract for project
development services for the above reference project.
WHEREAS, the LPA and CONSULTANT did enter a Contract Amendment on April 11, 2017 for
additional services for the above reference project.
WHEREAS, the LPA desires that CONSULTANT provide further additional services to separate
this project into two separately constructed phases, with the first phase ending at Olive Street and Indiana
Court intersection, and the second phase to be developed under a separate agreement with INDOT
oversight named Olive Street from Indiana Court to Tucker Drive- Phase 2, Des. No. 1920178.
WHEREAS, the LPA desires the CONSULTANT provide additional services addressing the north
project limit as has been required for right-of-way engineering, environmental documentation, and
previously developed roadway design plans.
WHEREAS, the LPA desires the CONSULTANT provide additional services for revised railroad
right-of-way engineering property descriptions from property interests, title updates, and other information
received.
WHEREAS, the LPA desires the CONSULTANT provide additional services for additional utility
coordination to facilitate the development of work plans and completion as was necessary for several
utilities across these two phases.
WHEREAS, the LPA desires the CONSULTANT provide additional services to develop a Note to
File for the currently approved Categorical Exclusion -Level 1 on file with INDOT and other requested
information to separate these two projects.
WHEREAS the LPA desires the CONSULTANT provide additional services for design services to
separate these two projects to be constructed as separate projects that shall be seamless above and
below create when both phases are complete.
WHEREAS, in order to provide for completion of the work, it is necessary to amend and
supplement the contract in the amount of $14,525.00
NOW, THEREFORE, it is agreed by and between the parties that the following Appendices are
amended:

Appendix "A" is amended as follows:
ADD to Task 1 — The CONSULTANT shall develop a Note to File for the approved Environmental
Assessment (Category Exclusion -Level 2) services for this project. All work shall comply and be
in accordance with INDOT's Procedural Manual for Preparing Environmental Studies and
Categorical Exclusion Manual, INDOT comments received, and directed revisions required.
ADD to Task 3 — Road Design and Plan Development — The CONSULTANT shall end the project
north limit approximately 500 feet south encompassing the existing railroad crossing for a
separately constructed project phase. Revisions shall address storm sewer networks, project
transitions, pavement markings, walks, public road approaches, quantities, estimates, special
provisions and other contract document information in accordance with INDOT policies and
procedures.
ADD to Task 4 - Utility Coordination Services - The CONSULTANT shall work with LPA utilities to
develop utility relocation plans, review existing records, and perform as a liaison to develop work
plans and necessary revisions to secure Utility Coordination Certification.
ADD to Task 7 — Right-of-way Plan Development — The CONSULTANT shall make necessary
revisions to railroad parcel properties based on current property interests held to accurately
reflect land acquisition and present existing right-of-way. The CONSULTANT shall also provide
additional coordination activities as may be required to satisfy railroad property interests,
attorneys, and consulting engineers.
Appendix "D" is amended as follows:
A. 1. The consultant shall receive payment for the work performed under this contract the total
amount not to exceed is $219;000 8a 09 $495,525 unless an amendment is executed by the
parties which increases the maximum amount payable and funding approval.
2. The CONSULTANT shall be paid for the work performed under this Contract on a lump sum
basis in accordance with the following fees:
a. Environmental Document Preparation — Appendix "A" Task 1 $ 18,500.00 $22,900.00
b. Topographic Survey —Appendix "A" Task 2 38,300.00
c. Road Design & Plan Development — Appendix "A" Tasks 3 260,050.00 263,625.00
d. Geotechnical Services — Appendix "A" Task 5 18,100.00
e. Design Hearing/Public Involvement

3. The CONSULTANT will be paid for the services described in Task 4 and Task 8 of Appendix
"A" on a labor rate multiplier basis. The CONSULTANT will be paid for the actual hours of work
performed by essential personnel exclusively working on these tasks at the direct wage and
salary rates of each employee multiplied by 3.135, PLUS direct non -salary costs as approved by
the LPA. The direct labor rates shall not exceed the INDOT maximum applicable at the time of
service. The maximum allowable rate is available on the INDOT website. Direct non -salary costs
shall be the actual out-of-pocket expenses of the CONSULTANT directly attributable to this
Contract, such as fares, subsistence, mileage, equipment rentals, reproductions, approved sub -

consultant fees, etc., however, the direct non -salary costs for travel reimbursement shall not
exceed the limitations on travel expenses set out in the current State policy on travel
reimbursement.

5. The CONSULTANT shall receive payment for the work performed under this Contract related
to the following services as described in Task 7 of Appendix "A". This is based on the specific cost
per unit multiplied by the actual unit of work performed.

Total Extended $ 129,350.00 $ 132,610.00
Except as herein modified, changed and amended, all terms of the original contract dated February 24,
2015, and Contract Amendment No. 1 dated April 11, 2017 shall continue in full force and effect.
In Witness whereof, the CONSULTANT and the LPA, to duly authorized representatives to enter into this
Contract Amendment. The parties having read and understand the foregoing terms of this amendment
due by their respective signatures stated below hereby agree to the terms thereof.
