AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA,AMENDING VARIOUS SECTIONS WITHIN ARTICLE 1 OF CHAPTER 2,
OF THE SOUTH BEND MUNICIPAL CODE ADDRESSING THE COMMON
COUNCIL AND AMENDING VARIOUS SECTIONS WITHIN ARTICLE 5 OF
CHAPTER 2 OF THE SOUTH BEND MUNICIPAL CODE ADDRESSING BOARDS
AND COMMISSIONS
STATEMENT OF PURPOSE AND INTENT
In the interest of promoting better and more efficient communication on issues
brought before the Common Council, the following five (5) amendments are proposed.
Collectively they would change the meeting time of the Organizational Meeting of the
Common Council to 7:00 p.m. from its current time of noon; would re-name some of the
Standing Committees of the Common Council to more appropriately reflect their duties;
would require the City Clerk's Office to send copies of Committee Meeting notices as well
as copies of the legislation to be heard by the Committee to citizen members; would require
annual updating and notification of all Commissions, Committees, Boards and similar
bodies; and would encourage new legislation to be signed in by the Chairperson of the
Committee who has jurisdiction over the particular subject matter.
It is believed that all of these proposed amendments are in the best interest of the
City and would enhance more effective governmental operations.

Section I. The Common Council of the City of South Bend, Indiana, hereby
amends Chapter 2,Article 1, § 2-3 of the South Bend Municipal Code to read as follows:
Sec. 2-3 Organization meeting of the Common Council; Officers;
Election; Term. 1
(a) The members of the Common Council shall hold their first regular meeting on
the first Monday of January after their election at 7:30 p.m. in the Council Chambers. This
meeting shall take place at+leen 5:00 p.m. on the first Monday of each succeeding January
thereafter.
(b) At this first regular meeting, the Council shall choose from members a
presiding officer or President, a presiding officer pro tempore or Vice-President, >he
Chairperson of the Committee of the Whole, and all other Council officers who shall serve
until neon 7:00 p.m. of the first Monday in January of the next succeeding year. The
Council shall also choose its Council Attorney at said meeting.
Section II. The Common Council of the City of South Bend, Indiana, hereby
amends Chapter 2,Article 1, § 2-9 (v) of the South Bend Municipal Code by the addition
of new sub-paragraph (7)which shall read as follows:
(7) Resolutions and Ordinances proposed by the City Administration
should. when at all possible. have the proposed resolution or proposed ordinance signed in
by the Chairperson of the Standing Committee having jurisdiction over the subject matter
addressed in the proposed legislation,with a copy being sent to the Council President upon
signing. In all cases the required accompanying cover letter should be signed by the
Department or Bureau Head as further addressed in sub-paragraph (5) above.
Section III. The Common Council of the City of South Bend, Indiana, hereby
amends Chapter 2, Article 1, § 2-10 (c) of the South Bend Municipal Code to read as
follows:
(c) Citizens members shall be appointed by the Chairperson of the standing
committee. In making such appointments, the Chairperson shall assure that the citizen
members are broadly representative of the South Bend Community. The Office of the City
Clerk shall send to each citizen member. notices of all Committee meetings along with
copies of proposed Bills sent to such committees for review and recommendation.no later
than two(2)business days prior to the meeting.
Section IV. The Common Council of the City of South Bend, Indiana, hereby
amends Chapter 2, Article 1, § 2-10 (e) of the South Bend Municipal Code to read as
follows:
(e) The nine (9) standing committees shall be as listed below:
(1) Personnel and Finance;
(2) Council Rules;
(3) Community and Economic Development;
(4) Parks and Recreation;
(5) Health gut Public Safety;
(6) Public Works and Property Vacation;
(7) Residential Neighborhoods;
(8) Utilities;mci
(9) Zoning and Vacation. Annexation.
Section V. The Common Council of the City of South Bend, Indiana, hereby
amends Chapter 2, Article 5, entitled "Boards and Commissions" of the South Bend
Municipal Code is amended by the addition of new Section 2-58 which shall read as
follows:
Sec. 2-58 Annual Notification of Members, Terms of Appointment
and Appointing. Authority Required.
(a) All Boards and Commissions addressed in this Article. and any other Board,
Commission. Committee. Authority or similar body charged with governmental
responsibility which was created by operation of state or local law must report in writing
the following information each year no later than February 1st:
(1)Name of Entity
(2)Name of Members
(3)By Whom Each Member was Appointed or Selected
(4)Term of Appointment
(5)Names of Officers for the calendar year,
(6) Confirmation of mailing address.telephone number,facsimile number. and
(7)Dates.Times and Locations of regular meetings.
fb) The above-required information shall be submitted to the City Clerk. Mayor,
and the Common Council.
(c) Any changes occurring during the calendar year shall be reported to the same
individuals listed in sub-paragraph (b) within five (5) working days of the change taking
effect.
Section VI. This Ordinance shall be in full force and effect from and after its

Dear Council Members:
The attached Bill sets forth various items discussed informally with various Council
Stephen Luecke Members. It proposes small changes on several items which we hope will enhance the
First District efficiency of our internal operations. There are basically five (5) areas addressed:
Cleo Washington (1)Changing the Organizational Meeting to an evening meeting so that it would

Roland Kelly 2 Having the Chairperson of the Standing Committee who would have

jurisdiction over a new piece of legislation, sign a proposed Bill initiated by the City

Linas Slavinskas (3) Having the City Clerk's Office regularly send a copy of the Committee
Fifth District meeting notice, as well as copies of the items to be heard by the Committee, to citizen

Sixth District (4) Renaming three (3) of the Standing Committees of the Council to better
