Contract for piping Leeper Park awarded to William Downes for $390.00 using Crescent hydrants? But one bid was received for the Howard Park privilege, accordingly board refus- ed to award the contract. Bids will be received at 10 A. M. December 9th. Application. of E. G. Sipress for janitor of new City Hall filed. President. 206 December 3. 1901. Common Council report concerning transfers by the Indiana Ry. Co. taken up. The Board are of the opinion that it is within the duties of the City Attorney to enforce the terms of that cormpanys franchise L City Attorney requested to act on the matter. Board took up the mo$ion of Councilman Koczorowski concerning the grade of the street in front of the Shepherd Davis Coalyard. This matter is the sWbject of negotiation with the L.S.&M. S.R.R. Co. Matter of paving Vistula Avenue. Board held a consultation with property owners to ascertain ghat sort of an improvement was desired. No conclusion was arrived at. The board suggest to property owners that it would be desirable to have them dedicate the river front to the City to protect themselves against building on this property. The City can then arra, nm for double tracks without narrowing the roadway over 5 feet. Engineer ins -- trusted to prepare a sketch of the proposition of the Board to enable property owners to understand the same: Bids opened for construction of now central fire station. Indiana Lumber &cMfgio Co. were beat bidders f )r pressed brick; $14639. Hilton Hammond was best bidder for common red brick,$13677. The Board reserved its decision pending consultation with Mr. Birdsall. Contract signed with the Indiana,Illinois and Iowa Railroad Co. authorizing the previous construction of their road in the city limits and the extexsiox of the same ac r across the southern part of the City to the eastern limits of the City. 4 k 12� Z--� President, 207 . 7:15 P. Petition filed for grading and construction of cement sidewalks and curbsAfrom East line of Michigan to west line of Fellows St. Hearing on the assessment rolls and final estimates for the following improve- ments: Napier street, under Improvement Resolution No; 30; West Division street, under Imp— rovsmant Resolution No-41: the grading of_ the alley east of Michigan street, under Impeove-- ment Resolution No. 40; the cement curb on Wenger street, under Improvement Resolution No. 41; North Michigan Street, under Improvement Resolution No. 15• In regard to Napier street a remonstrance was made by Peter Toepp against the amount of his assessment. No other rer&— onstrators appeared as to Napier street. In regard to Division street no remonstrators appeared. The assessment roll, filed on November 21st, and the final estimate, allowed on November 21st, are 1-lereby confirmed. In regard to the cement curb on Wenger street the following persons remonstr ated against the confirmation of the final estimate; H. Another hearing will be givex on this improvement on December 17th, 1901 at 7:15 P. M. In, regardto north Michigan street, no remonstrators appeared and no remonstraa,ces were filed except. by Elisha Peck. Said Peck remonstrated against the confirmation of the final . estimate, asking a reduction of $1000.00 from his assessment. In regard to grading Notre Dame street between Madison street and east LaSalle A . Avenue . Street Commissioner instructed to -examine the Milburn ditch on the township line near the east City limits and report upon the condition of same as to free flow of water through city territory. Remonstrance filed against the paving of Laurel street from Colfax Avenue to Washington street. The board is of the opinion that pavement is unnecessary on this part of Laurel street -at present. Resolved that notices as to the amount of assessments be published in the South Bend Daily Tribune and in the South Bend Daily Times for six successive days beginning on the 9th day of Dec— ember 1901y. stating that this Board will give a hearing on the amount of assessments on the 17th day of December at 7:15 P. M. Resolved further that the entire work under the above contracts be accepted and approved and the final estimates allowed. Notice of this resolution shall be published in the South Bend Daily Times and in the South Bend Daily Tribune on the 9th day of December, stating that this Board will give a hearing on this resolution on the 17th day of December 1901 at 7:15 P. December 10 1901 • Contract for new Central Fire Station prepared and submitted to J• C• Birdsell for execution, Contract price including heating and plumbing 16109.00 Report of Common Council upon the garbage crematory construction received. It was decided to have the City Engineer inspect the Dixon plant at Fort Wayne before enter- ing into a contract• President• -'ember 12_` 1901• In ,regard to Orange street opening, clerk reported that Napomocyna Koteras could not be found, that the house formerly occupied by him was empty and that no person of age or discretion could be found. on the premises. He was also informed that said KQter- as was not a non-resident .but still lived in South Bend. Board was further informed that said Koteras was in Michigan City prison. Ordered that a notice as to the amount of asses - went against said Koteras be sent at once to the prison warden with request that same be read to Koteras. Board were further informed that one Henry Schultz was owner of this pro- perty although County revords show Koteras to be the owner it was ordered that said Schultz be sent a notice of the amount of assessment. Board was further informed that Chris Fassnacht was not interested in these proceedings having sold to Martha J. Inwood. Ordered that Clerk immediately serve a notice on said Martha J. Inwood that the amo_.,nt of her assessment was $60.00 Board were further informed that the assessment for Ella Calvert for all except 102 feet off the East end and except 18.165 feet North and South by 100 ft in the South west corner and except Bernhard of Lot 25 in College Grove Addition, should be against Joseph B. Arnold. Although the County records show this property to be in the name of Ella Calvert it was ordered to send said Joseph B. Arnold a notice of assessment in sum of $180.00 President. 99 Permission granted South Bend Iron Works to put in private sewer through the alley south of Orchard Street from Chapin to Prairie Avenue. Agreement with Siders Brothers made to put all earth from new central fire station excavation at foot of Marion street at V per load. 0 President. December 16. 1901• Board find that it has no legal right to pay city money on the claim of Charles Lockstidt as the city is not liable for the injury sustained by him. Petitions for electric lights corners of A and C and Van Buren streets referred to street commissioner for a report. Street commissioner reported having examined the Milburn ditch within the city limits and having found the same in good shape and water flowing unimpeded. Engineer reported having inspected the Dixon crematory at -Fort Wayne and having found same highly satisfactory. week. James Reed, warden of Michigan City prison that no such person as Napomocyna Koteras could be found there. Clerk instructed to make further search for this gentleman and if possible to secure his attendance at the hearing on December 17th, 1901. In regard to Orange street clerk reported having followed instructions of Dec. 12th meeting and having been unable to find Koteras• The Board requests all persons having bills against this department to render the same before Saturday December 28th. Hickman, Frederick and Theresa Warkentine, James and Emma Mitchell, John Rosinski, Marcella and Maggie Latkowski, John Snhwind; The Board after hearing the arguments of the remonstrators and petitioners find that the assessments as made would in many instances be less than the benefits to the property assessed and accordingly do hereby rescind condemnation resolu-4io tion No. 4 and abondon further proceedings thereunder. Hearing on the assessment rolls and final estimates for the following improv- ments: the Wenger street curb. under Improvement Resolution No.41; the north Lafayette street brick pavement improvement, under Improvement Resolution No. 4; the south Mich- igan street brick pavement improvement, under prior proceedings of the Common Council; the grading of ruerbringer alley under Improvement Pbsolution No. 42; the east Washington street sewer, undcN Tmprovement Resolution_ No.39. In regard to the Wenger street curb the Board find that the work is not yet satisfactory and accordingly must again postpone the confirmation of Improvement Resolution No. 41. Another hearing in this: resolution will be given on Monday December 30th at 11 A. M. Clerk instructed to notify contractor that this work must be satisfactory by that time. In regard to the north Lafayette street brick pavement. No remonstrances were filed and no'remonstrators appeared. The assessment roll filed on December 9, 1901 and the final estimate allowed on December 9 are hereby confir- med. In regard to ruerbringer alley no remonstrances were filed and no remonstrators app- eared, the assessment roll, filed on December 9. 1901 and the final estimate, allowed on December 9. 1901 are hereby confirmed. In regard to the south Michigan street brick pave- ment improvement under prior proceedings of the Council:- Remonstrators appeared and object ed to the quality of the work, claiming the work to be uneven and rough. The Board accord- ingly find that this work should be inspected by the Engineer and a report made to the Board befor this Board can accept the same, and on Monday December 30th, 1901 at 11 A. M. another hearing will be given on this assessment roll and final estimate. The Common Coun- cil having already accepted the work the Board will after hearing the report of the Eng- ineer make such recommendations to the Council as it find proper -In regard to the east December°17. 1901. 715 P. Clerk instructed to notify the South Bend Electric Company to instal electric midnight lights at the corners of A and C and Van.Buren streets. Also to notify the Comp- any to please present their street lighting bill for December on the 28th. Resolved by the department of public works that the city property of about 10 acres lying north of the east end of the Sample street bridges between Parry street and Eddy streets and the St. Josoph river be hereafter known under the proceedings of this board as LASALLE PAILK' as soon as the new . nrematory is completed these premises will no longer be used as a dumping g±ound. Clerk instructed to notify contractor on Wenger street curb that this work must be made satisfactory by December 30. o President. Decembet-20. 1901. Condemnation Resolution No. 3, adopted October 3rd 1901 for the appropriation of property of Lucretia Creed for the widening of South Main street is hereby retdinded. The board are informed that property owners in the southern part of the ,city desire the open- ing of Main street and the entire matter can better be disposed of in one proceeding. Water Works rules relating to government of plumbers amended as follows: See- C1.1 0 tion 25: Ever;; family and every occupant of premises whether occupying one or more build- ings shall have a distinct stop box at the curb and distinct service pipe leading from such stop box to basement. No plumber shall under any circumstances connect more than one family or occupant of premises on the same service pipe. Where m.one than one family or occupant is to be supplied the service pipe from main to curb shall be one inch or more in diameter. W. H. ..'ries contracted to furnish 50 or more loads of earth at per load for Marion street. President. New contract for telephone franchise of five partners ( formerly St. Joseph County Telephone Company.) signed and submitted to Common Council for ratification. President. December 24 1901. Decenber &3�0. 1901. 7:15 P. 11. .,The Board held a special meeting in order to' give the contractor on the Wenger street curb improvement an opportunity to present his sid: o' the dispute with the proper- ty owners. Owing to misunderstanding the contractor expected that the regular hearing would be given at 7:15 P. M. instead of 11 A. M. A written statement was presented by the contractor in defence of his work.
