Re: Ordinance No. 10703-20
Dear Common Council:
After reviewing Ordinance No. 10703-20, I am unable to support this rezoning of 1322 N.
Chimes. As you know, state law (IC § 36-7-4-603) specifies five criteria to evaluate a
rezoning: 1) comprehensive plan, 2) current conditions and character of current structures
and uses, 3) most desirable use, 4) conservation of property values, and 5)responsible
development and growth.
The Plan Commission staff report made a compelling case that this rezoning does not meet
these criteria. The Plan Commission, comprised of community members, land use experts,
the City Engineer and a Council representative, voted unanimously(9-0) to send an
unfavorable recommendation to the Common Council. The zoning and annexation
committee also sent an unfavorable recommendation to the full Council. For these reasons
and the lack of a compelling case under the criteria, please accept this as notice of my veto.
My administration and appointees to the Plan Commission aggressively support growth
and development in our city. If they can justify an action under the state criteria, I'm
confident they will find a way to be supportive of investment in our community.
Conversely, they will not make unfavorable recommendations lightly. I hope in the future
that there can be more discussion before voting against their recommendations.
Although Council could choose to pass this ordinance over my veto, I hope you will take a
closer look and reconsider. I appreciate all your efforts and attention to this important
matter.
