AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, ANNEXING TO THE CITY OF SOUTH BEND
CERTAIN TERRITORY CONTIGUOUS THEREWITH
AND GENERALLY LOCATED EAST OF MAYFLOWER ROAD,
BETWEEN BRICK AND CLEVELAND ROADS
IN GERMAN TOWNSHIP, ST. JOSEPH COUNTY, INDIANA
(SHIVELY/DEMAEGT ANNEXATION)
STATEMENT OF PURPOSE AND INTENT
The Common Council of the City of South Bend, Indiana, has
determined that it is in the best interest of the City of South Bend
to annex and bring within the corporate limits of the City of South
Bend certain territory that is contiguous with the City of South Bend.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, as follows:
SECTION I. That the following described real estate situated in St.
Joseph County, Indiana, being contiguous by more than one-fourth ( 1/4)
of its aggregate external boundaries with the present boundaries of
the City of South Bend, Indiana, shall be and hereby is annexed to and
brought within the City of South Bend, Indiana:
Parcels of land located in the Northwest quarter of
Section 21 and the Northeast quarter of Section 20,
Township 38 North, Range 2 East, German Township, St.
Joseph County, Indiana. More particularly described as
follows:
Beginning at the center point of Section 21, thence
North along the West line of the Toll Road Industrial
Park Subdivision 1325.083 feet; thence West 661.02 feet;
thence North 1280 feet; more or less to the centerline
of Brick Rd. ; thence West 661. 02 feet; thence South 530
feet; thence West 138.48 feet, thence South 465 feet,
more or less to the south line, extended east, of the
Hartman & DeMaegt Subdivision and the High Meadows
Estates Subdivision; thence West along the south line of
Hartman and DeMaegt Subdivision and High Meadows Estates
Subdivision to the Southwest corner of Lot 35 of High
Meadows Estates Subdivision thence North along the west
line of said subdivision to a point 750 feet south of
the centerline of Brick Road; thence West parallel with
the centerline of Brick Road 420 feet, more or less
thence North parallel with the west line of said
subdivision 750 feet to the centerline of Brick Road;
thence West along the centerline of Brick Road to the
centerline of Mayflower Road; thence South 1308 feet,
thence Southeast 74 .74 feet; thence East by Southeast
2757 feet along the North right-of-way line of Cleveland
Rd. Extension; thence North 669.74 feet; thence East
561.72 feet; thence South 795.17 feet to the North
right-of-way line of Cleveland Rd. Extension; thence

SECTION III . That the boundaries of the City of South Bend,
Indiana, shall be and hereby are declared to be extended so as to
include all of the above-described real estate as a part of the City
of South Bend, Indiana.
SECTION IV. That the above-described area shall be and hereby is
assigned to the First Councilmanic District of the City of South Bend,
Indiana.
SECTION V. This Ordinance shall be in full force and effect from
and after its passage by the Common Council, approval by the Mayor,
and proper legal publication.

Territory Situated in German Township (Shively/DeMaegt
Annexation) and a Resolution of the Common Council of the City of
South Bend, Indiana Adopting a Written Fiscal Plan and
Establishing a Policy for the Provision of Services to an Annexed
Area in German Township (Shively/DeMaegt Annexation)
Dear Mr. Luecke,
I am attaching for filing substitute versions of the
above-referenced ordinance and resolution. As you know, the Council
tabled consideration of the same at its October 11th meeting. When
the substitute bills are considered at the Council' s October 25th
meeting, I would request that the Council suspend its rules to allow
the attached resolution to be considered prior to the attached
ordinance.
Thank you for your assistance. The Council' s favorable
consideration is respectfully requested.
