Resolved that notices as to the amounts of assessments be published in the South Bend Daily Tribune and in the South Bend Daily Times for six successive days beginning on the 2nd day of October, 1901, stating that this Board will give a hearing as to the amount of assessments on the 15th day of October, 1901, at 7:15 P. M. Resolved further that the entire work under the contracts for the above improvements be accepted and app- roved and the final estimates therefore allowed. Notice of this resolution shall be published in the South Bend Daily Tribune and in the South Bend Daily Times on the 2nd day of October 1901, stating that this Board will give a hearing on such final estimates on October 15th, 1901 at 7:15 P. M. Engineer reported grade for the alley north of Fuerbringers 3rd Addition* Seine adopted and approved. IMPROVEMENT RESOLUTION NO. 42. Resolved by the Board of Public Works of the City of South Bend, Indiana: That an improvement be made of the kind, size, location and terminal points as follows: Grading the alley running east and west between Michigan Avenue and Fuerbringer street, from Kankakee Avenue to the alley west of Harrison Avenue. Said improvement shall be known and designated as"Grading alley in Fuerbringer's 3rd Addition" and shall be constructed accor- ding to the plans and specifications prepared by the City Civil Engineer, filed herewith. Notice of this resolution and proposals for bids for the exeeuton.of the above work shall be published on the 2 day of October and on the 9 day of October 1901, in the South Bend Daily Tribune and in the South Bend Daily Times. This Board will give a hearing on this resolution at its office in the City Hall on the 15 day of October 1901, at 7:15 P. M. and will receive bids up to 10 Ag M. on the 17 day of October 1901• VACATION RESOLUTION NO. 6. Resolved by the Board of Public Works of the City of South Bend, Indiana: That it is desirable to vacate the following: Beginning at the north-east corner of lot 20 in Miller's Addition to the City o- South Bend, running thence north6.45 feet, thence north- west with the present north line of the alley 9.3 feet, thence due west to the south line of the present alley, thence south-east along the south line of said alley to the place of beginning, being a part of the alley lying between lots 1 in Witheri.il's Addition to the City of South Bend, and lot 20 in Miller's Addition to the City of South Bend. The following property may be injurously or beneficially affected by such vacation. Lot 1 Witherill's Addition, owned by J. G. Wunderlich, Lot 20 Miller's Addition, owned by Swan J. Nelson. President. 167 r 1._ 1901. 7:15 P. M. Clerk reported having examined the city records and having failed to find any - record that the alley east of Walnut street and south of the L. S. & M. S. R. _R. CO. tracks had ever been extended from that Company's right of way. Clerk instructed to give J. N.. Lederer a deed for Cemetery lot 14 Block 4, rs. Range 1 W. Also to give Mris Kuntsman a deed for Cemetery Lot 14 Block 7, Range 2 West. Invitations for crematory bids were extended to the Decarie Crematory of 555 St. Paul street, Montreal, Canada. Also to the horse BoulgerCo,. of 39 Cortlandt street New York. First hearing on Improvement Resolution No. 41 for grading west Division street from the Section line between Sections 10 and 11, Township 37, N, Range 2 East, to the east line of Olive street. No remonstrators appeared and no remonstrances were filed. The engineer filed the estimated cost $702..75. The Board find that the benefits including the benefits to the City are equal to the estimated cost of the improvement. Improvement Resolution No. 41 is therefore confirmed. Offer of Taylor and Barnes of Lot 37 0. P. on Vistula Avenue for Central Fire -- Station filed. Offer of Mary A. Campau to build a central fire station on her property at the corner of Wayne and Lafayette streets received. The terms of the offer being that the propert;( first be bought for cash for 10000.00, after which the station will be built . at a cost not to exceed $16000.00 and upon the terms of the Oliver city hall contract at 50 . Board decided to at once prepare a contract and .deed for consideration of the Common Council at their next meeting. President. ��� October 3. 1901. Condemnation Resolution No. 3• Resolved by the Board of Public Works of the City of South Bend, Indiana: That the following described property be appropriated for the use of said city: Beginning on the south line of Midway street at a point 49 1/2 feet east of the north east corner of Lot 1 in.Creed's Second Addition to the City of South Bend, thence east 49 1/2 feet, then south 397 feet, thence west 49 1/2 feet, thence north to the place of beginning. The following described property may be injuriously or beneficially affected by such approp- riation: Lots 1 to 11 inclusive of Creed's Second Addition to the city of South Bend, the property of Jonathan P. Creed. Also the following tract of ground: Beginning at a point on the south line 'of Midway street at a point 49 1/2 feet eastof the northeast, corner of lot 1 in 'Greed's Second Addition to the City of South Send, thence east 63 1/2 feet, thence s south 113 feet, thence east 8 1/4 feet, thence south 284 feet, thence west 78 feet more or less, to a point due south of the place of beginning, thence north 397 feet to the place of beginning, the property of Lucretia Creed. French of property on corner of Michigan Avenue and' Wood street for a Central Fire Station, 7800 square feet, for $4600.00, received and filed. Petition for continuation of the Eddy street brick pavement from the north line of Washington street to the south line of East LaSalle Avenue referred to the Engineer for specifications. Work to be done in 1902. C. H. Defrees given until November loth 1901 to complete his north Lafayette;St contract and permission granted to begin as soon as two squares of brick were upon the ground. Bids received and opened for the Division street grading under Improvement Res- olution No. 41; contract awarded to Harry N. Barnes at .17 cents per cubic yard. October 3. 1901• Assessment rolls and final estimates filed for the cement curb and grading on Sibley Avenue, and the cement walk and curb and grading on C street, under Improvement Resolutions 12 and 23 respectively. Ordered that notices as to amount of assessments be published in the South Bend Daily Tribune and in the South Bend Daily Times for six successive days beginning on the 4th day of October, 1901, stating that this Board will give a hearing as to the amount of assessments on the 15th day of October, 1901, at 7:15 P. M. Resolved further that the entire work under the above contracts be accepted and approved and the final estimates therefore allowed, and that notices of this resolution be published in the South Bend Daily Tribune and in the South Bend Daily Times on the 4th day of October, 1901, stating that this Board will give a hearing on this resolution on the 15th day ofO cyober 1901 at 7:15 P. St. Joseph County Savings Bank notified that since the offer of Mrs Campau of $10000.00 for Fire Station property has been received, the Board do not think it worth while to submit a fire station contract to the Council unless the bank is willing to make a considerable reduction from its offer of $15000.00 President• tober 4.. 1901- City Treasurer requested to mark the Lafayette street sewer connection assess - rent of Charles Coonley of $9.63 paid. Charles Coonley has this day agreed to pay this amount in case he uses this connection. Resolved that the prima facie assessments for paving improvements be upon the basis that the City will pay for all street and alley intersections. This to apply to the following improvements: North Lafayette, North Michigan, Navarre, LaSalle, Mill and Napier. The Board have come to this conclusion because of the fact that petitioners above improvements signed the petitions for the same before the adopt on::by the='B€ Ard=•of vc he new method of street assessments. Street improvements which were petitioned for after the adoption of the new method of assessment will be apportioned according to the new method whereby the City does not pay for street and alley intersections except where in the opinion of the Board of Public Works the City will derive some special benefits therefrom. Resolved that bills not presented before the third of the month will not be paid until the following month. The resolution of April 5th, 1903�2 fixing such time as the 5th of the month, is hereby revoked. Clerk instructed to give Mrs. A. B. Merritt a deed to Lot 36, Block 8, Range 1 East, in the City cemetery. President. 7. 1901. Treasurer requested to mark paid the assessment for water connection for Lot 15 Outlot 28 Cobb's Addition, against R. J. Chestnutwood Jr. Petition filed for the establishment of a grade for Campau street. Referred to the Engineer. South Bend Electric Co. notified that the maple trees in front of the George Barnhard and 0. M. Cunningham properties on West Washington street were being ruined by their wires and requested to give the matter their immediate attention and to stop further damage. Engineer reported that the approach on.the west side of the Sample street bridge had been completed. This work is all that the City will undertake. The City will not build the approaches on the east side. Hearing on the matters concerning Division street and its occupation by the Grand Trunk and Western R. R. CO. The Board were met by a committee of property owners on the street. The first question which the Board desired to have settled was whether or not the railway company could be entirely ousted from the street. Judge Howard, representing the property owners, and Mr Ward, City Attorney, advised the Board that in their opinion an attempt to oust the company from their present rights on the street would result in a failure and that at this late date the courts would probaly uphold the present rights of the company in the use of the street. The Board therefore find that it wi-1 take no steps to oust the Grand Trunk and Western R. R. Co. from its present rights and franchises on Division street. The next question discussed was whether or not the railway company could be prevented by the City from laying a double track on Division street east of Taylor St. Board decided to call upon Messrs Anderson, Dushane and Crabill to satisfy the Board of the company's right to do this. Meeting adjourned till Monday October 14th, 1901. President. 172 October,8.-1901• Mr August Beyers met the Board and generously offered to dedicate free of cost to the City sufficient land for the extension of Eddy street to the Sample street bridge-. The offer was accepted. Assessment rolls and final estimates filed for the Wenger street and Ford street improvements under Improvement Resolutions 41 and 42 respectively. Ordered that notices ad to amount of assessments be published in the South Bend Daily Tribune and the South Bend Daily Times for six successive days beginning on the 9th day of October, 1901, stating. that this Board will give a hearing as to the amount of assessments on the 29th day of October, 1901, at 7:15 P. M. Resolved further that the entire work under the above con-6-1..., tracts be accepted and approved and the final estimates therefor allowed. Notice of this` resolution shall be published in the South Bend Daily Tribune and in the South Bend Daily Times on the 9th day of October, 1901, stating that this Board will give a hearing on this resolution on the 29th day of October, 1901, at 7:15 P. M. The engineer presented drawings of the grounds of the different fire stations showing Park Superendent Barker's suggestions for improving the same. Clerk instructed to turn same over to Mr. Barker. Street Commissioner instructed to examine the Hydraulic Avenue board sidewalk, along the east race and make necessary repairs to the same. President. 173 October 8. 1901.-715 P. M. Hearing on the assessment rolls and final estimates for the following improvements:— the Navarre street brick paving, under Improvement Resolution No. 114 the Division street cement curbing, under Improvement Resolution No. 31; and the north Hill street cement corbing and cobble stone, under Improvement Resolution No. 40. No rem- onstrators appeared and no remonstrances were filed. The Board therefore find that the assessment rolls, filed on September 26th, 1901, and the final estimates, allowed on September 26th, 1901, should be, and hereby are confirmed. President. 174 October 10, 1901•• Contract signed with Harry N. Barnes for the grading of West Division street under Improvement Resolution No. 41• -- Clerk instructed to notify August Beyers that the Eddy Street dedication deed and map were ready for his inspection and execution. Con -.race of B. Thomas Beardsley for the water connections on Napier street recinded. This contract was made August 12, 1901 but after repeated requests from the Board the Contractor failed to begin work. Same was awarded ,to Mr. -Thomas Williams at same price, namely $15.50 on south side and $14.00 on north side. President. 175- 'ober. 14, 1901 - J- H- Moore of Evanston, Illinois, favored the Board with a report of the work— ing of the Pearse, LaChapelle crematory* Same showed that from October lst, 1900 to October 1st, 1901, 2648 tons of pure garbage had been burned with a consumption of 903940 pounds of slack - Deed from August Beyer for the extension of Eddy street to the Sample street bridge turned over to him for signatures- City agrees to protect the mineral spring in case it comes within the line of the new street - Engineer reported a grade for Accommodation street from Burroughs to Cushing streets. Same approved, adopted and filed - Notice received from Mary Campau that she had withdrawn from the market her property at corner of Wayne and Lafayette streets and same was no longer for sale for Purpose of a central fire station. Complaints received from farmers entering the City from South Michigan street that they needed some facilities for crossing Bowman creek during the construction of the new bridge* As this is outside of the Cite the clerk was instrdcted to notify the County Commissioners - Hearing on the matters concerning Division street. The discussion of October 7th 1901, was taken up and attorneys for teh R• R• Company presented agreements to support the company's right to double track Division street as far as Taylorsstreet• The Board however are not satisfied that the Company has this right- Accordingly it was decided to present an ordinance to the Common Council repealing so much of Ordinance No- 62 as gave rights to lay two tracks on Division street as far as Taylor- Such an ordinance will be approved by the Board and the Council requested to pass the same at this evenings meeting- President- October 15. 1901•, T Remonstrance filed against the condemnation of property for the opening of Orange street• Petition for an electric light at corner of Nilson and Sample streets referred to street commissioner for -a report - Charles Thacheray & Co• Montreal, Canada invited to bid on garbage crematory - Board decided to advertise three insertions in the South Bend Daily Tribune for plans for new central fire station• P re s i dent - w October 15. 1901. 7:15 P. M. Hearing on Vacation Resolution No. 6 adopted October 1st, 1901. No remonstrances were filed and on remonstrators appeared against the proposed vacation. The Board there- fore find that Vacati on Res oluti on No. 6, should be confirmed. The Board declare the fo11- owing property vacated: Beginning at the northeast corner of Lot 20 in Miller's Addition to the City of South Bend, running thence north 6.45 feet, thence northwest with the pre- sent north line of the alley 9.03 feet, thence due west t o the south line of'the present alley, thence southeast along the south line of said alley to the place of beginning, being a part of the alley lying between Lots 1 in Witherill's Addition to the City of South Bend and Lot 20 in Millers Addition to the City of South Bend. -No assessments or awards will be necessary in these proceedings. Hearing on Condemnation Resolution No. 3, a4opted October 3, 1901. Lucretia Creed remonstrated against the proposed appropriation of property. The Board however find that condemnation Resolution No.3 should be confirmed. The Board declare the following described property condemned: Beginning on the south line of Midwat street at a point 49-1/2 feet east of the northeast corner of Lot 1 in Creed's Second Addition to the City of South Bend, thence east 49-1/2 feet, thence south 397 feei,thence west 49-1/2 feet, thence north to the place of beginning. The Engineer presented the roll of property owners affected by the above condemnation proceedings, the only owner of affected property being Lucretia Creed. The Board find that the property of Lucretia Creed has been damaged to the extent of $50.00 and therefore awards her that sum. Clerk -',.instructed to serve person- al notice on Lucretia Creed which shall state that on Tuesday October 291 1901, at 7:15 P. M. the Board would hear any remonstrance she might have as to the amount of her award. Hearing on the assessment rolls and final estimates for thefollowing improve- ments: the west Dater street brick pavement, under Improvement Resolution No. 14; the cement curb and grading on College street under Improvement Resolution No. 13: the cement curb and grading on Sibley Avenue, under Improvement Resolution N0.12; and the cement walk, curb and grading on C street, under Improvement Resolution No. 23. No rem- onstrators appeared or remonstrances were presented, except August and John, Charles, Bertha and Ella Prast, who objected to the amount of their assessment for the West water street brick pavement. The Board however find that the above assessments and final estirt-t mates should be confirmed. Board decide d,upon publication of the new annexation ordinance, to begin pro- ceedings for the widening of Olive street from L.. S.& M. S. R. R. Co. property to Mich- igan Avenue. Hearing on the question of authorizing the Indi=ay Illinois and Iowa Ry Co. to extend its line eastward through the southern part of the City. The railway company did not appear. About twenty-five interested property owners appeared before the Board and ,remonstrated against the occupation of any streets and alleys for the proposed extension. The property owners were represented by attorney W. G. Crabill. The Board listened to the arguments of Mr. Crabill. The Board had previously looked over the site of the proposed extension and had seen about what property would be affected, and what streets and alleys occupied. The Board decided that it would not authorize or empower any railway company to construct a line upon the route outlined by this Company. October 29 1901. City .Treasurer requested to mark paid the assessment and interest against W-m G. and Catherine Schroeder for East Market street sidewalk: This assessment which dr. Hearing upon the award of $50.00 to Lucretia Creed in proceedings under Comdem- nation Resolution No.3 for the widening of south Main street. Lucretia Creed presented a remonstrance against the amount of her award on ground that it was to small and that t the Board had not considered the market value of the strip nor the remainder of her land. The Board however find that the award should be confirmed. -and that the amount of $50 00 be tendered to Lucretia Creed to be paid out of the City Treasury as benefits accruing to the City. Clerk instructed to tender to Lucretia Creed in person a' certificate or, voucher for $50.00 and to tell said Lucretia Creed that the same will be honored by the City Comptroller upon presentation at any time. Hearing as to amount of assessments and upon the final estimates for the west Madison street pipe sewer and the west Washington street cement sidewalks, under Imp'- rovement Resolutions 33 and 34 respectively. No remonstrators appeared. The assessment rolls, filed upon October 17, 1901, and the final estimates allowed upon the same date, are hereby confirmed. Hearing upon the amount of assessments and upon the final estimates for the.. water connections on Napier street, from Scott to Chapin streets, and on north Lafayette street from Colfax Avenue to Navarre street. No remonstrators appeared as to Napier s re street, but one Collar appeared and objected to the acceptance of the work on north Laf- ayette street. The assessment roll filed upon October 18, 1901, for Napier Street and. the final estimate, allowed upon the same date, is hereby confirmed. But the confirmation of the North Lafayette street work is hereby withheld until November 12th, 1901 for another hearing at 7 :15 P' M. on that date. Hearing on Condemnation Resolution No-4-for appropriating the property of Franklin Reese and George Hodson for the opening of Orange street through to Birdsell street -No remon- strators appeared. The board declare the following described property condemned for the purpose of said street opening: a part of Lot 3 in Arnold and Pagin's Subdivision of State Bank Outlots 80 and 81, described as follows; beginning at the north east corner of said Lot 3, thence south 37.8 feet, thence Nest to the West line of said lot, thence North 37.4 feet, thence Least to the Place -of; -beginning, the property of Franklin Reese.
