ORDINANCE NO. "S4 (c- q44.
AN ORDINANCE OF THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA APPROVING
PARKING RATES FOR PARKING GARAGES
OPERATED BY THE BOARD OF PUBLIC WORKS OF
THE CITY OF SOUTH BEND, INDIANA
STATEMENT OF PURPOSE AND INTENT
I .C. 36-9-11-7 authorizes the Board of Public Works to fix the rates and
charges to be collected for parking vehicles in parking facilities owned and
operated by the City and for other use of those parking facilities so as to
promote the maximum use of the facilities by the public in a safe, orderly,
and efficient manner. Such rates fixed by the Board of Public Works are
subject to the approval of the Common Council . The Council has received
Resolution No. 1419-94 of the Board of Public Works, a copy of which is
attached hereto and made a part hereof, which establishes rates for city-
owned parking facilities, both parking garages and parking lots .
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana as follows :
SECTION I . The following monthly rates shall be charged to vehicles
parked at City operated parking garages :
Rate
(a) Per vehicle, on a month-to-month basis $35 . 00 per mo .
(b) Per vehicle, on a three-year contract $35 . 00 per mo.
(c) Per vehicle, on a five-year contract $35 . 00 per mo.
(d) Group rates on a monthly contract $35 . 00 per mo.
(e) Priority for committing parking spaces within a City operated
parking garage shall be given to vehicles with the longest term parking
contract and the highest monthly rental rate. Commitment of spaces within a
parking garage within a particular rate structure shall be determined based
upon (1) the number of parking spaces committed per single billing; (2) the
length of time the person has committed spaces within that garage; and (3)
the payment experience of the account .
Persons entering into long term agreements for parking may be granted an
option to renew within the discretion of the Board of Public Works or its
designee.
SECTION II . The following hourly rates shall be charged for individual
vehicles parked at City operated parking garages :
(a) From September 1 through April 30

SECTION III . This Resolution rescinds and supersedes all prior
resolutions setting rates for municipal parking facilities .
SECTION IV. Nothing herein shall affect rights and liabilities accrued
prior to the effective date of this ordinance.
SECTION V. If any portion of this ordinance shall be declared illegal
or unconstitutional, that determination shall not affect the balance thereof.
SECTION VII . This ordinance shall be in full force and effect on and
after its passage, approval by the Mayor and proper legal publication.

A RESOLUTION OF THE BOARD OF PUBLIC
WORKS OF THE CITY OF SOUTH BEND,
INDIANA FIXING RATES AND CHARGES TO
BE COLLECTED FOR THE PARKING OF VEHICLES
AT MUNICIPALLY OPERATED PARKING FACILITIES
WHEREAS, I .C. 36-9-11-7 authorizes the Board of Public Works to
fix rates for municipally owned off-street parking facilities, subject
to approval of the Common Council; and
WHEREAS, the Director of Administration and Finance for the City
of South Bend recommends, and the Board of Public Works for the City
of South Bend hereby finds that it is in the best interest, fiscal and
otherwise, of the City that the current tiered rate schedule for
monthly parking privileges be replaced with a flat rate for monthly
parking privileges in said facilities and that an incentive be given
to encourage the use of said facilities during the summer months.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the
City of South Bend that the following monthly parking rates be
established for the Colfax Street Parking Garage, the Jefferson Street
Parking Garage, and the Wayne Street Parking Garage:

Dear Mrs . Puzzello:
I am attaching for filing an Ordinance Approving Parking
Rates for Parking Garages Operated by the Board of Public Works .
This Ordinance is being placed before the Council for
consideration as a part of continued efforts in the City' s plan
to make more efficient and self-supporting the downtown parking
facilities operated by the City and to ensure the increased
effectiveness of parking restrictions in effect within the City.
The ordinance in question fixes new rates and charges to be
in effect at City operated parking garages . Attached to this
ordinance is a copy of the Resolution, which will go before the
Board of Public Works on Monday, May 9, 1994, for approval .
