APPROVALI OF CLAM Mr. Ellison: I'd like to bring to the attention of the Commission the claims from Michiana Title Corporation totallin $376.00. These were related to 312 loans and are for work previously done. The Bureau of Housing has been instructed not to use Michiana Title Corporation in the futu e. Mr. Nimt : The Commission indicated on November 21 that all outstand'ng work with Michiana Title should be completed and paid for Mr. Butl r: I'd like to state for the record that John Newman of Afichi ma Title has been told not to accept any more business from the Bureau of Housing. On motion by Ms. Auburn, seconded by Mr. Robinson, and unanimously carried, the claims totalling $136,392.46 were allowed d ordered to be paid. (NO CHANGE IN CONTRACT PRICE) Mr. reus: Just as rehabilitation service was beginning at 236 Haney, Bureau Inspector visited property and observed that; 1) homeowner had repaired some items himself, and; ) additional items had deteriorated since time of initial inspection. The Bureau accommodated the above by changing the porch specification to concrete from deck board replacement and thereby balanced costs. DELAYED DECISION Mr. Ellison: The staff would appreciate it if the Chair ON TAX ABATEMENT would recognize Mr. Ernest Szarwark, an Attorney who is REQUEST FOR AN here recognizing the petitioners. AREA REFERRED TO AS 1007 E. SAMPLE Mr. imtz: The Chair will recognize Mr. Ernest Szarwark. Mr. zarwark: I am here today to seek your support for a requ st for a tax abatement for a parcel of land at the orner of Lincolnway East and Sample Street. I am sure you re familiar with this piece of property. Currently, ther is a burned out structure on the property and it is an e esore to the area a. (Mr. Szarwark distributed pictures of the site). The land in question is located within the Sou east neighborhoods which is a troubled area, an area refe red to as blighted in the Southeast Planning Profile. My c Tents want to build a new facility on that parcel to expand their business. They plan to provide five new jobs, with an increase in the payroll of approximately $100,000 over the next few years. Mr. Robinson: Could you tell us the name of your client? Mr. Szarwark: Certainly, I am representing the Trane Comp y, a company concerned with heating and air cond tioning. Mr. ira: I have some questions about abatement being necessary for that property. It seems to me that's a pretty desirable location, it is near Miami Street and across from Ro 's and Shoemaker's company. I think somebody would even ually build there without a tax abatement. Mr. Szarwark: All I can say is that no one has wanted that property to date. I'd like to repeat that it is in a troubled neighborhood and people might be afraid of fires--like what happened at South Bend Toy and the building on the property now. Mr. obinson: Aren't you going to need permission from the State for urb cuts? Don't you think that will be a problem? South Bend R development Commission Regular Meet g December 7, 1979 6. NEW BUS ME SS c. continued... Mr. Donald Rohan from Trane Aix Conditioning was recognized by the Chair. Mr. han: We have not yet obtained permission for the curb cuts but we do not feel this will be a problem. We won't have a lot of traffic in and out, it is not that type of business. Ms. uburn: I too have some questions concerning that property. It seems like a good location for a business, I don' know if abatement is necessary. Also, when do you plan to start construction? Mr. zarwark: Construction is scheduled to begin in the Spring. With construction costs continuing to rise, abatement could be the difference between building there or going elsewhere, outside the City. Mr. : I'd like to mention that our plan includes cle 4ohan ing up the property along the river and landscaping it it will be very attractive. Mr. �obinson: I'd like to suggest that we not make a deci ion on this matter at this time. Mr. �imtz: Mrs. Hernandez, as a resident of the neighbor - hood what are your views on this request? Mrs. Hernandez (President of S.E. PAC): I'm tired of hearing quotations from the S.E. Planning Profile, and I wish neighbor- hood residents would be consulted ahead of time and not just hear of proposals at meetings like this. Mr. imtz: I think we are all concerned about the lack of advance notice regarding these requests. That is why we are going to vote on a resolution later in this meeting stating our ntention not to consider tax abatement requests until local procedures are set up. Mr. zarwark: With all due respect, I'd like to ask you to sup rt our request before our resolution is considered by the ommon Council. Mr. imtz: I think it might be appropriate to have a motion dela ing any decision on this tax abatement request until local nroc dures and standards are established. Mr. zarwark: Perhaps the Redevelopment Commission would consider getting a committee together immediately to establish local procedures and standards, so that future tax abatement requ sts could be approved without further delay. Mr. imtz: I do not think you need to tell this Commission how to proceed. I think it would be appropriate to wait until the new administration takes office in January before approving any more tax abatement requests. Mr, Robinson made a motion to delay consideration of the tax abatEment request, relative to an area commonly referred to as 1007 East Sample Street, pending establishment of local procedures and standards to go before the South Bend Common Council, seconded by Mr. Cira, and the motion was unanimously carried. d. I would just like to state that the resolution expresses Commission objection to the addition of the Odd Fellows Building to tfie West Washington Historic District for the foll winiz reasons: a) e National Register application does not provide sufficient evidence that the Odd Fellows' Building meets the ational Register criteria found at 36 CFR Part 60. b) The justification for National Register District boon ary changes pursuant to 36 CFR Part 60.16 (a) (2) has �ot been met. c) Me fact that the Odd Fellows Building is fifty (50) years old is not sufficient reason for its nomination for inclusion in the West Washington Historic District. I would like to comment on the reporting of the November 16, 1979 Redevelopment Commission meeting. -13- DISCUSSION PER MR. T. BROOKS BRADEMAS South Bend R Regular Meet 6. NEW BUS e. Mr. elopment Commission December 7, 1979 continues.... Out of all the things I said at that meeting the only item reported in the Tribune was that I had zero equity in the Odd Fellows rehabilitation proposal. That is not the case as developer's fees are to be put back into the project. This type of reporting is what happens when you have .a controlled press.. In his report, Mr. Jerry Miller of Jannotta & Associates stated that there were problems with all the proposals related to lack of firm financing taxes and soft costs not being included, lack of detailed costs and lack of equity. I can assure you that these are not problems with our proposal. We have a firm a commitment from Stephens, Inc. as any developer can have at this stage of a proposal. Also, we have included taxes and soft costs in the proposal, we have extensive detailing of rehab costs and, as I mentioned before, considerable equity in the project since developers fees are to be put back into the project. In their announcement to the media recommending demolition, the Redevelopment staff stated that additional public investment would be necessary to save the building. I would like the staff to identify the nature of the public investment they think is necessary. I'd also like to add that our proposal will work without additional public invest- mentl In fact, it will save the City the cost of demolition. The Rouse report indicates a need of 54,550 sq. feet of additional office space in the period 1979 -1982. This did not take into account the new River Glen Office Building on Block 6 that will provide 35,000 square feet. Thus, the addition of a 100,000 square foot GSA building will provide space than can be digested. I have a major restaurant chain who will rent the first floor of the Odd Fellows Building and another restaurant for the 9th and 10th floors. That leaves the 2nd through 8th floors available for use by the SA. I have talked to Mr. Sochowski with the GSA in Chic go and he told me that we could have the GSA in the Odd �ellows Building. I would like to comment on the designs of the Gruen Company. I would like to show you a picture of Faneuil Hall in Boston. What Gruen has done is design a Faneuil Hall for South Bend. I think a much better arrangement for the mall area would be to build a parking garage on the corner of Jefferson and Main with walkways between the garage, the Odd Fellows, and the Federal Building. The garage could be built in the manner of the National Bank Garage with offices, etc. on the first floc--. -14- South Bend Redevelopment Commission Regular Meeting December 7, 1979 6. In conclusion, I think it is buil ing that we don't need buil ing that could provide c "11111 ty. insanity to build a new GSA and tear down an existing many years of service to the Mr. llison: Mr. Chairman, I would like to respond to Mr. rademas' remarks. First, I would like to state that the work of the Jannotta firm was done during a short period of time--a time period considerably shorter than the six (6) mont s Rouse took to do its market study. Therefore, Jer Miller's work on behalf of the Jannotta firm could not nave been as extensive as that of Rouse. I think the Jann tta firm did a credible job given the time available to t em and I believe their analysis was accurate. With respect to the quality of financing aspects of Tom's proposal, I will only note that a firm written commitment to buy EDC bonds may be sufficient for bond authorization but is not sufficient to assure that development will take place. Ult:Lnately, we need evidence of an irrevocable financing commitment to be confident that the rehab of the Odd Fell ws Building will fly. My p rsonal feeling and that of the staff is that.since subs natial rehabilitation is by its nature an inexact science, developers need cushion within their finances to assure that the unexpected can be overcome. Jannotta described all of the proposals as marginal, in part, because of o r inability to find cushion in the numbers. The staff believes that writing down the disposition cost of the building to $1.00 will not be sufficient. We believe additional public sector investment in the form of interest subsidies or loan guarantees or both will be necessary to supply cushion to any of the deals. Rela ive to what the Rouse report indicates regarding the market for additional office space, I note that the report was speaking of new office space. Even with the unexpected addi ion of 35,000 square feet in 1980 as the result of the prof ct on Block 6, the market can still bear additional space in the new GSA building since that space won't be avai able until 1981. Besides, GSA needs cannot, in my opinion, be met'in the Odd Fellows Building. For example, GSA as indicated that the Social Security Administration, because of its clientele needs first floor space. Obviously, this need could not be serviced under Mr. Brademas' proposal sinc he indicated a restaurant use for that floor. We've spent long difficult hours working on the federal building. It is my info tion that GSA has settled on building on a portion of the 45 bus lot. South Bend Redevelopment Commission Regular Meet ng - December 7, 1979 6. NEW BUS Mr. Elli$on continues... In fact, GSA is currently reviewing a site option agree- ment for that site right now. I think Tom Brademas' efforts are too little and too late. We should not turn down an economic opportunity of a new federal building containing additional marketable office space in an effort to save the Odd ellows Building. The fate of the Odd Fellows Building and he new GSA Building are separate and distinct issues. We s ould keep them that way. 7. PROGRESSIREPORTS Mr. Ellison: Mr. Chairman, and members of the Commission, DISCUSSION CON - the Redevelopment Department owns 130 remaining parcels of CERNING THE land in Ind. R -57, of which 30 parcels are being disposed DISPOSAL OF RE- of on an installment type basis. The remaining 100 parcels MAINING PARCELS IN have not generated much buyer interest. This lack of interest IND. R -57 AREA apparently results from the fact that most remaining land is much land. Given the lengthy period during which this land has been available, the department finds good cause in believing that this land inventory could remain in public ownership indefinitely. Since public ownership of the land produces no tax income for the City, and since departmental interest dictate that it be relieved of the burden of managing and disposing of this land as soon as possible, the department intends to request HUD concurrence to dispose of remaining parcels for $1.00 per parcel. The department is confident that HUD will concur in this disposition plan.
