GAMMON Approved and signed by me Ig 13 � -- Mayor ORDINANCE NO. q( b-Q 3 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 2, ARTICLE 14 OF THE SOUTH BEND MUNICIPAL CODE BY THE ADDITION OF NEW SECTION 2-170.5 ENTITLED "HOWARD PARK ICE RINK NON-REVERTING CAPITAL IMPROVEMENT FUND" STATEMENT OF PURPOSE AND INTENT The Common Council recognizes that pursuant to Indiana Code §36-10-4-16(g) , it has the authority to establish by Ordinance special non-reverting operating funds and special non-reverting capital funds. In each instance, the establishment of such funds are to be requested by the Board of Park Commissioners. The Board of Park Commissioners of the City of South Bend at its meeting of October 25, 1993, requested that the Common Council establish a non-reverting capital improvement fund. The funding mechanism for the new fund would be the increment increase of selected user fees and charges approved by the Park Board at its meeting of October 25, 1993 . The Park Board has determined that in order to provide and make available to the public, quality park facilities and programs such as the Howard Park Ice Rink, that an increase in fees charged for users of that facility will be necessary. It has also been determined that the amount of the increment increase of each of the selected fees should be deposited into a separate non-reverting fund. Accordingly, the increment increase of the fees for the use of Howard Park Ice Rink would be deposited into the Howard Park Ice Rink Non-Reverting Capital Improvement Fund. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: Section 1 . Chapter 2, Article 14, of the South Bend Municipal Code is hereby amended by the addition of new Section 2-170. 5 which shall read in its entirety as follows: Sec. 2-170.5 Howard Park Ice Rink Non-Reverting Capital Improvement Fund. (a) The Howard Park Ice Rink Non-Reverting Capital Improvement Fund is established pursuant to I .C. 36-10-4-16. (b) The increment increase of all charges for use of the Howard Park Ice Rink shall be deposited into this special fund. (c) Funds may only be expended for capital improvements directly related to the Howard Park Ice Rink upon passage of a proper appropriation ordinance by the Common Council. (d) Any and all interest earned on the monies deposited in this special fund shall remain a part of the Howard Park Ice Rink Non-Reverting Capital Improvement Fund. Section 2. At its meeting of October 25, 1993, the Board of Park Commissioners approved an increase to the various user fees associated with the use of the Howard Park Ice Rink. It is the desire of the Park Board that those funds collected by the Park Department representing the increase in these fees be deposited into the fund proposed to be created in order to fund capital improvements to the Howard Park Ice Rink. This request is similar to the three (3) new non-reverting funds recently created by the Council to receive deposits of fee increases for other park facilities (including golf course, picnic and zoo facilities) in order to fund capital improvements to those facilities.
