Mayor ORDINANCE NO. ?L( V-Q 3 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING MONIES WITHIN THE ZOO ENDOWMENT FUND TO BE USED FOR CAPITAL PROJECTS AND/OR CAPITAL IMPROVEMENTS AT THE POTAWATOMI ZOO, CITY OF SOUTH BEND, INDIANA FOR THE YEAR 1993 STATEMENT OF PURPOSE AND INTENT, The Common Council of the City of South Bend has determined it to be in the best interest of the City of South Bend and to be in the best interest of the City' s Park Department to authorize and appropriate monies dispersed from the Robert J. Fitch Revocable Inter Vivos Trust and deposited into the Zoo Endowment Funds to be used for capital improvements to the Potawatomi Park Zoo only, according to the restrictions of the Robert J. Fitch Revocable Inter Vivos Trust. The Robert J. Fitch Revocable Inter Vivos Trust provided a cash distribution in 1993 totaling approximately $10,000. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. The Robert J. Fitch Revocable Inter Vivos Trust monies deposited into the Zoo Endowment Funds shall be and hereby are appropriated and set apart for the capital projects specified herein below and according to the restrictions of the Trust. Capital Improvements utilizing funds from the Robert J. Fitch Revocable Inter Vivos Trust Fund: 1. One ( 1) Reed Lova 16-4 Model Gunite Spray Machine $9,219.29 2. One ( 1) 50 'x12" Gunite Hose 510. 00 3. One ( 1) 12" Gunite nozzle 280.81 $10,000.00 Section II . This ordinance shall be in full force and effect from and after its passage and approval by the Mayor. These monies represent a Specific Bequest made by the Robert J. Fitch Revocable Inter Vivos Trust. The specifications for the use of these monies explicitly state for the use of the Potawatomi Zoo for capital improvements only. The Potawatomi Zoo has selected to purchase a Gunite Spray Machine. Attached is a copy of a letter from Mr . Charles F. Nelson, Vice President for Norwest Banks. In his letter , Mr . Nelson does authorize this purchase as qualifying for the use of the trust monies. Fitch Revocable Inter Vivos Trust, per Article Two (D) which reads as follows: "To the City of South Bend, Indiana, for the use by its Park Department for Potowatomi Zoo, the sum of Ten Thousand Dollars ($10,000.00) , for capital improvements only. " Please note that these funds are to be specifically used for capital improvements only to the Potowatomi Zoo. Also enclosed is a Receipt for Specific Bequest. Please sign this Receipt, retaining one copy for your records and returning the other in the postage paid envelope provided. The enclosed w-9 Form also needs to be completed, signed, and returned.
