CITY WARNS RESIDENTS OF NON-LICENSED ARBORIST PERFORMING
TREE SERVICES WITHIN CITY LIMITS
SOUTH BEND The City of South Bend's Legal Department would like to inform the
public that any person performing arborist (tree) services in the City must be licensed by
the City of South Bend, as required by Sec. 4-19 of the South Bend Municipal Code. It
has been reported to the Police Department that individuals who are not licensed by the
City are approaching South Bend residents at their homes and offering to do tree work.
In August 2011, the City was able to obtain a judgment granting an injunction against
Gary Wayne Franklin(photograph is attached) and Rick Franklin, prohibiting them from
operating any tree service or arborist business within the City of South Bend. They had
been operating under Wayne's Tree and Landscaping Service, but the order prohibits
them from operating under any name.
The injunction does not allow the two men to operate within the limits of the City of
South Bend. However, it does not prohibit them from doing arborist work outside the
City limits. It also does not prohibit them from working as employees of a tree service
licensed by the City of South Bend pursuant to Section 4-19 of the South Bend Municipal
Code, or from advertising their services.
Please be advised any City resident should know that a person performing any arborist or
tree services must be licensed by the City and should be able to present a copy of the
license to the potential customer.
