M. Publication of such notice shall b e , in on the 15th day of February 1904. Resolved furthurs that the entije wokk under the above contracts be accepted and final estimates thereon allowed. Notice of the resolution shall be pu lished in the South Bend Daily Times and South Bend Daily Tribune, stating that the Board will give a hearing upon the acceptance of such work at its office in the City Mall on the 23rd day of .7ebruary 1904. VACATION RESOLUTI€lN NO. 27. Resolved by the Board of Public Works of the City of South Bend, Indiana: That it is. desirable to vacate the following: A part of Milton street which lies West of the West line of High ;street in the South East Addition, also the alley running West from High Street between Milton street and Calvert Street in the South East A&Jt it i on. The following. property may be injuriously or beneficially effected by such vacation' The Henry Studebaker Park, the property of the City of South Bend. Notice of this resolution shall be published on the 19th day of Fetruary and on the 26th day of February, 1904, in the South Bend Daily Times. This Board, at its office in the City Hall on the 8th day of March 1904 at 10 A. M. will hear and receive remonstrances from all persons -interested in or affectd by these proceedings. Contract signed with the Oliver Chilled Plow Works for construction of .conduits underground to carry electrical current. Contract subject to approval of the Council. D. 1904 by and between the City of South Bend by and�rthrough it's Board of Public Works, party of the first part, and the Oliver Chilled Plow Works, a corporation organized under and by virtue of the laws of the state of Indiana. as party of the Second part,- ;YI TNESSETH --- For convenience the Oliver Chilled Plow Works, its successors and ass- igns, will be hereinafter spoken of and designated in this contract by the word "Company": That the party of the first part does hereby grant unto the said Company, subject to any laws anii ordinances now in force, or hereafter enacted or put in force as police regulations, authority and permission to use the following; described street: alleys and public places of the city of South Bend, to -wit; --Beginning. at ehe West "lase in said City as a point North of Washington street thence through and along the most convenient alleys to North Michigan street at a point East of Center Street; the- nce West across interveining: streets and alleys and on and along; Center street and the alley which is as extension of Center street, to the westward to North Taylor street, thence South on North Taylor street to Wash ington Street, thence West on Washington street to Scott Street, thence South on Scott street to West Jefferson street, thence West. on Jefferson street to the alley West of Chapin street,`.begin- 14,, at the intersection of Chapin street and Jefferson street, thence South on Chapin - street to Napier,street, thence West on Napier to Pine street, thenc< South on Pine street to the Lake -Shore and Michigan Southern RI-T-t (f W.--_y; also upon such private ways as said Company may deem convenient, for the purpose of transmitting electrical euT4@4% for power and light or either of them, by means of poles, wires, conduits, pipes an4-other appliances, equipment and apurtenances, which grant is and shall be upon the following terms and conditions, that is to say: 1. Before entering upon any of the streets, alleys or public places .©f<'tdid City, said Company shall cause to be executed and filed wi h the comptroller of said City a bond in the penal sum of $2000.00 with surety to be approv ed by the Board of Public Works of said City. Conditionaai, that said Companr shall, at all times, main- tain it's poles, wires, conduits and apurtananees in a &Food and safe condition, and pay to said City or to any person all damages that may be sustained by reason of the erection of such poles or wires in said City, and keep said City.harmless from all losses, costs and damages that said City may at an,, time incur 1fy reason of erection and maintainance of the poles -and wires, pipes, conduits, casings or appurtenances of said Company through the sai" City. 2. Whenever the said Company shall desire to construct any appliances for the distrubition of electrical current as aforesaid, it shall prepOre and place on file in the office of the Board of Public Works of said City, maps, plans and specifi- cations of such proposed construction, which specifications ahall include all excu vations and all underground apparatus and ap;liances, showing the exact location of al poles, wires, pipes, conduits, casinE-s, ducts and other appliances, the depth below the surface of he street, and, in general, where and how such construction is to be done,and shall conform in all respects to the provisions of this contract, and any ordinance of the Common Council relating to the public safety ana health, which maps, plans and specifications shall be approved without unnecessary delay by the said Board of Public Works, and a permit to cut into the streets, alleys, and ppblic places or to go upon said street for overhead construction, shall be issued to said Company before such work shall be begun, it bemng understood, howeverm that alleys instead of streets shall be used whenever practicable. The Board of Public Works shall have the power to designate at what point in the streets, alleys or public places shown upon such maps, plans and specifications, the poles, wires, trenches, conduits, cassinrs, pipe.j or other appliances used by said company in distrubition of electrical current shall be located, In case of dispute between any property owner and said Company as to the location of any o`:' the applian- ces aforesaid, or a change of location of any such trenches, conduits or other appli- ancesthat may be deemed neces ary, the decision of the Board of Public Mork, as to such location shall be final. Upon filing any such maps, plans and specifications, and their approval as aforesaid, said Company may take the specified construction and place the poles and wires, and lay -the specified pipe::, conduits, casings and other appliances underground all with suitabld and safe connections and appurtenances to constitute an entire plant which said Company may therefore maintain repair, improve, extend, add to, and oper- ate during the life of thisgtant, subject to it's terms and conditions; such exten- sions always being first subject to the approval of the Board of Public Works as here- in provided for.. 4. Said C ity will not be responsible to said Company or ton any property owner of said City by reason of the erection and maintainenee of any pole or wire or the construction of any conduit, casiAg or a;)purtenance at its own risk so far as any authority hereby given is concerned. 5. Said Company shall erect said poles along sid route alont the outer curb -or of the sidewalks .just inside said -urt, in such a manner as bit to injure the curb stones, or planLk, or shade trees along the same, and so as not to be iin front of the door of any persons house, Or of the, entrance to any persons house barn of lot. 6. It is expressly agreed and understood that the right and authority to transmit electrical current by overhead construction herein granted, is limited to electric(al Current of a voltage of not more than 550 volts, and that any authority granted herein., to transmit electrical current of higher voltage than 550 colts, is upon the express terms that such current of more than 550 volts shall be transmitted through the streets, a'leys and public places of said Cit;,r by means of underground construction in accordance -with ordinances now in force or to be put in :force gover- ning ..such construction. 7. Said City may, at any time, alter, add tk,. amend or repeal any provisions of this ordinance a27)Ld reserve the right hereafter to impose any burden or -tax, or license.fee, for each pole erected on said streets, the Common Council may deem proper as a condition upon which said Company may maintain its poles and wires on the streets of said City. 8. Said City reserves the right to the free; use of -1 times of any anq all poles erected or to be erected for the purpose of conveying; electrical or other tyres of the fire, police, and any and every other departure nt of said City goverment. 9. To each of the terms, conditions, provisions, stipulations and requirementG of this contract, the City of South Bend, by and through it's Board of Public Works, party of to first part herein_., and the said Oliver Chilled Plow Works, party of the second part herein do fully agree and bind themselves, their successors and as signs. 10. It. is agreed and understood and made a part of the considration for this contract, that therights and priveleges herein granted shall continue for a period of forty years from the ratification of this contract by the Common. Hearing was ifiven the assessment roll for -he Pipe Sewer on Navarre Street(Short) under Improvement Resolution +171. In the matter of the above Improvement no remonstrances appeared and no remora-=. strances were filed. The Board find that the property assessed and as shown on said roll in each case respectively is benefitted in the amount of the assessment as shown on said roll and that the assessment roll filed Feb. 9th, and the final estimate allowddd Feb. 9th 1904, should be in all thing s ratified confirmed and approved.
