Routine business required the attention of the Board for some time, after the consideration of same the Board adjourned into executive session. ----- Pre s. TUESDAY EVE. SEPT. 1 st. 1903. The Board met in special session in the office of the Board at 7:15 P.M., all members being present. The Board having up for consideration and final hearing the Assessment Rolls and Final Estimates for the Grade, Curb and Walk on Indiana Ave. from Miami to Leer; E. Navarre from Michigan street to the east line of Lot 60 in 'H. & W. Addition; also, for the pipe sewer on E. La Salle from Alley east of St. Pete to Eddy street. All under Improvement Resolutions 122,1329123 respectively. In the matter of the fie, Curb and Walk on Indiana ave. and the pipe sewer on E. La Salle ave. No remonstrants appeared and no remonstrantes were filed. The Board find that the property assessed in said rolls is benefited in the amount of the assessments shown on said roll and that the Assessment Rolls filed Aug 21, 1903, and the Final Estimates allowed Aug. 21, 1903, should be and the same are hereby in all things ratified, confirmed and approved. In the matter of the Grade, Curb and Walk on E. Navarre st., Geo Rochstroh appeared and remonstrated agiihst the amount of his assessment. The Board postponed the hearing on said improvement until Tuesday Eve. Sept. 8th, 1903. Hearing given on the Declaratory Resolutions for the following street improvement Pipe Sewers on Portage avenue, Bartlett st and St. Joseph st, Marion Boulevard and Navarre st, Calvert st. and Catalpa avenue,.Monroe street, E. LaSalle avenue, Bridge, Sycamore and Colfax ave, and the brick pavement of the alleys south of Jefferson St. all under Improvement resolutions nos. 154, 1559 1569 1539 1529 1512 150 respectively. The Engineer filed his estimated cost of the improvements as follows: Portage ave. $10500.00 Bartlett and St. Joseph. 4400.00 Marion Boulevard and Navarre st. 3100.00 Calvert St. & Catalpa ave. 4200.00 Monroe st. 1850.00 E. LaSalle.Sycamore & Bridge, 4900.00 Alley Brick south of Jefferson 1375,00 No remonstrants appeared and no rei=Lonstrances were filed. The Board find in each and every case in said improvements that the benef!i s to the property anu to the City of South Bend are equal to the estimated cost of the improvements and that said Declaratory Resolutions are hereby confirmed and approved. The Board met in regular session in its office at 10 A.M. all members being present when the meeting was called to order. Bond of T. C. Barnes for grade, curb and walk on Indiana avenue approved. Bonds of C. H. DeFrees, on Euclid and Brick avenues, James Nelson on OF La Salle avenue, and Robert, Hoban and Roach on Prairie avenue, released. J.a.Barker ordered to sod the cut -across path through Howard Park and properly guard same against a repetition. Bids were received and opined for sewers on Portage - Bartlett - Marion Boulevard - Calvert st. and Catalpa avenue - Monroe st - E. La Salle, Bridge and Sycamore - streets; also brick pave meth of the alleys east of Jefferson street. Same referred to Engi74eer for tabulation. Meeting adjourned at 11. Feldman appeared before the Board in support of a petition to vacate a ten foot strip along the north side of Vistula avenue from Washington street to Jefferson street. Contract signed. with J.W.Donahue for grade, curb and walk on Franklin street Communication filed and consideredfrom the Birdsell Mnfg. Co. regar"iug a building at +428 S. Carroll street, now used as a bakery, and in its nature is considered a fire trap. �� zA Hearing on the relocation of May street continued until Sept. 8th, 1903. v President. � 613 Sept. 5th, 1903.. L. H. Webster awarded the contracts for the pipe sewers on Bartlett street, Marion Boulevard, Portage avenue, and Monroe streets. Defrees and Beyrer the brick paving of the alleys south of Jefferson street. The bids on Catalpa avenue and the La Salle, Bridge and Sycamore street sewers rejected. Grade on Emerson avenue approved. The Engineer filed the assessment rolls and final ®stimates for the grade, curb, and walk improvement of Bowman street, under improvement resolution +127. Also, for sewer and water connections on Thomas street from Chapin street to Walnut street. Resolved that notices of the amounts of assessments be published for six .con- secutive days in the South Bend Daily Times and the South -Bend Daily Tribune,'commencing on the 8th. day of September, 1903, stating that this Board will give a.hearin.g on,the amount of such assessments at its office in the City Hall on the 15th. day of Sept., 1903. at 7:15 P.M. - Resolved further, that the entire -work under the above contracts be accepted and approved and the final estimate thereon allowed. Notices of this resolution shall be published on the 8th. day of Sept., 1903, in the South -Bend Daily Times and the South Bend Daily Tribune stating that this Board will give a hearing on the acceptance of such work at its office in the City Hall on the 15th. day of September, 1903, at 7:15 P.M. m President. Tuesday Sept. 8thy 1903.. The Board of Public Works met in regular session in the office of the Board -at lA A.M. all members being present when the meeting was called to order at 10.. A.M. Hearing was had on the assessment roll of benefits and awards of damages in the relocation of May street. The Board find that the property of Del C. and Kittie Mg Leer is benefited in the amount of $50.00 above that shown on said roll; that the property of John Rohrer and the Joel Shively estate is not benefited in the amounts shown on said roll by.25.00 each respectively; and the Board accordingly caused said roll to be so changed that the above additions and reductions iaay appear thereon. No remonstrants appearing against said amended roll the Board find that. said roll should be and the same is hereby confirmed, ratified, and approved, and that the assessment Roll of benefits and awards of damages filed duly 25th.,�1903, is accordingly confirmed, ratified and approved. i Improvement Resolution +157. Improvement Resolution +163.Resolved by the Board of Public Works of the City of South Be -Indiana: Thatan improvement be made of the kind, size, location and terminal points as_ follows: A Trunk sewer described as follows: Beginning at the end of the present Trunk Sewer on Michigan avenue and Brick avenue, thene south along Brick ave* with a 72" sewer to the intersection of La Porte ave. and Fassnacht ave.; thence west on Vassnacht ave. with a 72" seer to Wilber st., thence west on Fassnact ave. to Johnson st. with a 66" sewer, thence south on Johnson i.16.Kea#aod avenue with a 66" sewer, together with necessary appurtenances shown on plans. Be it resolved by the Board of Public Works of the City of South Bend, Indiana: That an improvement be made of the kind, size, location and terminal points as follows: The grad- ing of the roadway to the'established grade, and the construction of cement curbing on boh sides of'the roadway and the laying of cement sidewalks on the north side only of W.Sample at. from Harris at. to the alley west of Kosciuszko street. Said improvement shall be known and designated as the W&Sampike at. grade, curb and walks and shall be constructed according'to'the plans and specifications prepared by the City Civil Engineer filed -here- with.- Notice of this resolution and proposals for bids for the execution of the above work shall be pablisped on the-10th. and on the 17th. days of Sept:, 1903, in -the South Bend Daily Times and the South Bend Daily Tribune. This Board will give a hearing on ,this resolution at its office in the City Hall on the 22nd. day of September, 1903, at 7:15 P.M. and will receive bids up to 10 A..M. on the 23rd. day of September, 1903. The Board met in special session in the office of the Board on the above date. Present being Pres. McINerny, Messers Nicar, Papcaynski and City Engineer Hammond, also, Walton F. Suchanek as Clerk.. Hearings were given on the ksses�ment. Rolls, and Final.Estimates f6k,the Grade, Curb and Walks on Allen street., Navarre street (Postponed from Tuesday eve. Sept.lst,:.1903) High street and for walks on Pennsylvania avenue. In the matter of the grade and curb on High street under improvement resolution *.,1t07;,.: land the improvement of cement walks on Pennsylvania avenue under improvement Resolution + 136. Several remonstrants appeared and objeeted`to the class of work done and in one instance the price charged for same. The Board took the objections raised under advisement and postponed hearing; on said resolutions until Wednesday A.M. Sept,9th, 1903.. In the matter of the grade, curb and valk on Allen street under improvement resolution # 134; also, the grade, curb and walk on Navarre street under improvement resolution + 132. In the former the Board find that the property described in said roll for said improvement is benefited in the amounts shown on said roll and that the Assessment Roll filed Aug. 26th, 1903, and the Final Estimate allowed Aug. 26th. 1903, should be and the same is hereby in all things ratified, confirmed and approved. In the matter of the latter improvement - the Board find after a thorough investigation that the properties of Fred Rochstroh and John A. Wunderlich arenot benefited in the amounts shown on said roll by $24.00 each and accordingly cause said roll to ue so changed that the findings of the Board showing the reduction of $24.00 from each of the respective assessments appear thereo: Furth6r the Board find that the properties of Seth Hammond and Leslie C. Whitcomb are each benefited in the amount s of $6.00 above the assessment for said properties as shown on said roll, and the Board have caused said roll to be so changed that the increase in the above parties assessments thereon may appear. Said Roll having been so amended and no remoistrants appearing - the Board find that the property described in said roll is now benefited in the amounts of assessments as shown on -said roll, and that the assessment roll filed Aug. 21st, 1903, and the Final Estimate allowed Aug. 21st, 1903, should be and the same is hereby in all things ratified, confirmed and approved. President. The Board met in regular session in the office of the Board At 10 A.M. All members of the Board being present. The Board having under consideration the assessment of benefits and the awards of damages in the condemnation proceedings brought under condemnation Resolution #12, adopted on the 25th. day of July, 1903,'and confirmed on Aug. 14th, 19030 the Board find that the properties affected by said condemnation are respectively damaged or han;.r benefited in the amounts shown on the roll of awards. and assessments made and agreed. upon this 9th. day of September, 1903, which roll roll t*ff awards and assessments is ma made a part of this record. Resolved that notices of the amount of said awards and assessments be personally served upon the owners of the properties mentioned, or proper notice given by legal publication in cases requiring such legal notice, stating that this Board will give.a hearing on the matter of such awards and assessments at its office on the 29th. day of September, 1903, at 7:15 P.M. In the matter of the hearing on the Assessment Roll and Final estimates for the Grade and Curb on High street under improvement resolution # 107: also, for cement walks on Pennsylvania avenue from Carroll to High street under Improvement Resolution +136. The Board having considered the objections raised at the meeting of the evening before, and having heard the Engineers report as to the character of the work, find that the properties described in said rolls are each respectively benefited in the respective amounts shown on said roll, and that the Assessment Rolls filed Aug. 26th, 1903, and the Final Estimates allowed Aug. 26th, 1903, should be and the same are hereby in all things ratified, confirmed add approved. In connection with the above work on Pennsylvania avenue the Contractor was notified to repair some four blocks of the walk.u-:. President. Only routine business was transacted by the Board of Public Works on Fir day and Saturday, Sept. llth. and 12th. 91903. Tuesday. ...•Sept. 15th, 1903. The proposJtion of A.J.Jacquith for an alley from Chapin street to Prairie avenue accepted. Petition filed by Fred W., Keller for the vacation of part of an alley in Burroughs addition and a proposition to donate a similar strip for an alley. Pre side SPECIAL MEETING. 7:15 P.M. Hearings given on the assessment rolls and final estimates for the Grade, Curb and walk improvement of Bowngul sire from the E. Line of the S.E.Add. to the W. The Board of Public Works met in regular session all members being present. The Engineer filed the assessment rolls aa final estimates or the jirieK Pave- ment on Marion and Burroughs streets from Michigan street to Michigan avenue; also, for water connections on Monroe street and Sewer connections on Emerick street. Resolved that notices as to,the amounts -of assessments on the above streets be published for six consectuive days in the South Bend Daily Times ana the South Bend Daily Tribune, beginning on the l8th: day of Sept., 19032 stating that this Board will give a hearing on the amount of assessments at its office in the City Hall on the 29th. day of Sept., 1903. Resolved further, that the wntire work under the above contracts be accepted and approved and the final estimates thereon allowed. Notice of this. resolution shall be published on the 18th. day of Sept., 19039 in the South Bend Daily Tribune and the South Bend Daily Times. This Board will give a hearing upon the acceptance of said work at its office in the City Hall on the 29th. day of Sept., 1903 at 7:15 P.M. In the matter of pipe sewers on Catalpa avenue and LaSalle avenue,Bridge st. and Colfax avenue; and the Trunk sewer on rassna cht avenue. Resolved that sealed bids be received by the Board of Public Works, in its office in the City Hall, up to 10 A.M. on the 14th. day of October, 1903. Resolved further, that noritces ol: this resolution 7Jaall be published on the 18th. day and on the 25 day of Sept., 1903, in the South Bend Daily Time and the South Bend Daily Tribune. President. September 18th, 1903.. In regular session. All members being present. Petition filed for the location of an alley between Sorin street and South Bend Ave. referred to Engineer for specifications. Cormaunication filed by the Dixon Garbage Creamatory Company stating that the Crematory will be ready for operation Tuesdayq Sept. 22nd, 1903. -Petition filed for cement walks and curb on Indiana Avenue from Franklin street to Michigan street. Petition filed by residnets on Lafayette street and vicinity from Indiana arOnue to Ewing avenue asking the the City to abandon the proposed Elmira street viaduct and open Lafayette street. n A September 19th, 1903.. The Board met in regular session all membets being present. Vacation Resolution +24. Resolved by the Board of Public Works of the City of South Bend, Indiana: That it is desirable to vacate the following: That part of the alley in the Burroughs addition to the City of South Bend lying south of Lots 31 and 32 in said additioA,described as follows: lying east of the following line and west of Portage avenue; beginning at a point 14 feet north and 6.2 feet east of the north east corner of lot 19 in the said addition, thence sou 42 degrees east to the south line of said alley. The following described property may be injuriously or beneficially effected by such vacati Lots 16117918131,32 in Burroughs addition to said city. The Board find in all cases that the benefits resulting to the abutting property and to the City of South Bend are equal in each case to the estimated cost for the improvement and that said declaratory resolutions should be and the sameare hereby in all things ratified confirmed and approved. D�resident. September 23rd, 1903.. The Board met in reular session in the office of the Board all members being present. Bids were opened for the improvements on the following streets and were referred to the Engineer for tabulation. Grade, curb and walks on Emerson ave., Sample st., Notre Dame street, Special walks under res. # 157,158,and 160.,also, for pipe sewers on 'Carroll street and Notre Dame street. Garbage -collectors will be required to collect the kitchen garbage from private resid— ences only. Saloons, hotels, Boarding houses,etc., must provide for the removal Of the Garbage from their premises. 2. All kitchen garbage should be placed in suitable sessels.preferably eon:tructed of -wood and lined with. galvanized iron, not to exceed twenty gallons in capacity I and provided with a covering to keep out rain and snow. All garbage must be drained before being put into vvis elo TIN CANS AND BROKEN DISHE=} WILL ALSO BE TAKEN BY THE BARBAGE COL COLLECTORS, PROVIDED THEY ARE KEPT IN A VESSEL SEPERATE FROM THE KITCHEN GARBAGE. If tin cans, broken dishes, or any other matter is found among the kitchen garbage, the collectors must refuse to take its and it must be removed from the premises by the tenants. 3. All garbage boxes must be kept in the alley, or if kept inside 'ence or barm, max must be easily accessible to the collectors from the alley. The cois.eozors will not be required to carry the garbage not to go up stairs nor into basements for garbage. 4.
