Notice is hereby given that the City of South Bend, Indiana, Boardof Public Works will receive sealed
electronic bids at southbendin.gov/bidsuntil 9:30 a.m.,Local Time, on April 14, 2020for the following:

Work includes structural repairs and improvementsat the Main & Colfax Parking Structurein South Bend,
all more particularly described in plans and specifications prepared by WGI, phone 269-381-2222.
The Contract Documents are on file and available for public inspection or purchase commencing on the
first advertise date during regular working hours at American Reprographics Company (“ARC”, located at
1303 Northside Blvd., South Bend, Indiana, 46615),www.e-arc.com/location/south.bend/(574) 287-2944,
toll free at (800) 783-7231. There will be a non-refundable charge for reproduction as set by ARC for every
set of documents for all bidders.Additionally, the Contract Documents will be available that same day for
inspection at MACIAF,212 W. Colfax Ave. South Bend, IN 46601.
Electronic bids must be on the City of South Bend Contractor’s Bid for Public WorkForm, accompanied by
an electroniccopy of a Bid Bond or Certified Check in the amount of not less than five percent (5%) of the
base bid plus any alternates.The awarded bidder will be required to send the original check or bid bond
via USPS.
Each bidder or contractor (hereinafter the contractor) must comply with “City of South Bend EEO Contracting Provision
Diversity Utilization” included in the specifications as to each construction trade it intends to use on this construction
contract and all other construction work (both federal and non-federal) in the St. Joseph County area during the
performance of this contract or subcontract. The contractor commits itself to the goals for minority manpower and all
other requirements, terms and conditions of these bid conditions by submitting a properly sealed bid. Woman and
Minority-Owned Business Enterprises (W/MBE) are encouraged to respond to this notification. It is the sole
responsibility of the potential bidder to comply with all submission requirements applicable to the bidder in Section 6-

The following information is to be changed/added to the contract documents:
Remove Section XXIV. M/WBE-DBE GOALS.
Replace Minority and Women Business Enterprise Inclusion Program General Conditions with
the attached Minority and Women Business Enterprise Diversity Development Program General
Conditions.
Replace Minority and Women Business Enterprise Inclusion ProgramForms with the attached
Minority and Women Business Enterprise Diversity Development ProgramForms.
The project will have a substantial completion date of June 1July 3 and a final completion date
of June 8 July 10. During all work, the Contractor may close Levels 4 and 5, maintaining a drive
lane up to Levels 6 and 7. The contract time will start when the Notice to Proceed is
delivered and signed.
Pre-Bid Question and Answer:
Q: Can the photos be sent out in an addendum as well?
A: See attached.
Q:What is the anticipated Start Date for the Project?
A: The project will be awarded on April 28, 2020 at the Board of Public Works meeting.
Successful bidder from award notice will have fourteen (14) calendar days to submit a fully
executed contract, Certificated of Insurance, and other require documents from either the
th
awarded contactor and/or the subcontractors. As a team, we are looking at the week of May 11
as an ideal start. A pre-construction meeting will be scheduled and Notice to Proceed
administered the week prior if all required documents are submitted.
Q:June 1st seems like an aggressive schedule - assuming award / contract might take a week or
two that is a likely start date of May 1st-ish (not assuming any issues with starting due to Covid).
Assuming we have to wait for cure times for coating etc. - Is June 1st completion set in stone?
Q:Would like to know of the new time line could be extended to 8 weeks?
A: The project will have a substantial completion date of June 1
July 3 and a final completion
dateof June 8 July 10. During all work, the Contractor may close Levels 4 and 5, maintaining a

Q:Is this a prevailing wage project and was the pre bid attendance mandatory?
A: No and No.
Q:Paint removal is down to bare concrete or just what is loose?
A: See Section 09 9100 – 5 in the specifications for expectation of preparing surfaces.
E. Preparation of coated and uncoated concrete surfaces:
1.Concrete surfaces shall be waterblasted as a minimum to remove contaminants
and loose paint. Scraping of the loose paint may be required.
2.Surfaces shall be cleaned, dry, and free of all contaminants such as dirt, dust,
laitance, grease, previously applied coatings and other contaminants that would
interfere with the adhesion of the specified coating system.
3.Properly prepared surfaces shall be dry prior to coating.
4.New concrete shall cure for minimum of 28 days prior to coating, or as
required by Manufacturer

The following information is to be changed/added to the contract documents:
Replace Contractor’s Bid for Public Works Page 7 and 8, Bid/Proposal, with the attached,
revised Contractor’s Bid for Public Works, Bid/Proposal.
The project will have a substantial completion date of June 1July 3and a final completion date
of June 8July 10. During all work, the Contractor may close Levels 4,5,6, and 7maintaining a
drivelane up to Levels 6 and 7.The contract time will start when the Notice to Proceed is
delivered and signed.

.W9/ʹ COVID-19 Pandemic Notification
Ms. Martin,
The current events surrounding the Covid19 Pandemic has affected everyone in the World. The rules, laws and special hygiene
procedures has and will change our lives forever. We want to provide reasonable notice and comments to address the impact of the
conditions that currently exist with the hope, that we can all provide the necessary protection to one another while we work
together to complete your project.
We request that this memorandum be made part of our proposal/bid and ultimately part of the final contract. It is meant to address
the potential adverse effects of the Covid19 Pandemic. It is also meant to notify all parties to the contract that conditions exist
which may affect the performance of the contract in areas of labor availability, material deliveries, equipment, and access to the
jobsite. It also alerts the parties that Government bodies may enact laws and rules that preclude us from performing our obligations
stated in our contract.
Many of our contracts require us to notify the customer at the time of bid if knowledge exists of concerns especially those usually
identified in the sections addressing, Force Majeure, Time Extension, Right to Terminate, etc. Those clauses essentially free both
parties from liability or obligation due to circumstances beyond the control of the parties. The Covid19 Pandemic will most certainly
fall into this category.
Specifically, we ask to be released from liability or obligation, if non-performance is a result of Covid19 Virus Pandemic.
