La Fayette street from Sample street to Broadway.
Messer, Goo. W. Louglman and F. Henry Wurzer appeared in person in behalf of
their application for a ,3eat Franchise filed with the Board on Weedneslay Dec. 5the
1c 02. Moved by Ca4ptain Nicar that the application as amended be approved by the
Board and refereed to the Common Council for confirmation. The motion prevailed.

The Board find that the property condemned being a,.11 of Bank Out Lots 4120 of
the Third ,Addition of Bank Out Lots of the State OfnIndiarka which lies between Vinson
subdivision of Bank Out Lots #121 and the St. Joseph River; also all of Bank Out Lots
#125 of the Third Addition of Of Out Lots of the State Bank of Indiana which lie
between Bank Out Lot #124 and the St. Joseph River. All in the City of South Bend,
Indiana. is the only property injuriously affected by said condemeea:ion, that said
Property is owned by Elisha S. Pec% and Hannah M. Pecl-; that ":ate. R. 71-5:,,C- oA- lido
Quay, James DuShane, Joseph E. Roberts, Martin Hoban, Martin J. Roecii, claim some
interest in said property condemned and that the said property is CLamaged in the

street; also, cement walks on Fuerbringer street from Witherill street to the first

The hearing on Ruin street opening under Codemnation Resolution 45v which was s

Out Lots 4120 and #125 for Park Purposes uncle r C ondemnat ion Resolution No. 7 A.
Mr.Elisha Peck appeared in
company with D.D.Bates
his
Attorney and filed remonstrance
against the award of 112.500.00,
alleging that the sum
was
not sufficient to compensate
him for damages sustained by such appropriation. HELDQthat the sum awarded is in the
judgement of the Board, equal to the damagres 'sustained by said condemned property and that
the award allowed on the 9 th. day of Decembers 1902 should be and is hereby confirmed.
The Engineer was requested to pre y-)are specifications for the paving of Marion

Michigan street to the east line of O.P. under Improvement Resolution. 468; and the
Grade, Curb and -alk on Indiana Avenue from Franklin street to Prairie Avenue under
Improvement Resolution #109. In all cases no remonstrances were filed and no remonstratts
