AN ORDINANCE AMENDING THE ZONING ORDINANCE
FOR PROPERTY LOCATED AT 317 WEST WASHINGTON
STREET IN THE CITY OF SOUTH BEND, INDIANA
BE IT ORDAINED By the Common Council of the City of South Bend,
INDIANA:
SECTION I. Ordinance No. 4990-68, as amended, which ordinance is
commonly known as the Zoning Ordinance of the City of South Bend, Indiana,
be and the same hereby is amended in order that the zoning classification
of the following described real estate in the City of South Bend, St.
Joseph County, State of Indiana:
That part of the Northeast Quarter of Section 11,
Township 37 North, Range 2 East, Portage Township,
City of South Bend, St. Joseph County, Indiana, which
is described as: Beginning at the intersection of
the East line of William Street and the North line of
Washington Street, in the City of South Bend, St.
Joseph County, Indiana; thence S. 89°-48' -08" East
along the North line of Washington Street, 430.07 ft.
(426.50 ft. records) to a Point on the West line of
St. James Court (a 14.00 ft wide Public Alley) ;
thence N. 00°-01' -34" East along said line, 411.05
ft. (410.00 ft. , record) ; thence N. 890-43 ' -16" West
along the South line of Colfax Avenue (82.50 ft.
wide) , 430.26 ft. (426.36 ft. record) ; thence
S. 00°-00' -00" West (assumed bearing) along the East
line of Williams Street (66.00 ft. wide) 411.66 ft.

RE: A proposed ordinance initiated by the Area Plan Commission to zone from "D"
Light Industrial, "A" Height and Area to "A-3" Mixed Use Multifamily Residential
and Commercial, "F" Height and Area, property located at 317 W. Washington
Street, City of South Bend - APC #1561-93
Dear Council Members:
The above referenced ordinance of was legally advertised on November 4, 1993.
The Area Plan Commission at its public hearing on November 16, 1993, took the
following action:
Upon a motion by Willie Morgan, being seconded by Charles Landesman and carried,
the proposed ordinance initiated by the Area Plan Commission to zone from "D"
Light Industrial, "A" Height and Area to "A-3" Mixed Use Multifamily Residential
and Commercial, "F" Height and Area, property located at 317 W. Washington
Street, City of South Bend is sent to the Common Council with a favorable
recommendation.
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will be
forwarded to you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the
Area Plan Commission's Staff Report.

Location: 317 W. Washington Street
City of South Bend
REQUESTED ACTION: This is an Area Plan Commission initiated
petition to change the zoning classification
for Central High School from "D" Light
Industrial, "A" Height and Area to "A-3" Mixed
Use Multifamily Residential and Commercial,
"F" Height and Area to allow uses permitted
under the "A-3" zoning classification.
EXISTING LAND USE: The property contains a vacant high school
building that is to be converted into
apartments.
SURROUNDING LAND USE AND ZONING: Located to the north is a church zoned "D"
Light Industrial; to the east is a church, an
office, and a gas station zoned "D" Light
Industrial; to the south is an office zoned
"D" Light Industrial and a Bed & Breakfast
zoned "C" Commercial; and to the west are
apartments and offices zoned "A-3" Mixed Use.
ACCESS: Access to the site is from William Street,
Washington Street, Colfax Avenue, and St.
James Place.
WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the site.
DRAINAGE:
SITE DATA: The total site to be rezoned is 4.06 acres.
ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no
public wells, wetlands, flood or environmental
hazard areas are present.
SITE PLAN: A site plan is not required for rezonings
initiated by the Area Plan Commission.
