The Board met in roular session at 10 A.M.- present being the members of the Board, City Engineer, Street Commissioner, and Clerk. A petition was filed for a pipe sewer on Navarre street from Burroughs street east to the angle in Navarre. The Board met in consultation with the City Attorney and the City Comptroller until the noon hour. President. Tuesday.. -Oct, 6th, 1903. The Board met in regular session, all members; being present. The Electric Light Company were ordered to place a mid-nite lamp at the inter- section of Marine street and -Indiana avenue.. Petition asking that sidewalks on Madison street east from roin ichigan tobehe first alley east thereof be laid next to the curb and the sidewalk including made 5' in width, granted. JAI, President. SPECIAL MEETING. The Board met in special session at 7:15 P.M. present members of the Board and City Engineer and Clerk. In the matter of the grade, curb. and walk improvement on Calvert street, under Hearing was given on the assessment rarfindathatithe Estimat improvement resolution #115. No remonstrants appeared and no remonstrances were filed. oa property described in said roll is benefited respectively in the amounts of the assess- ments shown on said roll. The Engineer filed his estimates as follows: Indiana avenue 996.60; Ewing avenue $104.40; Fox street 362.20 and Poland street- 896.50. No remonstrants appeared and no remonstrances were filed. The Board find that the benefits to the abutting property and to the City ofSouth Bend are should al to the same estimated cost of the improvement, and said declaratory resolutions are hereby in all things ratified - confirmed and approved. First hearing on Vacation Resolution +24, adopted on the 19th. day of September, 1903, for the vacation of that part of an alley in the Burroughs iaddition fo o the City of ws: lying east South Bend, lying south of lots 31 and 32 in said addition described as of the following line and west of portage avenue; beginning at a point 14 feet north and 6.2 feet feet east of the northeast corner of lot 19, in the said addition, theneb south 42 degrees east to the south line of said alley. The Board finding no remonstrants present and no remonstrances being filed, that said lots 31 and 32 and 169 17, and 18 in the Burr- oughs addition to the city of South Bend owned by Fred W. Keller are benefited in the amount. of $20.00. The Board accrodingly fixes the assessment of Fred W. Keller at 20.00. property will be injuriously effected by such vacation. Now comes Fred W. Keller and waives notice of amount of assessment and the hearing of the amount of assessment under Vacation Resolution #24, and pays into the City Treasury of the City of South Bend, the sum of 20-.00 without further proceedings. SPECIAL SESSION, 7:15 P.P.M- The Board met ih special session, having under consideration. Co the hearing on the roll of awards and assessments in the condemnation for the opening o der Condemnation Resolution +129 which said roll was adopted on the 9th. day of September919039 The Oliver Chilled Plow Works, by Jos. D., Oliver, appeared before the Board and submitted ti following communication relative to their awards of damages, which follows- viz: To the Board of Public Works, _ South Bend, Oct* 3rd, 1903. South Bend, Ind.. Dear Sirs; We have received your notice of our awards of damages in the Colfax avenue opening. The sum alloted us by no means represents the adan►age actually occasioned by the taking; of the real estate and the damage to the Hill Phoenix Mill. The portion of this will which would remain would not give sufficient floor space for milling purposes, so we will, as conditioned below, remove the mill building from the space appropriated. If we were to look upon this matter as a business proposition we would be prompted to appeal from your decision, but in view of the public interest in the Colfax avenue bridge, we will abide by your decision provided that you can assure us that the driveway from Michigan stre at Colfax avenue to what is known as the City Roller Mills, on the north side of said avenue, will not be molested. Your Board is probably aware , and. the City records and has been recognized undoub- tedly show, that the driveway was authorized over fifty years ago, If the Board will by the city in planning the garde for that portion of the avenue. assure us that the grade of the street relative to the proposed bridge construction will also recognize this driveway, we will abide by theawards of damages without appeal. And the Board being fully advised in the matter and knowing that the plan, grade and pro- file on said avenue has always been maintained with a view to the us.e of said driveway, Now therefore be it resolved by the Board of Public Works, that the proposition of the Oliver Chilled Plow Works be accepted and the Board hereby instructs the Engineer to plan improvement of said avenue with view tthe continued osaid driveway to the use confirm and legalize of said driveway. No further remonstrances were filed and no remonstrants appeared. The Board finds that the proper-iies described in the assessment roll are respectively damaged and benefited in the amounts shown on said roll, and that said roll filed on and adopted on 9th. day of September, 19030 should be and the same is hereby in all thing ratified, confirmed and approved. Contracts signed with McSherry, and Baer for the improvements on Fox` street and Ewing avenue. Lake Shore and Michigan Southern were notified to plank their crossing at High street to its full width of sixty feet. The South Bend Electric Company were notified to discontinue the lamps in the Parks. The South Bend Eletric Company were notified to place a higher pole and set same ten feet farther east from its present location on +851 W. La Salle avenue. - South Bend Fuel & Gas Company were notified to put their walks in a passable condition along their property. Bell Telephone Company were notified to place their wires at 619 Park avenue in a condition so as to protect the trees. Miller & Donahue Lumber Company were notified to place a walk along the west side of their property on Carroll street. Pres ent. M11 Friday ...... Oct.l6th, 1903. South Bend Electric Company notified to change wires so as to protect treet in front of +127 College street. South Bend.Elettftc Company notifed to remove transmission poled from in the roadway of Emerick street. John Beck notified to repair walks in front of his property on Emerick street on the north side of Jefferson street. Plat of Smith and Holloways Sub-div. of Lot 7 Kuntsman & Mayers Add. approved. Permission granted the South Bend Mnfg. Co. to -make certain excavations- near the City -Water Wroks reservoirs work to be done under the direction of the City Engineer. Communication received from F.A.Miller, relative to defective material and work- manslsltp on the Monroe street Efrick Pavement. Referred to the City Engineer. The Engineer filed the Assessment Rolls and Final Estimates for the Brick Pave- ment on Thomas street from Chapin street to Walnut street; and on Franklin Place from Washington street to Jefferson Street, under improveme-nt Resolutions +138 and 140 respect- ively. Resolved that notices as to the amounts of assessments be published for six consectuive.days in the South Bend Daily Times and the South Bend Daily Tribune, stating that this Board will give a hearing on such assessments at its office in the City Hall on the 3rd. of November, 19039 at 7:15 P.M. w Resolved further that the entire work under the above contracts be accepted and approved and the final estimate thereon allowed. Notice of this resolution shall be published on the 21st. day of October, 1903, in the South Bend Daily Times and the South Bend Daily Tribune stating that this Board will give a.hearing upon the acceptance of such work at its officein the City Hall on Novemebt 3rd, 1903, at 7:15 P.M. �P;resident. 643,' Friday.....Oct. 23rd, 1903. The Board met in regular session, Mr. Papczynski being absent. Only routine business was transacted. Tuesday ....... Oct. 27th, 1903.. Bids received and opened for the plumbing in +7 Hose House, Voelkers & Wahlen being the lowest bidders were awarded the contract. Price...4457.00. Petitions filed and granted asking for permission to do by private contract the .grading and curbing of Smith street, Sixth street, and Linden avenue through the Smith and Howollelladdddit i on. Plat of Fred Wo Kellers Sub-div. of Lots 16,17,182 and 32 Burroughs add. approved. Petitions filed for a sewer on Howard street from Notre Dame ave* to the river; also for sidewalks on Howard street from Notre Dame avenue to Leeper avenue. The Engineer was inttructed to investigate the property lines at Portage ave.. and Rex street, at lot 34, s.e.corner, and have same changed to correspond with the inter- secting streets. (145 ) curbing and walks on Linden ave(144)9 Grading, curbs and walks on Sadie street (146), and grading curbing and cement walks on Dayton street (121); no remonstrants appeared and no remonstrances were filed. The Board find that the property assesed in said roils is benefited in the amount of the assessments as shown on said rolls, and that the assess- ment rolls filed on the 10th. day o_ October, and the Final estimate allowed on the loth. day of October, should be and the same are hereby in all things ratffied, confirmed approved. In the matter of the Grade, curbadn walks on St. Joseph street (133), and ,the same on'Olive street (147).-the hearings were postponed until Friday A:.a. Oct. 30th, 1903. Geo. Barnhardt remonstrated against the buldge in his sidewalk just north of Washington streetq on Olive street. C. Soens remonstrated against the improvement on St.Joseplg street for the reason that the grading along said street and his property in particular had not been done. The Engineer -was instructed to investigate. .> President. Friday .......... Oct. 30th, 1903.. t The Board of Public Works met in regular session all members being present. Bond of Voelkers & Whalen for the plumbing in +77 Hose House approved. Bond of P. Suzio on -Catalpa avenue approved. a Contract for Fassmcht avenue sewer postponed until Saturday, Oct. 31st, 1903. Bids received for the electric street lighting of the City and contract awadded the,South Bend Electric Company — the lowest bidders. In the matter of the Grade, curb and walk on Olive street, also for same on St. Joseph street, the engineer reports that~ he has investigated the objections raised and finds that the matters are of no serious consequence and that he has instructed the dontractors to repiar same. No remonstants appearing, the Board find that the property described in said roll is benefited in the amounts of the assessments shown on said roll and that said assessment roll filed on the loth. day of October, and the Final Estimates all on the loth. day of October, 1903, should be and the same is hereby in all things ratified, confirmed and approved. ;res i dent . Petition filed for the condemnation of an alley in the rear of Marion - Burroughs - and Navarre streets from Burroughs street east to the 2nd. alley between said streets. Referred to Engineer for proper description. President. Saturday.... Oct. 24th, 1903. The Board -met in regular session all members being present. South Bend Eleetric Company ordered to place a mid -nits -lamp on Rush street be- tween Bronson and Sample at- the intersection of the alley between the points named. Communication from E.C.Westervelt regarding improvements over the tail race at the foot of Colfax avenue referred to the Engineer and City Attorney. Grant Trunk Western Railway Company were notified to put Division street in a passable condition by fi ;ling the low places along said street, The Board having under consideration the assessment of benefits and the awards of damages in the condemnation proceedings brought under Condemnation Resolution +10 A. adopted on the 14th. day of July, 1903, and confirmed on the 25th. day of July, 1903, find that the property affected by said condemnation are respectively benefited or dams -aged in the amounts shown on said roll of awards of damages and assessments of benefi-b made and agreed upon this 24th. day of October, 1903, which said roll'of awards and IN" assessments is made a part of this record. Resolved that notices of amounts of assessments and awards of damages be personal —ly served upon the owners of the property in question, stating that this Board will give a hearing on the matter of such awards and assessments at,.its office in the City Hall on the¢ 6th. day of November, 1903, at 10 A.M. Boand of Hoban & Roach on LaSalle, Sycamore, Bridge and Colfax avenue sewer accepted and approved. Clerk instructed to notify the Michigan Central to shave their planking along their tracks on Emerick street. . Also to remove their switch levers on the east side of their tracks out df the street. In the matter of, the opeing of Main street, -the -Comptroller reports that the awards of damages had been paid and it was reoolved by the Board, that- the Chief of Police n.oti.fy S.amuel..:and Arthur P.Perleyo,, and, also, Martin .& Page to remove buildings now located in the street within ten days from -date. a And :that t-he street Commissioner be instructed to place this portion of the street in a passable condition. Lake Shore & Michigan Southern railroad ordered to plank their,crossing at May street 638 Oct. 14ths. 19-03. The Board met in regular session:, President McInerny being absent. Bids received and opened for the construction of a pipe sewer on E.La, Salle ave. -Bridge street, Sycamore: Street and. Colfax avenue; also, -one onCatalpa avenue; and for the trunk surer on Fassnacht avenue. Referred to Engineer for tabulation. In addition to routine business the Lake Shore & Michigan Southern were ordered to place all -nice lamps at their Lafayette street and Prairie avenue crossings. The Terre Haute and Logansport Railway Company at their Indiana avenue.crossing. The Engineer filed the assessment rolls and final estimates for the grade, curb and walks on, on Sadie. street , walks and curbs on Linden avenue, walks and grading on Linden avenue. grade. In the matter of the proposed street lighting contract; Be it Resolved by the Board of Public Works that the specifications filed this 3rd. day of Oct. 1903, and approved by the City'Engineer'be approved by this Board and that notices be published in the South Bend Daily Times and the South Bend Daily Tribune, on. the 3rd. day of October, and on the loth day of October, 1903, stating that this Board will receive bids on said street lighting on the 30th. day of October, 1903. In the matter of the water connections on Monroe street. No remonstrants appeard and no remora trances were filed. The Board find that said connections have been made in conformity with the specificationsof the Board of Public Works and orders 6 of the Common Council, and the _assessm nts roll for said connections filed Sept. Z 16thl 19032. should be and the same is hereby mall things ratified, confirmed and approved. In thematter of the Brick Pavement on Marion and Burroughs street, Res. 115, postponed from Tuesday last; the Board find that the property of Wm. Knowlton is not benefited in the amount of his assessment by $29.76; Ed. Staley got benefit —ed in the amount of his assessment by $35.00; and Mrs. Frank not benefited in the amount o her assessment by $25.00._.The ,Board incorporated said changes on.said roll, and no further objections being raised against said roll, The Board find . that the assessment roll filed Sept. 16th, 1903, and the final estimate allowed Sept.16, 1903, and the assessment roll as amended Oct, 3rd, 1903, should be and the same is hereby in all things ratified, confirmed and approved.
