AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, AMENDING CHAPTER 21
OF THE SOUTH BEND MUNICIPAL CODE
ENTITLED "ZONING," AS IT RELATES
TO THE FRONT YARD SETBACK FOR
FREESTANDING SIGNS
STATEMENT OF PURPOSE AND INTENT
The purpose of this ordinance is to amend Section 21.169(c)(4) of Chapter 21 of the Municipal
Code to reduce the required front setback for signs within the 'CC ' Height and Area District.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, AS FOLLOWS:
Section I. Section 21.169 General Provisions of Article 10, Sign Regulations, of Chapter 21 of the
South Bend Municipal Code is amended as follows:
Sec. 21.169 General Provisions
(c) (4) Freestanding signs in the "A", "B", "C", and "D" Height and Area Districts
shall be setback a minimum of five (5) feet from the right-of-way line of other than limited
access highways.
Section II. This ordinance shall be in full force and effect from and after its passage by the
Common Council and approval by the Mayor.

RE: A proposed ordinance initiated by the Area Plan Commission amending Chapter
21 of the South Bend Municipal Code entitled "Zoning", as it relates to the front
yard setback for freestanding signs - APC #1543-93
Dear Council Members:
The above referenced ordinance initiated by the Area Plan Commission was legally
advertised on September 9, 1993. The Area Plan Commission at its public hearing
on September 21, 1993, took the following action:
Upon a motion by Richard Warner, being seconded by Robert MacNaughton and
unanimously carried, the proposed ordinance initiated by the Area Plan Commission
amending Chapter 21 of the South Bend Municipal Code entitled "Zoning", as it
relates to the front yard setback for freestanding signs is sent to the Common
Council with a favorable recommendation
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will be
forwarded to you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the
Area Plan Commission's Staff Report.

Location:
City of South Bend
REQUESTED ACTION: This is an Area Plan Commission initiated
petition to reduce the required setback for
signs in the "C" Height and Area District
within the City of South Bend. In December of
1992, the Common Council passed an ordinance
amending various provisions of the City's sign
regulations. As part of that amendment, the
setback for signs within "A", "B", and "D"
Height and Area Districts was reduced to 10
feet from the right-of-way. The "C" Height and
Area District was inadvertently ommitted from
this portion of the ordinance. The current
setback for signs within the "C" District is
the same as the required building setback, 20
feet. The proposed ordinance would correct
this ommission, and establish a 10 foot sign
setback within the "C" Height and Area
District.

RE: Proposed ordinance to amend the required front yard setback for signs within the "C"
Height and Area District.
Dear Mr. Luecke:
Attached please find a proposed ordinance that was initiated by the Area Plan Commission at
its meeting of July 20, 1993. The purpose of the ordinance is to correct a previous text
amendment that was passed by the Council in December of 1992 (Ordinance No. 8335-92).
This amendment changed, among other things, the setback requirements for signs in the "A",
"B", and "D" Height and Area Districts. For some reason, the sign setback in the "C" Height
and Area District was not included with this amendment. Currently, the "C" Height and Area
District requires a 20 foot front setback for signs, which is 15 feet greater than any other
District. If the proposed ordinance is passed by the Council, the "B", "C", and "D"
Districts will require a five foot front setback for signs, and the "E", "F", and "G" Districts
will require no front setback.
Copies of the proposed ordinance have been forwarded to the City Building Commissioner and
the City Attorneys Office for review. Please place the proposed ordinance on the agenda for
first reading at the August 9, 1993 meeting of the Common Council.
