ORDINANCE NO. a .?02 - PJ r AN ORDINANCE MAKING TECHNICAL CORRECTIONS TO ORDINANCE NO. 8397-93 AND ORDINANCE NO. 8398-93 FIXING THE ANNUAL PAY AND MONETARY FRINGE BENEFITS OF FIREFIGHTERS OF THE SOUTH BEND FIRE DEPARTMENT FOR CALENDARS 1994, 1995 AND 1996. STATEMENT OF PURPOSE AND INTENT The South Bend Common Council notes that it has the responsibility for fixing, by Ordinance, the annual compensation of all members of the Fire Department pursuant to Indiana Code Section 36-8-3-3 (d) . The Council further notes that it established such annual compensation through Ordinance No. 8397-93 which was passed by the Common Council on July 29, 1993 , and that that Ordinance was subsequently amended by the passage of Ordinance No. 8398-93 , which was passed by the Common Council on August 1, 1993 . The Council acknowledges that in the event that the sworn members of the South Bend Fire Department had a positive ratification vote, that certain provisions addressing the maximum annual pay and monetary fringe benefits would be established. In light of the positive ratification vote of the members of the Firefighters Local Union No. 362 on October 6, 1993 , and October 7, 1993 , the following technical amendments to the above-described Ordinances are necessary. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: Section I. The following Sections of Ordinance No. 8397-93 are amended in part to read as follows: " Section II. Annual Pay Based on Rank. (a) Annual Pay: Annual pay for the Officers and sworn members of the South Bend Fire Department, by rank, for calendar years 1994 , 1995, and 1996 shall be as follows: Rank 1994 1995 1996 Fire Chief $42,250 $43, 517 $45, 693 Assistant Chiefs $38, 350 $39, 500 $41, 475 Battalion. Chiefs $34,250 $35, 277 $37, 041 Specialist $27, 033 Captains $27, 033 $27,844 $29, 236 Engineers $25, 727 $26, 500 $27 , 825 Firefighter 1st Class $21,912 $22 , 569 $23 , 697 Firefighter $19, 248 $19, 825 $20, 816" Section III: • All of the other provisions of Ordinance No. 8397-93 entitled "An Ordinance of the Common Council City of South Bend, Indiana, Fixing the Annual Pay and Monetary Fringe Benefits of Firefighters of the South Bend Fire Department for the Calendar Years 1994, 1995 and 1996" are hereby reaffirmed. Section II. Ordinance No. 8398-93 is hereby amended in part to read as follows: Section I. (f) Shall read as follows: In the event of a positive ratification vote by the Firefighters Local Union No. 362 on the total wage, benefit and working conditions package offered by the City of South Bend, the sworn members of the Department as defined in Section I. of Ordinance No. 8397-93 shall have the option of selecting one (1) of the following: 1. Option 1: A one-time CBA incentive of $700. 00 payable in the second regular payroll check in January 1994 ; or 2 . Option 2 : A Food-Bedding Allowance payable on or about December 15th of each year as follows: 1994 1995 1996 $235. 00 $235. 00 $235. 00 Sworn members who select "Option 1" must have been a sworn member as of the positive ratification vote of October 6, 1993 , and October 7, 1993 . Sworn members who select "Option 2" must have been sworn members of the Department as of the positive ratification vote of October 6, 1993 , and October 7, 1993 , and be members of the South Bend Fire Department as of the first day of the designated calendar year with said allowance being prorated to the date of a sworn member's separation from the department due to retirement, death, discharge, or resignation, for that calendar year. The City of South Bend will require all sworn members who qualify for selecting the one-time option of either "Option 1" or "Option 2" to make said selection and have said selection completed on or before December 17, 1993 . All of the other provisions of Ordinance No. 9398-93 entitled "An Ordinance of Common Council of the City of South Bend, Indiana, Amending Substitute Bill No. 59-93 , Fixing the Annual Pay and Monetary Fringe Benefits of Firefighters of the South Bend Fire Department for the Calendar Years 1994 , 1995 and 1996" are hereby reaffirmed. Section III. This Ordinance shall be in full force and effect from and after its passage from the Common Council and approval by, the Mayor. Dear Council Members: On behalf of the City Negotiating Team, I am pleased to introduced for your review, discussion, and passage the attached Bill that would make technical corrections to Ordinance No. 8397-93 which was passed by the Council of July 29, 1993 and would also make technical corrections to Ordinance No. 8398-93 which was passed by the Common Council on August 1, 1993 . As you are aware, the members of Firefighters Local Union No. 362 ratified all of the terms and conditions of the City's wage, benefit and working conditions package offered by the- City of South Bend, with voting taking place on October 6th and October 7th. It is our understanding that the ratification vote was by an 8-1 margin. It should also be noted that revision to the Neo-Natal Article of the Collective Bargaining Agreement will also be recommended to the Board of Public Safety. It requires volunteers that signed up for that program to remain available for service throughout the six month period unless excused otherwise due to an emergency. The current Contract permits a two week withdrawal of the "volunteer" classification which will be deleted from that Article.
