Mr. Nimtz: The Chair recognizes ^fir. Morris Morrison,
President of the Redevelopment Trustees.
Mr. Morrison: Thank you, Mr. Nimtz, President of the
Redevelopment Commission. The Trustees met last Monday,
with Carl "1Weitzl not being present, and Dr. Fromm, Mr.
Welshei er, Mr. Kelley and myself present. At the
meeting we appointed Paula Auburn, Robert Cira, A. Peter
Donaldson, Lloyd Robinson and F. Jay Nimtz to again
serve another year as Redevelopment Commissioners. I
want to congratulate you on your appointment. We felt
you were doing an excellent job and we know you will
continu to make South Bend thrive as a city.
Mr. Nimtz: Thank you, Mr. Morrison. We appreciate
the confidence you've placed in us and the nice things
you have said about us on TV and in the newspapers. I
can say that all the Commissioners have tried to be

diligent in their efforts and do a good job. I
certainly would like to say, in light of the Mlish-
awaka ex erience, that we have had differences with
the Mayor at various times but we settle those dif-
ferences as time goes by. We have had no problems
with May )r Parent. There has always been a friendly
feeling, there has been no upheaval or changing of
personnel, everybody does the job they are expected
to do.
The Chan�anuary announces that our next annual meeting
will be 2, 1981, at 10:00 a.m.
4. COMMUNICATIONS
Mr. McMa on: We have one important communication
from the Governor's Office, and Mr. Kagel will be
taking c re of that.
Mr. Kage : I want you to know that while fir. Nimtz
and I were in and out of the Governor's Office yester-
day, he qas not aware of this little surprise andwe
were hoping that members of the staff would not say
anything to him about it before hand.
On behal of Governor Bowen, we are presenting to
you the iighest award that the Governor of the State
can pres nt to an individual. This is for your out-
standing work on the Governor's Annual Downtown Con -
ference or which you served on the Steering Committee,
the Coun it of the Sagamores of the Wabash.
Mr. Nimt : Thank you, John. This is quite an honor
and I do appreciate this recognition and this honor.
I think ou have done half the work associated with

Mrs. Baumgartner: Sometimes they put in an adden-
dum, they feel that there will be a better treat
ment or an alternative way of handling the problem.
Also sometimes a homeowner will talk about adding
addi: ional items. We ask that they put this in
the orm of an addendum.
Mr. ira: How should we take this estimated bid-
ding how accurate is it? I see it is quite a
bit igher than the cost estimate.
Mrs. Baumgartner: None of these exceeded the
cost estimate by 20%.
Mr. ira made a motion that the following Grant

Mrs. Baumgartner Yes. It is still not com-
plet . If you notice, you have both bids and
prop sals in front of you, and this is not a
bid, just a proposal.
Ms. ,auburn: Would you like to clarify that?
Mrs. Baumgartner; Certainly. The money that
is b inch spent here is the homeowner's money,
tech ically we are not obligated to bid. We
did id 312 Loans this year just for expediency,
it allows us to get a starting date a lot quicker
than people can get going if they are out getting
estimates and contacting the contractors. There
is a very great time delay in that and that is
why we did bid the 312 Loans. Additionally,
then it was all on proposal basis.
Mr. McMahon: As Kathy indicated a moment ago,
there has been a re- thinking with respect to the
Commission's involvement or the City's involve-
ment as a contract signatory. The Legal Depart-
ment is currently reviewing this entire question.
The IUD guidelines that have come down recently
have indicated that we should not be signing
thes contracts and that it should be a contract
stri tly between the homeowner and the contractor.
The -egal Department is putting together some
guid lines in that regard to identify those areas
wher we should take exception to it in order to
prot ct the interest of the City. The fact that
we a e in the stage of going from one procedure
to a other is reflected by the fact that we have
a number of these that were bid under the old
process and a number of them for which proposals
were sought under the process we are going to
find ourselves into in the near future.
Ms. uburn: Who bears the liability if the con-
trac or defaults on performance or if the per-
form nce is below code? Does that come back to
the ureau of Housing, or the Redevelopment
Comm scion?
Mrs. Baumgartner: In the contracts now or the
prop sed contracts?

Ms. Auburn; Both.
Mrs. Baumgartner; I believe that point will re-
main somewhat consistent in both our old contracts
and the new. Right now we are totally responsible
to sae that the job is performed correctly and
that no payment will be made until the entire job
meets with our approval. Under the new contracts
we will advise the homeowner that this job meets
with our approval or does not meet with our ap-
proval. They then have the option to move as they
wish.
Mr. ira: Why would you call it a proposal and
not bid?
Mrs. Baumgartner; When you call it a bid you have
certain obligations and requirements in terms of
advertising and in terms of just what is required
when this is bid out. With proposals the con-
tractors that are on file with us are notified
when proposals are available. The homeowners are
then given packets, they give the packets to whom-
ever they wish and the packets have to be back by
a certain date and the contractors that have pre-
sent d proposals by that date are considered.
Mr. obinson: After they make this change do you
have to use your staff to supervise and see that
the job is complete?
Mrs. Baumgartner: Yes.
Ms. uburn: Is the homeowner free to deal with
any �ontractor they want?
Mrs.lBaumgartner: Yes, within St. Joseph County.
Ms. uburn made a motion that the following South
Bend Home Improvement Loan Program bid contract
be a proved, subject to legal counsel review, and
Soutl Bend Common Council approval as applicable.

Mr. ira: On Thomas Sherer, that is a 30% under
cost estimate, you mean to tell me that they are
going to do the same work that the other bidders
are going to do for 30% under the cost estimate?
How are you going to know for sure they will give
you the job that you need done?
Mr. McMahon: He may be 30% under the cost esti-
mate, but he is right in the same ball park with
everyone else that bid. Apparently the cost
estimate was in error.
Mr. Cira: How can you go by this cost estimate
if apparently it was a mistake, but we don't
kno for sure. What kind of guidelines can we
use for this process:
Mrs. Baumgartner: We have been using the 20%
guidelines.
Mr. Cira: But you are 30% under.
Mrs. Baumgartner: These contracts do not go to
the Advisory Board to get their approval.
Ms. Auburn made a motion for approval of the

tract that was previously awarded under the 312
Loan Program. We previously awarded, on Septem
ber 12, 1980, a contract in the amount of
$17, 95.00. It has been requested by the Bureau
of H using to reduce this to $13,810.00, based
on i put from the property owner.
Mrs. Baumgartner: This particular loan was ap-
prow d on September 12, 1980, in the amount of
$17, 95.00. When this loan was submitted to HUD
it was requested that it be cut and it was also
the omeowner's wish that the amount be reduced.
It w s possible to reduce the loan to $13,810.00
by c tting out things that were not code items.
Mr. ira: How did Aardvark Construction get that
bid t $17,295.00, and Shamrock was the low bid-
der f $17,170.00?
Mrs. Baumgartner: Shamrock submitted an incomplete
bid.
Mr. ira: By cutting this bid by $3,500.00, is
this house going to be livable?
Mrs. Baumgartner: Certainly. All the code items
will be taken care of, we just cut out cosmetic
item;. In a 312 Loan you are allowed up to 40%
of tie loan to be used for cosmetic items.
Mr.;, Robinson made a motion to approve the amended

with the initial 312 Loan. Some people have
money left in their account. We have to either
do More work on their homes or send the money
to Kiseell Corporation which is a service agency.
All of these people were given the opportunity
of spending the money remaining in their account
on their homes or sending it back to Kissell
Corporation. These particular homeowners have
chosen to have additional work done.
Mr. Cira: I don't like the idea of awards being
given on one bid.
Mrs. Baumgartner; The only problem I have with
this is that in recent monitoring by HUD in
Indianapolis on the 312 Loan Program, they wanted
us to close out 91 outstanding 312 Loan accounts.
Mr. Cira: Is it that much of a problem to get
two or three bids?
Mrs. Baumgartner: Yes. People have been given
thr e weeks and they pass out the bid packets and
in ome cases only one proposal is turned in..
Mr. Cira: Some of these have as many as seven or
eig t bids. I don't know if the effort was there
to et more than one bid.

Nimtz: The thing is that the Bureau is try-

Baumgartner: We have been requested to get
of these as quickly as possible and this
a tight time strain on people.
Robinson: On the John Rudnicki residence,

Mrs. Baumgartner: Barany did not want to work on
a Bureau contract. When he submitted his proposal
he did not realize it was in connection with a 312
Loan.
Mr. limtz: What is the pleasure of the Commission?
Do y u want to vote on them in mass or go through
and reject the ones that only have one bid?
Mr. ira: I realize that some of these are only
$450, $350, and $550, but it is just a matter of
that policy we want.
Mr. IcMahon: You may wish to consider something
like rejecting those that only have one bid that
are flore than $1,000. With less than $1,000 I
don't know if you would be far off in any case.
[4s. uburn: You probably would be creating more
admi istrative work.
I'ir. 'agel: When did [IUD say you have to get rid
of t iem?
Mrs. Baumgartner: They didn't say exactly when,
they just said as soon as possible. Their letter
was sent the 25th of November, and they wanted us
to get rid of as many as possible after that date.
Ms. Auburn: I would like to see these approved,
but with a caution to the Bureau of Housing that
they should pursue getting more than one bid in
the future.
Mr. 'imtz: This is cleaning up the program,
isn't it, Kathy?
Mrs. Baumgartner: There are ninety -one on this
list, and a lot have turned the balance over to
Kiss all Corporation.
Ms. uburn: Maybe you can help the homeowner find
a co ple of contractors who will be willing to bid
on s all cost items.
Mr. Robinson: Is this clean -up program the same
one that we have been talking about for the last
couple of meetings?

cases, repaying this loan for one to three years.

Ms. Auburn made a motion to approve the Section 312 SECTION 312 LOAN
Loan proposals per the recommendations of the Bureau PROPOSALS APPROVED
of Housing, with all future proposals requiring at
least two bids to be submitted. The motion was
seconded by Mr. Robinson and unanimously carried.

that I would like to enter into the record before we
get into the section for comments.

Bend Tribune on publication; affidavit from Tri-

ing iotice was delivered to the Area Plan Commission,
Boar of Public Works, Board of Zoning Appeals, Build
ing epartment and other City agencies that we're re-
quir d to notify; the original Area Plan Commission
Resolution with respect to this public hearing; a
certified copy of the Resolution of the Common Council
base' on their public hearing, as well as a copy of
Resolution No. 626 of the Redevelopment Commission

various notices as listed here and the affidavit cones
cern'ng the giving of notice concerning this public
hearing, and unless there is some objection, directs

Mr. IcMahon: I believe this is the fourth time that
the ast Bank Plan has come before some public body
for iearing purposes. We had our meeting here for
the original filing of the Declaratory Resolution,
The Area Plan Commission has had a public hearing on
it, as indicated by one of these documents. With
respect to their resolution, they have a favorable
recommendation. The City Council has also held a
hearing JA :this regard We have also had.a number
of meetings with the property owners on an indi-
vidual basis, as well as a group meeting, and have
had questions and answers. In light of the fact
that this has been discussed on four separate
occasions, I would leave it to the pleasure of the
Commission as to the extent to which we present
info oration this morning, rather than rehash in its
totality everything that has been discussed. It
seem a review of some of the pertinent items that
are lecessary to be placed on the record would be
appr priate and then open up for questions.
Mr. Vimtz: I feel it is essential that we show that
the rea Plan Commission has approved this plan and
prop sal and they are in favor. Secondly, that the
City Council has approved and is in favor of this
prop sed plan and development. Correct?
Mr. Sweeney: That is my understanding.

Mrs. Kolata I would like to summarize that the
area we are looking at extends from Jefferson
Boul vard on the south, from Sorin Street on the
nort , the river on the west, and till Street on
the ast. As stated in our Resolution of Octo-
ber 3, the area has become blighted and con
diti ns can not be corrected by the regulatory
proc ss or by ordinary operations of private
ente prise as evidenced by its current condi-
tion
The irea is roughly 52 acres, excluding public
righ -of -way and streets. Of that 52 acres,
47% f the land currently is vacant. It has been
zone "D" light industrial since 1922 and at one
poin it was heavily used as light industrial, but
its ise has decreased over the years and buildings
have been demolished. The declining industrial
population has had an adverse effect on what resi-
dential population has been in the area. Since 1960
the opulation of the area has declined from 262 to
57, qhich is a decline of 78 %. Also, the number of
households has declined from 130 to 21 for a decline
of 84'110. There are currently 86 structures in the
area of the 86 approximately 25% are deficient
requiring varying degrees of repair. When we say
degr es of repair, I am only considering those that
have some structural problem and need some correction,
and that if the problems are not corrected the build-
ing nay require demolition. I am not referring to
merely cosmetic items.
Beca se of its current conditions, the land does
not generate much in the way of tax revenue for the
City. Currently the total assessed valuation for
the area is $1,701,730, and at the current tax rate
of 13.463 per hundred we are bringing in $178,052
per ear in taxes which comes out to about $3,300
or $ ,400 per acre in taxes.
As y u can see, within a half mile of the downtown
area we have a large area that is greatly under
utilized. We believe by redeveloping the East Bank
Area the land use will be increased, the tax base will
be increased, and this will be of public benefit to
the bublic health and welfare.

Mr. McMahon; Mr. Commissioner, there will also be
a.i formal statement of findings on behalf of the
Redevelopment Department that will be filed prior
to our next meeting on December 19, at which time
the final Commission action will come forward.
Mr. imtz: As I mentioned previously, the only
question raised at the afternoon meeting at the
Park Department was the question of Niles Avenue.
Would you like to tell everyone about the plans
for Niles Avenue, Mrs. Kolata?
Hirs. Kolata: The plan that we have proposed had
sugg sted that in the future Niles Avenue, between
Jeff arson Boulevard and Washington Street, and
betty en Madison Avenue and Cedar Street, would be
clos d with the rerouting of traffic from Niles
Aven e over across Cedar Street and then down Hill
Stre t. There would be access to those businesses
or w atever development that is in;this area, there
woulJ also be access from Jefferson Boulevard and
Washington Avenue, but our intention is to limit
Nile Avenue as a through street so that proper
development can take place. It is not our inten-
tion to deprive people who are in the area or will
be g ing to the area their access, but we do want
to limit through traffic. We do not have intentions
of vacating those portions of the street because
there are utilities in place underneath.
Mr. McMahon: Perhaps when we refer to this in the
future, we should not refer to the street as being
closed, but we should simply say it will be closed
to through.traffic. In all other respects it will
remain open.
Mr. Kagel: In other words it will be limited access?

r property, simply that we would like the through
fic, the traffic which does not have that area
destination or source, to utilize Hill Street or
of the other nearby streets.

Mr. lcMahon: They will not be vacated and the
stre t itself will not be closed. We will take
step to restrict through traffic.
Mr. ira: There isn't too much residential in
that area.
Mrs. Kolata: No, but the idea behind our whole
plan is to:create a residential area.
Mr. ira: You think you could with all that
comm rcial /industrial?
Mrs. Kolata: Yes, because right now you have half
of tie land vacant and some of the buildings that
are in there right now, some of the older buildings,
are uitable for conversion to apartments.
Mr. McMahon: Or commercial.
Mrs.lKolata: Yes, either one.
Mr. '1cMahon: If there are no other public state-
