R ^66 Mr. Ellison: At our last meeting we received a bid to purchase Parcel IP8 -9 which is next to the Baer's Furniture Building on Riverbend Plaza.. That bid was received from the Diocese of Fort Wayne South Bend for the Faith & Hope & Charity Chapel. We have received preliminary plans and drawings. The Church intends to construct a chapel fa 'lity which will have a storefront type entrance. The Church intends to allocate within the building space not only for a chapel but for a con- sul tion room, and other related uses. The plans call for the current vacated alleyway between the Baer's facility and the Chapel to be irproved to per-nit both a side entrance and access to Darking that would be developed at the rear of the parcel These plans are preliminary and are subject to some change. Based on that information and the balance of the information necessary to have the bid be complete, the staff would recommend that the Commission authorize the disposition -3- South Bend development Commission Special Mee ing - August 8, 1980 5. OLD BUSINESS (continued) a. Mr. Ellison, continues..... i a. of the parcel to the Diocese of Fort Wayne - South Bend. Mr. Nimtz: Mr. Butler, have you reviewed the bid documents? Mr. Butler: Yes I have and they are all in order. Mr. �tz: Will this be a one sto r two story building? Mr. Ellison: The preliminary plans cal for one story although it is pos ible it could become two. Mrs Kolata: I believe they have determined that it would be a one story structure. Mr. Robinson made a notion that the bid proposal received on Disposition Parcel #8 -9 (Project Ind. R -66) be accepted and that the bid be awarded to the Diocese of Fort Wayne - South Ben I for the Faith & Hope & Charity Cha)el and that the President and Sec etary be authorized to convey thi 3 parcel, seconded by Mr. Donaldson, and I the motion was unanimously carried. for aMend- Mr. Ellison: This resolution asks the Comnission to begin the process to amead the land use plan for the down- t area to correct certain changes whizh should have been implemented previously, and to accommodate certain intanded uses such as for the grassy knoll in front of the Morris Civic Auditorium. -4- South Bend development Com-aission Special Mee ing - August 8, 1980 6. Mrs Kolata: The first change in Area A on the top of page four under "Basic Objective" is that the bas c objective of this area is its Utilization for service commercial, opeti space and parks. That is primarily the largest change in the entire plan and it allows for the park in front of the Mo is Civic Auditorian to remain as en space. The next change is der Physical Organization in ea C. A reference is deleted can erning a bo.tel and commercial theatre to be developed in that block. We also make a reference to the small generally triangular tra t of land in the northeast qua Irant of the area which is developed as a park, and to the sou est quadrant of the area whi 2h will remain open space to be developed as a park. We hava taken out certain state- men--s relating to pedestrian ri t -of -way, to the commercial the3.tre, and reference to the res aurant facility. All of the wording changes have to do with the basic change of kee ing that land as open space. The next changes begin on page 5 under Area "C ". A few words have beea inserted to allow for retail/ service commercial. Under "physical org 'zation" we have made a modi- ficEttion in that the plan originally sal "the physical organization of thi3 area will be modified by the clo3ing of Michigan Street between Way e Street and Colfax". We have ame ded that to say "between Wayne Str Bet and Washington ". In effect, mans that Michigan Street will be Dpen between Washington and Colfax, and this is compatible with the plans for the First Bank Center Project. Kolata continues.... that the street remain open. On page 6 there were some changes made concerning service /retail conmercial development and the pedestrian mall etc. There is also a reference to alleys being wicened to 40 ft. to provide for di:rect service to the rear of all de elopments in Area "C We have amended that to read that certain 'sting alleys will be widened to 40 ft. In other words we don't want an alley to go through the First Bank Center Project. The.only other change is on page 11 where there is a statement on controls and restrictions and there is a wording of F.A.R. which is a Floor Area Ratio. There was some confusion as to whether that was a nminum or a iremimum so we inserted the word `Mmdr um" F. .R. to make it clear to people. Those are basically the changes that we have made. It is our intention that as soon as this is completely adopted and recon- firmed, we will record this document. We felt that there were some compli- cations because as the plan had been previously amended the amendments had been attached to the back of the l and had not been incorporated Pit pthe body of the Land Use Plan. Mr. Nintz: I presume that this will meet with HIJD`s approval to have it all in one document. Ms. Auburn made a motion to approve Resolution 621 relative to amendments to Land Use Plan, Ind. R -66 (Attachment " A` ` ) correcting and placing into one document the Land Use Plans controls and restrictions concerning Central Damitown Project Ind. Mr. INimtz: I believe this was Ms. Bathon's project, do you wish to give us a report? Ms. Bathan: Everything went rather smoothly. We had about 40 people. present at the drawing. Obviously not everyone won a lot but on the whole they were pleased. We did wind up g four lots left over. Mr. Ellison: Essentially what the random calls for is that rather thmi going through the expense and the enormous amount of staff time that would be associated with both the providing of information and enrollment of applicants City -wale for only two parcels of land, it bec s practical for the 'Commission to ern-it us to modify the plan and s' ly go back and recontact those pers,ons who applied during Phase II who were unsuccessful in the process. We have reason to believe that we will be easily able to dispose of the two remaining parcels through tha process. In the event that we e unable to, then we would wan permission to contact persons who were successful and who received the maximum amount of lots we made available to them during the Phase II process. It is our feeling that giv the cost associated with trying to 'spose of the two parcels, and given the overall objective of trying to assure that persons who live and own property in the area had prefer.. - enc for the land, it seems reasonable to the staff that we should be allowed to eviate from the original plan by imp ementing the procedure outlined in the memo. Mr. any Mr. Nintz: Mr. Butler, do you see legal complications in this? Butler: No. Ms.lAuburn: It certainly seems like an fficient way of doing things. Mr. Ellison: We began with 128 parcels in Phase I, had 48 parcels in Phase II, and now have 4 miring parcels. Mr. Robinson made a motion to adopt the revisions of the LaSalle Park Disposition Plwi as outlined in the Memorandum of Ms. Bathon of August 7, 1980, seconded by Ms. Auburn, and the motion was unanimously carried. Tax Abatement re st from Homer Fit er . re ative `to An area tobe purchased by New'En6rgy Mr. Ellison: Mr. Kernan, City Controller, who is the administration's coordinator for this project is present, along with Mr. Dick Mintz who represents the New Energy Corporation, and Mr. Cal .Todd who is also part of the New Energy Cor- Mr. . Mintz: I an here on behalf of Mr. Fitterling who owns a piece of property of approximately seventy acres on the southwest side of the City of Sou Bend. I am also here on behalf of the New Energy Corporation of Indiana, who has an option on that property and who intends to construct a large scale ethmol.plant. The plant will cost approximately one hundred million dol ars to construct. It will process co into fuel alcohol. During the process of construction there will be be en 300 -500 contruction workers on ite. After the project is completed it 'l1 have 130 permanent employees in the plant and it is estimated that approxi- mately three times that number outside of the plant. For instance, we have an estimate from a trucking fire that says there will be 243 jobs created in that in try alone. The land in question (a 0 acre parcel) is located just north of the extension of Calvert Street. This is a site that is just west of Olive Street. The site itself is the best sita that we could find inside the City of 3outh Bend. However, it is classically an underutilized site. Probably the biggest pro lem with the site and the reason it may be underutilized (even though it nay hav been setting there on a railroad track) is t there is some three feet of what I cal - "muck" which has to be removed in ord r for that site to be utilized. Mr. blintz continues....... we ask that you act favorably on this petition so that we can move ahead with the construction as planned. If there are any questions of a technical nature, Mr. Cal Todd the general manager of New Energy in Sou Bend will be happy to answer them. you. Mr. Nimtz: Mr. Todd or Mr. Kernan, is there anything else you would like to add? Mr. Kernan.: We are looking at a project that is possibly a`once in a lifetim . opp rtunity for the City of South Bend. It will be sit impractical for us to ect a one hundred million dollar in stunt over a two or three year per od without providing some sort of incentive for them to come here. It bec s even more critical with: the fac that New Energy has.an option on a Ate in Rolling Prairie. The tax rat out there would be roughly half of t it would be in South Bend. A par el of land that they are looking at would cost about half of what a par el.in South Bend would cost. There- for a a tax abatement for New Energy is rea ly a necessity in order for us to attract them into the City of South Bend. On behalf of the City I would ask your fav rable consideration for the request of tax abatement. Mr. Nimtz: I am aware that some.of the Ccmnissioners were present at the press con erence when Senator Birch Bayh and Con essman Brademas made this announce- men:, so I am sure that you are aware of e plans of New Energy Corporation. Mr. � Kagel, is there anything you would liko to say about this? Mr. Kagel: Having lived in South Bend all my life, knowing the muck farms which usel to burn, and can still burn, I am sure the people in the southwest part of Souffi Bend would certainly appreciate hear- ing that the muck is going to be removed -13- South Bend development Commission Special Meeting - August 8, 1980 6. NEW d. continued... Mr.lNimtz: Are there any further Mr. is 1 the Mr. the Robinson: Approximately what he figure for the taxes on site now? Mintz: The last assessor assessed property at $10,190.00. Mr. Ellison: For the record I might add that in your packet is a report the staff has prepared in answer to the tax abatement request. The staff finds that the area qualifies as an Urb Development Area and recommends tha the Commission concur with the finding with respect to the conditions. There is some discussion and explanation which essentially reinforces the notion that the area has been bypassed is underutilized and it is impossible to develop. This is primarily due to ecotiomic and physical conditions which during the normal course of private ent rprise are Uneconomical to correct. The report also concurs that the proposed one hundred million dollar facility does provide substantial public benefit and that indeed a tax abatement appears to be absolutely essential to assure that the facility is constructed within South Bend. Ms. Auburn: It was interesting °on my trw7els on my vacation as I went west- wani read the newspapers going across the country, that the discussion on et of plants is going on in almost every state that has a substantial farm- ing con unity. There are plants being pr sed and developed in Nebraska; Kansas, Oregon, Montana, North Dakota, South Dakota, and Minnesota. I think tha this is an important development, not only for South Bend, but for the State of Indiana to get into that kind Of T larket. Mr. INimtz: Thank you Ms. Auburn. e. Tax I Abatement request from the Hablin Mr. Ellison: I don't see Mr. Harold B seke present, who is the attorney for the petitioner. In his absence I 11 briefly describe the report h whi has been prepared by the staff for the Commission which has been marked as Item 6E in your packets. This abate - men request is for the Century Mall Place project which has been under construction for some tine and as I and stand it, is nearly completed. The petition is a ticklish.one in that the understanding of the Council's intEnt previously has been that if a construction permit were issued or con- struction actually started, then it could not be reasonably demonstrated that an abatement was necessary to make that pro ect happen: However, our investi- gation reveals that the Hablin Company, the petitioner, is in a rather awkward situation in that Hablin in developing the project and starting construction did so at a time when there was no clear local pro edure. They also started construction at a time when Hablin presumed that the fi year abatement statute would be app icable and they would be able to receive the five year abatement. -15- South Bend Redevelopnmt Commission Special.Mee ing — August 8, 1980 6. NEW BUSINESS e. Mr. Ellison continues.... It is our impression that Hablin is now in a situation where the petiti oner, becau.se of timing, cannot qualify for five year abatement and because of having started construction, would be denied a ten -year aba ement. Thus, because of imperfections in the system and due to the absence of having a local procedure some -six to nine man s after the new law became effective, Hab in would be penalized if we stick to the procedure of the policy of not consider - ing an abatement situation where a building pe it has been issued or actual construction started. It is our belief that Hablin did indeed enter the project under the presumption tha they would receive a tax abatement under the five year statute. Because of the timing difficulties in the absence of local procedures, and as we understand it, a determination by the auditor that Hablin cannot receive a five year aba ement, they are now petitioning for abate - men . Therefore, in the report we sought to loo at the conditions from the standpoint of what the condition of the former Frances Shop was prior to the start of construction to make a finding that conditions at that t' were such that the property would indeed qua ify for an abatement. In effect, the report is really a rather technical.effort to ggest that Hablin not be penalized. Tha the Commission recommend to the Council tha an abatement or designation be given eve though construction has actually started and completed in order to avoid penalizing a domitown merchant whose efforts I think we should encourage. I would be happy to answer any questions you might have on the matter. Mr. Robinson: Ubat effect will this have if we grant this tax abatement when in the past we have denied, and what is it goh ig to do to us in the future. Mr. Butler: It does not set the kind of pre edent that would require us to permit a t abatement or recommend tax abatement in e future. Yx.lEllison continues.... will have to have that same question an red for them but I don't believe it does set that kind of precedent. In the case an attempt was actually made to file an application in late 1979 under the old five year statute, and whem it was determined that abatement was no longer available by that time, we bad already taken 'a position that we zmd the City were not going to be processing applications until a procedure had been established. Therefore, Hablin had to begin con- s tion. I think they really met the spirit by attempting to file back in December. Mr. Robinson: What happen to the tax abatement petition we turned down for Mos s berg? Mr. Ellison: That one was recommended to the Council and the Council passed a &claratory resolution and I believe it is now on its way to Area Plan for Their approval or back to the Council for confirmation. Mr. Butler: I would say additionally that: the statute itself does not require that: the application be submitted before any construction commences or before a building, permit is granted. Mr. Harold Brueseke: I appreciate Re velcpment's interest in their willingness to consider the application and allow these gentlemen to show their int rest in the abatement. In fact, those interim leases have been very successful in generating additional down- tam tr fic as evidenced by the capacity of thos merchants to make money. 8.
