Grandview Avenue for a distance of approximately 132. 8 ft. and a width of approximate- ly 13 . 86 ft. Alley located in Heintzman' s Addition and Klingel ' s Subdivision of Heintzman' s Addition to the City of South Bend. Also, West Grandview Avenue from the east right-of-way line of N. Cottage Grove Ave. to the southwest right-of-way line of Lincoln Way West (U.S . 20) for a distance of approximately 249.7 ft. and a width of approximately 62 ft; part located in Heintzman' s Addi- tion and Bank Out Lot 130 in the City of South Bend, Indiana. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows : SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the fol- lowing property: The first north-south alley east of N. Cottage Grove Avenue from the south line of Lot 1 (Klingel ' s Subdivision of Heintzman' s Ad- dition) to the south right-of-way line of W. Grandview Avenue for a distance of approximately 132. 8 ft. and a width of approximate- ly 13. 86 ft. Alley located in Heintzman' s Addition and Klingel ' s Subdivision of Heintzman' s Addition to the City of South Bend. Also, West Grandview Avenue from the east right-of-way line of N. Cottage Grove Ave. to the southwest right-of-way line of Lincoln Way West (U. S. 20) for a distance of approximately 249.7 ft. and a width of approximately 62 ft; part located in Heintzman' s Addi- tion and Bank Out Lot 130 in the City of South Bend, Indiana, hereby determines that it is desirable to vacate said property. SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited to, the following: electric , telephone gas, water, sewer, surface water control structures and ditches , within the vacated right-of-way, unless such rights are released by the individual utilities . SECTION III. The following property may be injuriously or beneficially affected by such vacating: Lot 1 Klingel ' s Subdivision of Heintzman' s Addition Lot 11 Heintzman' s Addition to the City of South Bend Lot 12 Heintzman' s Addition to the City of South Bend Lot 21 Heintzman' s Addition to the City of South Bend Bank Out Lot 130 SECTION IV. The purpose of the vacation of the real property is to allow for consolidation of the lots around the Martin Youth Center in order to provide parking and other site improvements . SECTION V. This project will allow for an expansion of programming from the Colfax Cultural Center and provide outreach to youth in inner city neighbor- hoods . Many community institutions are involved in this effort . We appreciate the funding support you have already appropriated through the Community Development Block Grant process .
