Co. $12,441.00 1137 W. efferson Mr. Hunt explained that Commission approval is requested for awarding a bid in connection with property located at 1137 W. Jefferson in the immunt. of $12,441.00. The Bureau of Housing's estimate is at $12,072.00. This is a bid that would go to Jurtin Construction based upon a prev'ous bid recommendation being rejected by the Redevelopment Commission. Mr. Robinson asked if this was the same bid that was presented at the last meeting or if the contract had been rebid. Ms. Holston stated that it was the same, other than the loan amount which had been increased. Mr. Robinson stated that there were questions abou the other bid and since it was the same one e still had the same questions. Mr. Hunt asked if his question was in terms of the Pureau of Housing cost estimate or the bid spr d. Mr. Pobinson stated that it was in the bid spread. Ms. Schwartz explained that we have already ac- cepted the bids. They have been advertised and the cnvdssion last meeting rejected the lowest bid. The next lowest bid is recommended for ConmLssion approval. Mr. obinson stated that he thought we were goin to rebid the contract. OLD BUSIINESS (Cont.) a. uonL�_nuea... one Did was almost $28,000 and there is still one Did at $10,000 and the one at $10,000 is what was rejected. He felt it was still the same problem. Ms. Holston said that part of the reason for the spread is the result of the number of people that have bid on the contract. There were eight that actually bid on the contract. Heritage Con- struction is very meticulous and precise in res- toration. They would look at different items and different treatments. The Bureau does have its general regulations. All contractors have to re- hab to the same specifications, the same quality of materials. Mr. naldson stated that he had a problem with how one outfit can do a job for $15,000 when there is a large spread between two bids. He asked if we h ve the specs that these contractors use and if ey are brand names that they use. Ms, Holston said there are parti:cular.types of materials that are required to be used. How- ever, that does not prevent a contractor from doing over and above specifications. She stated that Heritage could have very easily been over and ve in their bid. Mr. i.asecki asked if she had ever questioned them as to why their bid was so high. Ms. Colston stated that they do not question them as to why their bid was so high. Mr. punt noted that that was pretty standard practice as it is with the Board of Works. Mr. Bockaj of Bockaj Construction said that Heri- tage Construction has an overhead where smaller con actors don't have. He stated that he is one of Uie small contractors and Bockaj Construction bid on the job at $14,000. Mr. Robinson stated that, unless they are going up, e cost of materials will basically remain the 3ame whether you are a big contractor or a smal contractor. The only difference would be vol e. If the contractor is larger he buys a lot f materials. He stated that that is the only edge. -4- South Bend Redevelopment Commission Regular Meeting - March 11, 1983 5. OLD BUSINESS (Cont.) a. Continued... Mr. ckaj agreed. Mr. Rlobinson stated that we have a prevailing wage scale established and everybody ought to be paying the same wages. He said he still questioned not only Heritage Construction, but Char es Brown Maintenance who has done a lot of work here. He pointed out that Brown is bidding almo t $24,000 and V.V. Engle bid a little over $16, 00. Mr. ckaj stated that these are men like him- self who work for themselves. Mr. obinson stated that he knows that and it is one f his personal hang -ups but that was beside the Doint. He knows what the law is and he is not lizing Mr. Bockaj for that. Mr. $ockaj stated that he cannot afford these Mr. obinson asked what Mr. Bockaj meant that he can't afford it. He stated that he has to pay them anyway. Mr. Bockaj said he agreed but he can't afford the wages because the wages are all so high for the mmunt of work that he is doing. His men make more money than he does. Mr. Robinson said that he was not worried about Mr. 3ockaj as an employer. He was worried about the Nnployee who is entitled to make a decent livi g for his family and that is what it is all abou and why there is a wage scale. Mr. ckaj agreed and stated that the employee makep a good decent living. Mr. Tobinson said that he isn't too good and no way s it too good. Mr. 13ockaj stated he had a guy and paid him $9.90 an hour and he wasn't qualified. It took him six hours to paint a closet when it could take Mr. Bockaj one hour. Mr. obinson said that Mr. Bockaj should get rid of an employee if he is not qualified to do the work -5- South Bend Revelopment Commission Regular Meeting - March 11, 1983 5. OLD BUSIWESS (Cont.) a. conrinuea... Mr. ckaj said you can't just change employees all the time like that. That you can't just fire and hire them like that. Mr. Robinson stated that he has been in the busi- ness for 36 years, not as an employer but he has been working at it. He said that Mr. Bockaj ought to ow in an hour or two if an employee is not qualified and he can certainly get rid of him. Mr. ckaj asked how long it takes to get another guy 4nd train him for the same price. Mr. obinson said he could not answer that but that you can get trained people already. Mr. Nimtz asked if anybody else desired to be Mr. eese from Reese and Sons Construction read the following statement: Gentlemen: I have consulted with my attorney regarding pro- cedures that have been filed by this Commission to date, and particularly at the meeting on Fri- day, February 25, 1983. 3-I am firmly convinced that there is no basis in fact, or in law „ for this Commission to refuse to honor the bid that I have submitted under the proposal of Reese & Sons for the rehabilitation of the house at 1137 West Jefferson Boulevard, South Bend, Indiana. And the only basis or reason given by Commissioner Robinson was that, and I am quoting from the Tri- bune dated Friday, February 25, 1983: "There might be an erosion of quality of work... ". This is an outright slander and this is no reason to reject the bid. The idea of "there might be" is absolutely pure speculation. The same thing might be said for the iighest bidder. And to criticize the fact that a one -man business wants to operate at a figure lower than what you as C mmissioners feel is beneath the wage scale is anti democratic. A man can sell his labors with a price the market will pay. Possibly he can be expe ted to pay wage scale to those who work for him, but he can certainly work under wage scale that he chooses. Thank you. Mr. tntz asked if Mr. Reese would like to file that tatement. Mr. Reese stated that he did. Mr. Robinson asked Mr. Reese if he realized that when he paid people underscale that he was breakincT a federal law. Mr. leese said that at this particular time they know exactly. They read the specifications which the Bureau submits to them. They do realize the new scale, yes. Mr. Robinson asked if he realized that he is break- ing a federal law when you under pay. Mr. Bockaj stated that it is not breaking the law and that other towns do not have federal regulations. Mrs. Kolata explained that there was a misunder- standing. She stated that she thinks Mr. Reese pays his employees the wage, and that he does not pay himself the wage. Mr. Robinson asked if that was what Mr. Reese said. Mr. Reese said yes. Mr. Nimtz asked if there were any other cconents. He stated that there still wasn't a motion on the floc . OLD BUSIWSS (Cont.) a. c ontl _nuect .. . Ms. Holston stated that the Bureau of Housing does a walk through with the conctractor and their rehab specialist. She stated that the Bureau has general specifications to protect the quality of work the people receive. This is in the bid packets. They are held to mini- mum specifications. These are not low grade materials that they require them to use. So, therefore they are in essence protecting their qual ty by forcing them to use these types of mate ials. Mr, Hickey of Aardvark Construction stated that he works with the Bureau of Housing quite a bit. He stated that irregardless of what pay scale you are paying it doesn't change the fact that no one is ever paid until the work passes inspections done by the Bureau inspectors and then City Code Enforcement inspectors. He stated that until eve ping is exactly the way it's supposed to be, every minor broken glass pane or a piece of wood stock unprimed, that you will not get paid. So, everything else is insignificant up to that point, as long as its not outrageous like you are paying $3.25 or $5.00 an hour. These things are totally insignificant until the work is ap- proved and you are paid. He stated that the Com- mission is worried about the quality of work. The quality of work does not change because you are not going to pass those inspections, irre- gard ess, and you are not going to be paid. There is no way around it until you meet those qualifi- cations and inspections. Mr. Donaldson said that the discrepancy between the lowest and highest bid is what he had a prob- lem with. He said that Ms. Holston's inspectors go out and inspect the place and work up a cost estinate. He asked why some other outfit comes up with a $15,000 difference in what her inspec- tors come up with. He said that the cost estimate is $12,000. He said that a bid a little over that is right, but he asked how can anybody else go much further above that. Ms. Holston asked if he was talking about Heritage Construction. Mr. Eonaldson stated any of them. He said Charles Browr. is $23,000, close to $24,000, and there is a $1 ,000 bid and Ms. Holston's inspectors say it can done for $12,000. South Bend Rodevelopment, Commission Regular Meeting - March 11, 1983 5. OLD BUS ZESS ( font . ) a. Wntp-nuea... Ms. Holston said that there is a number of reasons why they might bid this high. They might not have access to the materials right away, they might not have anything on hand and they anticipate on going out and purchasing the iraterial totally and that might increase their cost. They might be building in more profit than some of these other people. They might have more overhead or any number of reasons why they might bid that high. Mr. naldson asked if we should be responsible for hat. Mr. iickey said he thought that the main . reason why here are higher bids is that the contractor might already have an abundance of work and is just hoping that no one else will bid on that or that maybe only one other company would bid and they too have an abundance of work. Maybe one of t ie two of them will get that job and make a very large profit on it. Mr. Donaldson stated he could not buy the dif- Mr. Wimtz stated that he and Commissioner Robin- son date back far enough on the Commission to when they had a rash of complaints that jobs wer 't done correctly. An audit was done by HUD whereby the Commission was responsible to redo 10 -15 houses or jobs because they hadn't been done right. Mr. Putler stated that there were many, many more than that. Mr. imtz said that the inspectors just weren't doinj their job and they were passing things that weren't right. This explains in part the concern at tiis time of the Commission, that they do not want to get into the same situation because they have a very good record now and they don't want to have a HUD audit a year from now and say it wasn't done right. Mr. Nimtz stated that he hoped our ins tors are up to the quality that we have had the last year or two. He asked that there be some understanding as to why there is some reluctance of the Commission in this regard. South Bend R evelopment Commission Regular Meet'ng —March 11, 1983 5. OLD BUSINESS (Cont.) a. uonriLnuea... Mr. Hunt noted that in January, 1980, there was a mo itorium placed on the housing program be- cause of the audit that was done in 1979. Since 1981 the program was reopened with new procedures and 3ince then there has been a drop in change orde s coming before the Commission. He stated that there are legitimate change orders. Mr. Bockaj said that some of the work you can blam on the contractor not doing the job right, but 3ome of the work you have to blame on the peop e in the house because they didn't take care of it. Mr. Donaldson stated that a contractor's work is ins cted after its finished and they are cleared of t at. Mr. ockaj said that when HUD comes back and say that a door is off they are going to go after the con actor not the homeowner. Mr. naldson said that is true, but when a job is finished the Bureau of Housing inspectors go in a d inspect it to see if the job is done right. The =tractors responsibility ends there. Once the Job is approved and you get your money any - thin that happens after that is not the contrac- tors fault. Mr. �iasecki asked Mr. Bockaj if he uses licensed pl rs and electricians. Mr. Bockaj said yes, they give him a price and he pays the wages. His insurance does not cover it if he does the work himself. He stated that is why lie wants the wage guidelines to drop a little bit down so that he can afford to do something with it. He stated that whoever graded the wages for laborer at $12.55 an hour and gave the car - pent r $9.90 an hour, there is something wrong. Mr. obinson said no, that is what the area wage scale established by.the Departmerit.of_Labor based on a survey of what the wage scale is in this area. Mr. ckaj said you can't give a qualified man less mone than a laborer who doesn't know the job. -10- South Bend Rledevelopment Carnnission Regular Meeting - March 11, 1983 5. OLD BUSINESS (Cont.) a. uonLa-nuea... Mr. obinson stated that they don't have laborers in t e craft that he represents, that they have Mr. Oockaj asked how they grade the laborer. Mr. obinson said part of the survey conducted by t e Department of Labor is for all crafts in the area where they do it. Mr. Hickey stated someone should come out in the field and see how those two people compare up. He said he would like to see how they conducted the survey. Mr. Robinson said that supposedly that is how they conduct the wage scale. He stated that is how the law says it is and how it is supposed to ba conducted. Mr. ickey said whoever that was did not conduct the in the proper areas. Mr. Bockaj said that you cannot compare small con- tractors with big companies because big companies get enough money to back them up and they have so much tax write off. He said the Commission is ccm- plai ing about that $10,000 for the guy over there beca se he wants to get the job and keep his man busy That is all he is trying to do. He is not try# g to rip anybody off or do anything else. Mr. Hickey said he thinks in the case of the low bid ere has to be some decision made on that. It s ould possibly be decided on a formula on how near to the cost estimate one can be below. Maybe the Commission should judge by the 10 -15 percent. In a one or two man operation a man is not bidding for a profit for this company. He is bidding for labor for himself and family. If that is the case then there certainly is a possibility of a 15% dif- ference. The Commission should have a formula so you ow what that percentage is. They know in the beginning that they were signing docments and ac- cepting the bid for that work. He stated he thinks that sounds like a logical choice for that problem. Wage control is another problem you have to come up with some kind of an idea on. Mr. obinson stated the wage requirements are es lished by the federal government. Mr. qimtz explained that Mr. Robinson's point is at we have some guidelines and things that we hive to comply with because of HUD money, and lve don't set the wage scale. We have to follow them. This is the difficulty of the Com- miss on. Mr. ckaj stated that Mishawaka doesn't have a wage guideline. There are many other cities aroLuid that don't have guidelines for wages. Mr. Robinson agreed that Mishawaka does not have it but we do in this community. Mr. Bockaj said that is not federal government. Mr. obinson stated that HUD does have wage scale sure ys and that is how they establish wage rates. Mr. ckaj said that is just a survey and no one says we have to follow those rules. Mr. 4obinson said that is Mishawaka and he cannot arguq about what they do. Mr. utler stated that the decision was made a couple of years ago that we are going to follow thoSE guidelines. Mr. Robinson said that several years ago the area wage scale was established, and Mishawaka hasn't done this. What Mishawaka does is their business and what we do over here is our business. Mr. Bockaj said that they are just asking the Com- mission to drop the laborer cost on this. He is not talking about electricians, or about plumbers. He is not talking about any qualified work. If the laborer is $6.95 an hour it is a reasonable amount of money. How much do you want a guy to make. He said he doesn't make $9.00 an hour when he co is his hours, the time he spends on the contracts, the time he estimates, the time he spends on the gas, tools, insurance, he doesn't make 9.00 an hour. Bids are going to have to be made to cover this cost Mr. Bockaj agreed and stated the guy probably won't make anything for himself but will keep his inan busy. Mr. Diasecki said he is talking about making the wage scale equal for everybody. Mr. Bockaj stated he does make money on that. He makes $300 -400 a week thats a decent wage for himself. He doesn't want to get himself rich He just wants to survive in this world, soh can pay his insurance, keep his family, drive a decent car. He is not trying to be rich He works 7 days a week and he is being told that he has to pay his guy more than that so he can screw up the job when he is not there. Mr. Robinson stated that not all employees are like that. He said if that is the kind of em- ploy es he had he would be looking for a differ- ent work force. Mr.' imtz said the Chair was going to conclude the discussion. He said he felt they had given everlbody an opportunity to speak. He asked if ther was anybody present who had not spoken and would like to say something. No one spoke. Mr. Nimtz again asked what was the pleasure of the commission. Mr. Robinson asked if they could rebid. Ms. Schwartz stated that the bids have already gone out and they are before the Commission. She stated that if the Commission wishes to reject any and all bids at that point, they will be able to rebid it. Mr. naldson moved to reject all bids. Mr. qimtz stated that it had been moved and seco ded that all bids be rejected concerning the Rehabilitation Loan for Nannie Smith at 1137 W. Jefferson. It was unanimously carries and all the bids were rejected and the order was given to rebid. Mr. Nintz stated the Chair appreciated all of comments and discussions and he felt they had good airing and display of democracy and all were represented. NEW BUSINESS approval requested for Resolution a. ComLssion No. 1578 redeclaring the East Bank Development Area to be blighted and amending the Develop- ment Plan. Mrs. Kolata explained that the resolution wil. amenl the development plan and add Parcel 3 -4 to tie acquisition list. We have already pur- chased a small strip of Parcel: 3 -4 along .the The unendment to the plan would be that we ac- quire the remainder of thas.parcel and acquit, blue metal building just north of the East Bay Emporium. PROGRESSIREPORTS a. Repot on Monroe Park Mr. iunt explained that the landscaping plans had oeen prepared by Mr. Dave Barncord of the Land cape Design Company of South ,Bend. Mr. Hunt noted that the landscaping plans were pre - viou ly approved by the Monroe Park Design Re- view Committee. Mr. Dave Barncord gave a-. on the land caping plans as prepared by the Landscape Design Company. Mrs. Kolata stated that this is being bid through the Board of Works. The Board of Works have been handling all of the complete site improvements for us and Mr. Barncord has been under contract with them since last fall b. RelDoi-t on bid o-oenina of March 7. 1983. Mrs. Kolata explained that we have received two bids in connection with Disposition Parcel 4 -28 4 -29, 4 -30 and part of 4 -3 and the vacated east west alley in the Central Downtown Urban Renewal Area (Indiana R -66). She stated that the first bid was from CLF Corporation in the amount of $151,863.25 and the second bid was from St. Joseph Office Building Associates in the mmunt of $150,000.00. 8.
