White made a motion that the minutes of the February 10,2020 meeting of the Council be accepted and placed on file. Councilmember Sharon L. McBride seconded the motion which carried by a voice vote of nine (9) ayes. SPECIAL BUSINESS There was no special business REPORTS OF CITY OFFICES Representing the City Administration: Kacey Gergely, Chief of Staff RESOLVE INTO THE COMMITTEE OF THE WHOLE At 7:05 p.m. Councilmember Tim Scott made a motion to resolve into the Committee of the Whole. Councilmember Karen L. White seconded the motion which carried by a voice vote of nine(9) ayes. Councilmember Sharon L. McBride, Chairperson, presiding. Councilmember Sharon L. McBride explained the procedures to be followed for tonight's meeting in accordance with Article 1, Section 2-11 of the South Bend Municipal Code. PUBLIC HEARINGS 1 REGULAR MEETING FEBRUARY 24, 2020 BILL NO. 03-20 PUBLIC HEARING ON AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED 1322 N. CHIMES, COUNCILMANIC DISTRICT NO. 4 IN THE CITY OF SOUTH BEND, INDIANA Councilmember Sharon L. McBride stated, The Zoning and Annexation Committee met this afternoon and we send Bill No. 03-20 to the full Council with an unfavorable recommendation. Joseph Molnar, Zoning Specialist for the Department of Community Investment with offices on the 14th floor of the County-City building spoke about the property located at 1322 Chimes Boulevard as it relates to Bill No. 03-20. Councilmember Tim Scott made a motion to amend Bill No. 03-20 to have type three (3) buffer landscaping installed adjacent to the single family district, no vehicular access to Chimes Boulevard, a fence on the interior of the landscaping, parking area to be closed off during off business hours and the building is to be constructed of brick on all sides. Councilmember Jake Teshka made a motion to send Bill No. 03-20 as amended,to the full Council with a favorable recommendation. The motion was seconded by Councilmember Sharon L. McBride and carried with a voice vote of seven(8) ayes and one(1)nay. 05-20 PUBLIC HEARING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, RE- AFFIRMING ORDINANCE NO. 10688-19 ESTABLISHING A WASTEWATER LOW INCOME ASSISTANCE PROGRAM Councilmember Henry Davis Jr. stated, The Utilities Committee met this afternoon and we send Bill No. 05-20 to the full Council with a favorable recommendation. Aladean DeRose, City Attorney with offices on the 12th floor of the County-City building gave a brief overview of Bill No. 05-20. Councilmember Tim Scott made a motion to send Bill No. 05-20 to the full Council with a favorable recommendation. The motion was seconded by Councilmember Jake Teshka and carried with a voice vote of nine (9) ayes. RISE AND REPORT Councilmember Sharon L. McBride made a motion to rise and report to full Council. Councilmember Jake Teshka seconded the motion which carried by a voice vote of nine(9) ayes. REGULAR MEETING RECONVENED Be it remembered that the Common Council of the City of South Bend reconvened in the Council Chambers on the fourth floor of the County-City building at 8:03 p.m.Council President Tim Scott presided with nine (9)members present. 2 REGULAR MEETING FEBRUARY 24, 2020 BILLS —THIRD READING BILL NO. 03-20 PUBLIC HEARING ON AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED 1322 N. CHIMES, COUNCILMANIC DISTRICT NO. 4 IN THE CITY OF SOUTH BEND, INDIANA Councilmember Henry Davis Jr. made a motion to adopt the amended version of Bill No. 03-20. The motion was seconded by Councilmember Jake Teshka and carried with a voice vote of seven (7) ayes and two (2)nays. 05-20 PUBLIC HEARING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, RE- AFFIRMING ORDINANCE NO. 10688-19 ESTABLISHING A WASTEWATER LOW INCOME ASSISTANCE PROGRAM Councilmember Henry Davis Jr.made a motion to adopt Bill No. 05-20.The motion was seconded by Councilmember Karen L. White and carried with a voice vote of nine (9) ayes. RESOLUTIONS BILL NO. 20-01 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA ENCOURAGING A MINIMUM ANNUAL PERCENTAGE OF THE TAX INCEMENTAL FINANCING FUNDS FROM EACH TIF DISTRICT TO BE ALLOCATED TO, AND APPROPRIATED FOR, TANGIBLE INFRASTRUCTURE IMPROVEMENTS BENEFITING ALL AREAS IN EACH TIF DISTRICT Councilmember Karen L. White made a motion to hear the substitute version of Bill No. 20-01. The motion was seconded by Councilmember Sharon L. White and carried with a voice vote of nine (9) ayes. Councilmember Jake Teshka stated, The Community Investment Committee met this afternoon and discussed the substitute version Bill No. 02-01 and we send it to the full Council with a favorable recommendation. 3 REGULAR MEETING FEBRUARY 24, 2020 Councilmember Sharon L. McBride made a motion to adopt the substitute version of Bill No. 05- 20. The motion was seconded by Councilmember Troy Warner and carried with a voice vote of nine(9) ayes. BILLS ON FIRST READING BILL NO. 06-20 FIRST READING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED 514 FRANCES ST, COUNCILMANIC DISTRICT NO. 4 IN THE CITY OF SOUTH BEND, INDIANA Councilmember Tim Scott made a motion to send Bill No.06-20 Area Plan Commission for March 16,2020 and then back to the Zoning and Annexation Committee on March 23,2020. The motion was seconded by Councilmember Henry Davis Jr. and carried with a voice vote of nine(9) ayes. 07-20 FIRST READING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, FOR BUDGET TRANSFERS FOR VARIOUS DEPARTMENTS WITHIN THE CITY OF SOUTH BEND, INDIANA FOR THE YEAR 2020 Councilmember Jake Teshka made a motion to send Bill No. 07-20 to the Personnel and Finance Committee for second reading and public hearing on March 9,2020. The motion was seconded by Councilmember Karen L. White and carried with a voice vote of nine (9) ayes. 08-20 FIRST READING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING ADDITIONAL FUNDS FOR CERTAIN DEPARTMENTAL AND CITY SERVICES OPERATIONS FOR THE YEAR 2020 OF $687,464 FROM GENERAL FUND (#101), $30,000 FROM POLICE STATE SEIZURES FUND (#216), $100,000 FROM GIFT, DONATION AND BEQUEST FUND (#217), $759,800 FROM LIABILITY INSURANCE PREMIUM RESERVE FUND (#226), $10,282 FROM LOCAL ROAD & STREET FUND (#251), 4 REGULAR MEETING FEBRUARY 24, 2020 $500,000 FROM MOTOR VEHICLE HIGHWAY RESTRICTED FUND (#266), $49,087 FROM TAKE HOME VEHICLE POLICE FUND (#278), $210,113 FROM IT/INNOCATION /311 CALL CENTER FUND (#279), $156,596 FROM COPS MORE GRANT FUND (#295), $50,000 FROM COUNTY OPTION INCOME TAX FUND (#404), $333,224 FROM MORRIS CAPITAL IMPROVEMENT FUND (#416), AND $980,000 FROM CENTURY CENTER CAPITAL FUND (#671). Councilmember Jake Teshka made a motion to send Bill No. 08-20 to the Personnel and Finance Committee for second reading and public hearing on March 9, 2020. The motion was seconded by Councilmember Sharon L. McBride and carried with a voice vote of nine (9) ayes. 09-20 FIRST READING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AMENDING ORDINANCE NO. 10685-19, WHICH FIXED MAXIMUM SALARIES AND WAGES OF APPOINTED OFFICERS AND NON- BARGAINING EMPLOYEES OF THE CITY OF SOUTH BEND AND FOR CALENDAR YEAR 2020, TO INCREASE SALARY FOR ONE NEW POSITION Councilmember Jake Teshka made a motion to send Bill No. 09-20 to the Personnel and Finance Committee for second reading and public hearing on March 9, 2020. The motion was seconded by Councilmember Sharon L. McBride and carried with a voice vote of nine (9) ayes. UNFINISHED BUSINESS There was no unfinished business NEW BUSINESS Councilmember Karen L. White spoke about the upcoming budget educational series for the Council. Councilmember Troy Warner spoke about the upcoming joint meeting between the Common Council and the South Bend Community School Board. Councilmember Tim Scott spoke about an upcoming event that he needs Council participation and assistance with. 5 REGULAR MEETING FEBRUARY 24, 2020 PRIVILEGE OF THE FLOOR There were nine(9) citizens of the City of South Bend that came to the podium to speak on a range of issues that they have within their own individual neighbors. ADJOURNMENT There being no further business to come before the Council President Tim Scott adjourned the meeting at 8:50 p.m. 6
