Bill Nos. 32-12 and 33-12
Chairperson Oliver Davis opened the meeting noting a full quorum. He called upon
Christa Nayder to describe the purpose of Bill Nos. 32-12 and 33-12. Christa requested
that the committee consider both bills in that-they both relate to the old St. Joe High
School property at 1441 N. Michigan. With the request allowed, she proceeded to
explain the rezoning request needed to allow the proposed use of the property. She went
on to report the Area Plan Commission favorable recommendation for both.
Next Attorney's Rich Deahl and Dick Nussbaum along with Tim Sexton representing
Notre Dame described the proposed use of the building. They said the classroom space
could be utilized as temporary class space or offices for those displaced by construction
projects ongoing at Holy Cross College and Notre Dame. The space might also house
incubator businesses from Innovation Park needing more space.
During Council questions Derek Dieter asked about the old railroad right-of-way. Gary
Gilot responded saying the ROW could be used for a rails to trails project and for new
sewer line construction.
Council Attorney Kathy Cekanski-Farrand indicated both bills were substitutes.
After all questions were answered Gavin Ferlic motioned the sub bills go to Council
favorably. Councilmember Dr. David Varner seconded and all supported.
Bill No.34-12
This bill requests a rezoning from multi-family to single family for a burnt-out house at
709-711 Lincolnway East. The petitioner Eric Ford is the owner and intends to
rehabilitate and live in the home. Catherine Hostetler,Director of Historic Preservation,
indicated the house was in the Edgewater Place Historic District. She endorsed the
request.
Gavin Ferlic again motioned for a favorable recommendation with Dr. David Varner
seconding and all supporting.
Bill No. 12-65
This bill requests a special exception for an accessory parking lot for the Army-Navy
Garrison#146. Mark Lyons from the building department reported that the BZA offered
a favorable recommendation pending the petitioner's agreeing to limit parking to the
southern 35 feet of the property. Their being no remonstrators and upon agreement of the
petitioners to comply Gavin Ferlic motioned a favorable recommendation subject to all
compliances. Councilmember Dr. David Varner seconded and all agreed.
Bill No. 12-66
This bill requests approval by the Council of the Howard Park Neighborhood Master
Plan. Jitin Cain from the Economic Development Department had presented this request
at the last meeting where the Council requested continuance to allow time to address two
open issues. The first was a Council question about the economic diversity of the
proposed housing component. Jitin said lot size would be the primary determinant of
housing cost or affordability. The second issue was the Council's request that there be
little if any traffic"calming." Jitin said the arterials would remain free flowing while
interior street design would take safety into consideration. During Council questioning
Valerie Schey asked if Transpo,which still owns their vacated site was ready to submit
and RFP. Jitin said they should be ready by the end of October. Varner expressed a
desire that any developer be responsible for infrastructure costs. Derek Dieter echoed
Varner's comments. Henry Davis noting that Transpo not the City owned the site
wondered why the City was involved at all.
Ultimately the fact that Transpo can do as they please and the Master Plan is but a vision
or guideline the Council agreed to give no recommendation on a motion by Varner
seconded by Gavin Ferlic.
There being no further business to come before the committee at this time, Chairperson
