Toepp to discontinue care of old court house clock on reburary 1st, 1902. VACATION RESOLUTION NO. 7. Resolved by the Board of Public Works of the City of South Bend, Indiana. That it is desirable to vacate the following: Beginning at the north west corner of Section Seven (7) 'Township Thirty -Seven (37) north, Range Three (3) east, thence east. on the north boundary of said Section 7, a distance of 1290 feet to the place of beginning, thence south to the north -line of Jefferson street, thence south-easterly on the north line of Jefferson street to a point 50 feet at right angles east, thence north parallel with the west line and 50 feet distant therefrom to the north line of said Section 7, thence west 50 feet to the place of beginning. The above description is that of a public street hereby designated as Sunnyside Avenue"., The following property may be injur- iously or beneficially effected by such vacation: all that land lying between the east line of Said Sunnyside Avenue and the city limits, also a strip 100 feet wide lying along the west line of and adjacent to said Sunnyside Avenue. Notice of this resolution shall be pu!i;,hed on the 4th da;7 of January and on the llth day of Januar., 1902, in the South Bend Daily Tribune. This Board, at its office in the City Mall on the 13th day of January 1902 at 10 A. 1111. will hear and receive remonstrances from all persons interested in or affected by these proceedings. Jaquith on pages 860 and 867 respectively of -street and sewer assessment duplicate. Clerk instructed to notify I% C. Toepp, that, if satisfactory to him, the Board will consider his contract of November 22nd, reinstated President. January 9, 1902. Petitions filed for improvelmnt of De Maude Avenue and Woodward Avenue. Referr- ed to Engineer for specifications. Clerk instructed to notify the South Bend Electric Co. to put a midnight light. at corner of North Main and Foote streets. Engineer instructed to report a grade for Navarre street east of Michigan, St. Plat of Henry Studebaker' s - irst Addition to the City of South Bend approved and copy filed. Plat of James A. Judie' s First Addition to the City of South Bend approved and copy filed. Contract signed with the Dixon Garbage Crematory Co. of Toledo, Ohio. for the construction of a garbage crematory at the central water works pumping station, including approaches and alterations to the building. Petitions for improvement of DeMaude and Woodward Avenue referred back to board by, the engineer with the suggestion that same be held pending a general scheme imp- rob'ement in that locality. Petition filed for curbing and sidewalks on Elmira street from Michigan to 2ellows streets. Engineer presented drawings and specifications for the brick paving of Laurel Eddy and Wayne streets and E. Colfax Avenue. IMPROVEMENT RESOLUTION NO. 43. Resolved by the Board of Public Works of the City of Soutn Bend, Indiana: That an improvement be made of the kind, size, location and terminal points as follows: The paving of Laurel street with brick from the south line of Washington street to the north line of Division street. Said improvement shall be known and designated as "Laurel Street Brick" and shall be constructed according to the plans and specificationd prepared by the City Civil Engineer, filed herewith. Notice of this resolution and proposals for bids -for the execution of the above work shall be published on the 14 day of Januany-and on the 21 day of January 1902 in the South Bend Daily Tribune and in the South Bend Daily Times. This Board will give a hearing on this resolution at its office in the City Hall on the 28 day of January 1902, at 7:15 P. M. and will receive bids up to 10 A. M. on the 3 day of February 1902. Notice of this resolution and proposals for bids for the execution of the above work shall be published on the 14 day of January and on the 21 day of January 1902 in the South Bend Daily Tribune and in the South Bend Daily Times. Resolved by the Board of Public Works of the City of South Bend, Indiana: That an improvement be made of the kind, size, location and terminal points as follows: The paving of E. Colfax Avenue with brick from the east line of Sycamore street to the west line of Eddy street. The roadway to be established at 34 feet in width throughout. Said improvement shall be known and designated as "E. Colfax-Avenue"Brick" and shall be con structed according to the plans and specifications prepared by the City CivilEngineer, filed herewith. Notice of this resolution and proposals for bids for the execution of the above work shall be published on the 14 day of January and on the 21 day of January 1902 in the South Bend Daily Tribune and in the South Bend Daily Times. This Board will give a hearing on this resolution at its office in the City Hall on the 28 day of January 1902 ay 7:15 P. M. and will receive bids up to 10 A. M. on the 3 day of February 1902. In regard to the hearing on the resolution for the vacation of Sunnyside Avenue, none of the parties interested appeared. This hearing is accordingly postponed until Tuesday, January 14th at 10 A. M. At which time Vacation Resolution No. 7 will be taken up. President. Dmmlf 4. 1902. Engineer requested to prepare estimates of the cost to the city for a pipe sewer from the Perley school west to Eddy street, south on Eddy to LaSalle Avenue, west on La Salle Avenue to connect with old rater street serer at St. Peter street; also for a trunk sewer out South Bend Avenue to Eddy street. Hearing on Vacation Resolution No,. 7 adopted January, 3rd 1902; ,,_E: LouisK Kuhns appeared for himself and for Ida S. Kuhns, Lucuis G. Tong, Helen S. Ulrich, Harriet C. Studebaker. John C. Birdsell appeared by attorney. No objections were offered to the proposed vacation, The Board declare the following property vacated: Beginning at the North West Corner of Section 7 in Township 37 North, Range 3 East, thence East on North boundary of said section 7 a distance of 1290 feet to place of beginning3 thence south to the North line of Jefferson street) thence southeasterly on the north line of Jefferson street to a point 50 feet at right angles East, thence North parallel with west line and 50 feet distant therefrom to the Borth line of said section 7. thence West 50 feet to place of beginning. Now come the above mentioned parties and waive notice of assessments or awards under the above resolution and hearing on such assessments and awards. The roll of property owners is already in the hands of this Board. The board find that in consideration of the dedication to the city by the above parties (except Birdsell) of the hereafter described property to be used as a public streets neither assessments or awards should be made, and accordingly none shall be made. Such dedication shall include the following described property: Beginning at a point distant East 1350 feet from the North West corner of section 7 in Township 37 North Range 3 East, thence South to the North line of Jefferson street, thence Southeasterly on the North line of Jefferson street to a point 50 feet at right angles east, thence North parallel with west line and 50 feet dist distant therefrom to the North line of said Section 7, thence West 50 feet to the place of beginning. In regard to the resolution of the Common Council concerning the ground north of the City Hall the Engineer is requested to prepare a sketch of this ground and the alley north for submission to the Common Council Committee. The Board will take this matter up with the committee to decide upon the best means of improving this strip. Engineer requested to report an estimated cost of paving west Division street with brick on gravel foundation and sand filler from the east line of Laurel street to the west line of Olive street, also a seperate estimate for same street from the east line of Walnut street to the west line of Olive street. ;7� President. Engineer requested to report the estimated cost to the Cfty of paving west La Salle Avenue with brick on gravel and sand filler from Taylor street to Laporte Avenue, and east La Salle Avenue from the bridge to Eddy street. Engineer presented his report on the estimated cost. to the City of paving Divi- sion street from,Laurel street to Olive street , 4361 and from Walnut street to Olive street $ 3144. Engineer reported, profile and grade of Corby street from Niles Avenue to Eddy street. Plat of Anderson's -First Subdivision of part of Bank Outiot 19 in the City of South Bend approved and copy filed. Clerk instructed to notify the South Bend. Electric Co. to snake the midnight light corner of Division and Me Pherson street an allnight Bight. Engineer requested to report on the advisability of moving Pennsylvania Avenue 30 feet north between High street and Miami street. Resolved bi the Board of Public Works that parties offering plats to the Board for approval shall satisfy the City Engineer that such plat has been sufficiently mon- umented by permanent corner stones. President of Board reported having requested City Attorney in writing'to give the necessary legal notices of removal to the respective landlords whose property will be vacated by the City. Such notices to include the removal of the present City Offices, The Police Station, Hose house No. 1. and any other property the City may vacate upon the completion of the new Central Fire Station and the City Hall. County Commissioners requested to defer action on the Pennsylvania Avenue cul- Vert for 10 days until the Engineer could finally report upon the exact location of such culvert. President. The Engineer filed the estimated cost $13607,80 The Board find that the benefits, .including the benefits to the city .are _equal to the estimated` cost of the improvement Improvement Resolution No. 45 is accordingly confirmed. In regard to the East Colfax Avenue improvement a remonstrance representing 1759 feet of frontage was filed against this improvement. The total frontage on said street is 5268-1/2 feet. A remonstrance against narrowing part of the roadway of said street to the width of 34 feet was also filed. The Engineer filed the estimated cost 20834.95 The Board find that the benefits including the benefits to said city are equal to the estimated cost of the improvement. Improvement Resolution No. 46 is accordingly confirmed.. South Bend Fuel and Gas Company notified of the amount and location of paving for 1902 and requested to notify the Board as to when they could lay gas mains with connections to the curb. President.
