GAMMON Approved and signed by me August 4 19 93 Mayor r . t Bill No. 96-93 Ordinance No._3 ?8' ? 3 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING SUBSTITUTE BILL NO. 59-93, FIXING THE ANNUAL PAY AND MONETARY FRINGE BENEFITS OF FIREFIGHTERS OF THE SOUTH BEND FIRE DEPARTMENT FOR THE CALENDAR YEARS 1994, 1995 AND 1996. Statement of Purpose and Intent The South Bend Common Council has the responsibility for fixing by ordinance the annual compensation of all members of the Fire Department pursuant to Indiana Code § 36-8-3-3 (d) before August 2. On Thursday, July 29, 1993, the Common Council passed Substitute Bill No. 59-93 which fixed the annual pay and monetary fringe benefits of firefighters of the South Bend Fire Department for calendar years 1994, 1995, and 1996. On Saturday, July 31, 1993 the respective bargaining committees of the Firefighters Local Union No. 362 and the City of South Bend continued negotiations and recommend jointly to their respective bodies the terms of the following ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: Section I. Section II. of Substitute Bill No. 59-93 also referred to as Ordinance No. 8397-93 entitled "An Ordinance of the Common Council of the City of South Bend, Indiana, Fixing the Annual Pay and Monetary Fringe Benefits of Firefighters of the South Bend Fire Department for the Calendar Years 1994, 1995, and 1996, is hereby amended by adding to said Section the following new paragraph (f) which shall read in its entirety as follows: (f) In the event of a positive ratification vote by the Firefighters Local Union No. 362 on the total wage, benefit and working conditions package offered by the City of South Bend, the Sworn Members of the Department as defined in Section I of Substitute Bill No. 59-93 also referred to as Ordinance No. 8397-93 shall have the option of selecting one (1) of the following: 1. Option 1: A one-time CBA Incentive of $600.00 payable in the second regular payroll check in January of 1994; or 2. All of the other provisions of Substitute Bill No. 59-93 also referred to as Ordinance No. 8397-93 entitled "An Ordinance of the Common Council of the City of South Bend, Indiana, Fixing the Annual Pay and Monetary Fringe Benefits of Firefighters of the South Bend Fire Department for the Calendar Years 1994, 1995, and 1996 are hereby reaffirmed. Section III. This Ordinance shall be in full, force and effect from and after its passage by the Common Council and approval by the Mayor. Mem er oft Common Council ry m Y of he C thmon Council August 1, 1993 Members of the South Bend Common Council Council Chambers 4th Floor County-City Building South Bend, IN 46601 RE: Special Session of the South Bend Common Council to hear Bill No. 96-93 Dear Council Members: On behalf of the respective negotiating teams of which we are the Spokespersons, we respectfully request that the South Bend Common Council pass Bill No. 96-93. This Bill provides a new mechanism to provide additional dollars to the Sworn Members of Firefighter Local Union 362. The Bill would provide each of the Sworn Members the rights to select Option 1 which would entitle them to a one-time $600 CBA Incentive payable in January of 1994, or to Select Option 2 which would entitle them to a $250 Food/Bedding Allowance in 1994, 1995, and 1996, payable in December of each year. By passing this ordinance you would be benefitting 202 Sworn Member's families. The ratification vote is schedules to take place on August 9 and 10, 1993. If the Union members do not ratify the total wage, benefit and working conditions, this ordinance have no legal effect. We seek your favorable support. Thank you.
