GAMMON Approved and signed by me �` 19—� Mayor • ORDINANCE NO. 84-8 4•-5 AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: The alley to be vacated is described as the first east-west alley north of east Colfax Avenue from the east right-of-way line of the first north-south alley west of north St. Peter to the west right-of-way line of St. Peter for a distance of approximately 165 feet and a width of approximately 14 feet. Alley located in First Addition to Lowell in the city of South Bend, Indiana. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following: The alley to be vacated is described as the first east-west alley north of east Colfax Avenue from the east right-of-way line of the first north-south alley west of north St. Peter to the west right-of-way line of St. Peter for a distance of approximately 165 feet and a width of approximately 14 feet. Alley located in First Addition to Lowell in the city of South Bend, Indiana. hereby determines that it is desirable to vacate said property. SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of-way, unless such rights are released by the individual utilities. SECTION III. The following property may be injuriously or beneficially affected by such vacating: All of the following properties are owned by the petitioner: 224-0489, 225-0492, 226-0493, 226-0494 SECTION IV. The purpose of the vacation of the real property is to: Allow for an efficient utilization of the combined lots 224-0489, 225-0492, 226-0493, 226-0494 for the purpose of developing a dental office, incorporating on-site parking. SECTION V. This ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor. COLFAX AVENUE Dear Members of the Council: In accordance with Municipal Code Section 18-53 . 8, a favorable recommendation is being submitted to the Common Council concerning the Vacation Petition as signed by Ms. Bonita Raine, United Health Services, 711 East Colfax, South Bend, Indiana, and indicating Mr. William Lamie, Architecture Design Group, 1539 North Irownood, South Bend, Indiana, as the Contact Person, to vacate the following property: The first east/west alley north of east Colfax Avenue from the east right-of-way line of the first north/south alley west of north St. Peter to the west right-of-way line of St. Peter for a distance of approximately 165 feet and a widthsof approximately 14 feet. Alley located in First Addition to Lowell in the City of South Bend. For your information, the Board of Public Works received favorable recommendations from the Fire Department, Police Department, Division of Engineering and the Area Plan Commission concerning this vacation. Copies of the recommendations received from these departments are attached for your review. Therefore, the Board submits to you a favorable recommendation concerning this vacation.
