AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, APPROPRIATING $60,150.00 FROM THE
MORRIS PERFORMING ARTS CENTER IMPROVEMENT FUND
(FUND NUMBER 416)
STATEMENT OF PURPOSE AND INTENT
The Morris Performing Arts Center Improvement Fund (Fund No. 416) was established
for the purpose of renovating, remodeling, or otherwise improving the facilities at the Morris
Performing Arts Center. The Morris Performing Arts Center desires to make certain capital
improvements that will enhance its status as an efficient, updated, performing arts facility. These
proposed capital expenditures include $2,500.00 for life lines that will allow stage employees to
work above the stage safely, $6,500.00 for a theater intercom system that will allow stage hands
and traveling stage crews to communicate during stage set-up, $7,000.00 for a new Marley floor
to replace a deteriorated and unusable floor, $7,500.00 for Bistro chairs to accommodate the
ever-increasing number of diners to the space, $11,000.00 for new heat pumps in the box office
area to replace units no longer operating efficiently; $650.00 for a time clock for the part-time
box office employees; and $25,000.00 for portable concession stands to better serve patrons
during events.
The Common Council has determined that it is in the best interest of the City of South
Bend to appropriate the requested funds from the Morris Civic Improvement Fund (Fund No.
416) for the requested purchase of new and upgraded equipment.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, AS FOLLOWS:
Section I. The following sums of money are hereby appropriated and ordered set
apart from and within the Morris Performing Arts Center Improvement Fund for the purchase of
necessary equipment and licenses.

Respectfully report that they have examined the matter and that in their opinion, this bill is
being recommended to the full Council with a favorable recommendation as substituted by
anew title changing the money amount to match the bill.

Re: Morris Performing Arts Center Capital Improvement Appropriations Ordinance
Dear Ms. White,
I attach for filing with the South Bend Common Council an Ordinance requesting an
appropriation of $60,150, within the Morns Performing Arts Center Improvement Fund (Fund
416). Revenues from this fund are generated by the ticket surcharge and the fund is used
exclusively for capital improvements such as renovation, remodeling, and specifically here,
equipment to improve the facilities.
The improvements for which the Morns Performing Arts Center desires appropriation consist of
the following:
$ 650.00 Time Clock. Currently we have ten (10) part-time
independent contractors working in the Box Office. As of
January 1, 2004, these independent contractors will become
part-time employees of the City of South Bend, and a time
clock is needed to track the hours worked by these
employees.
$ 2,500.00 Life Lines. Life lines are safety lines and are needed for
use by the Morns Stage Manager, Facility Engineer and
others when working above the stage and seating area in
the theater to hang lighting, change lamps, and complete
various other project. The life lines are a safety
requirement of OSHA.
$ 6,500.00 Theater Intercom System. The theater currently has an
intercom system that is outdated and in poor working
condition. It was not upgraded during the Morns
renovation. The intercom is used by stage hands and stage
crews to help facilitate stage set-up and the running of the
show on stage.

$ 7,000.00 Marle. Fy loor. Purchasing a new Marley floor is necessary
to replace the current floor which is over 22 years old and
has deteriorated beyond a useable state.
$ 7,500.00 Bistro Chairs. Chairs are needed for the Morns Bistro to
accommodate the increased dining patrons in the space.
$11,000.00 Heat Pumps. New heat pumps are needed in the box office
area to maintain the temperature of the space for patrons
and employees. The current heat pumps are more than 20
years old, have exceeded their life expectancy, and are no
longer operating efficiently.
$25,000.00 Portable Concession Stands. New, portable concession
stands are needed to keep pace with the ever-changing
needs of the Morns Performing Arts Center. Portable
concession stands in the Morns lobby will allow us to
better serve refreshments to our patrons. The portable
concession stands can be moved to accommodate
promoters or other facility Lessees who wish to have them
located elsewhere during their event.
The Morns Performing Arts Center requests the Council's approval of this Ordinance that will
benefit the City and its citizens.

Re: Substitute Bill # 2-04
Dear Ms. White:
Attached is a Substitute Bill #2-04 which is an appropriations bill for the Morris
Performing Arts Center. Regrettably, however, the change necessitating this substitute ordinance
is in the caption. We just noticed that the dollar amount in the caption ($24,800) does not match
the correct dollar amount requested in Section I ($60,150).
Because the change is in the caption we know and understand that Bill #2-04 must be
republished and that it cannot receive public hearing and third reading until February.
We apologize for the inconvenience and thank you for your understanding. Dennis
Andres will appear at today's Council Committee meeting and at the public hearing in February.
