Lucretia Creed notified that 'the City will shortly begin proceedings to widen south Main street from Midway street south 397 feet to the full width of 99 feet. Assessment rolls and final estimates filed for the A street and D street imp- roveme nts under Improvement Resolutions No. 6 and 24 respectively. Resolved that notices as to the amount of assessments be published in the South Bend Daily Tribune axed in the South Bend Daily Times for six successive days beginning on the 4th day of September 1901 stating that this board_will give a hearing on this resolution on the 17th day of Sep- tember1901 at 7:15 P. M. Resolved further that the entire work under the above contracts be accepted and approved and the final estimates therefor allowed. Notice of this resol ution shall be published in the South Bend Daily Tribune and in the South Bend Daily Tim- eson the 4th day of Septemberl901, stating that this Board will give a hearing on the acceptance of such final estimates on the 17th day of September at 7:15 P. The confirmation of the assessment roll and final estimate on Monday September 9 1901, is hereby revoked for the foiklowing reasons. Certain property owners appeared on. Se- ptember loth and informed the Board that they were misled as to the date of the hearing and therefore were deprived of the opportunity to remonstrate against the acceptance of the work. It is therefore resolved by the Board that the matter be reopened for the belief it of,such property owners and that the Clerk give all property owners affected by or int- erested in these proceedings a personal notice in writing informing them that their remon- strance, would be heard on Tuesday September 17 at 7:15 P. M. at which time the assess meat roll and final estimate would be again considered and passed upon. President. 145 Petition of E. F. President. September 16. 19010 Michigan Central R. R.� Co. notified to bring their tracks to grade on Emerick street from Water street north to City limits. Engineer reported speciffications for grade on West Division street from Section line between Sections 10 and 11, Twp 37- N. R. 2 E. to the east line of Olive street. Street Commissioner instructed to plow out the gutters on East Madison street from Michigan street to the 1st alley east of Michigan street. IMPROVEMENT RESOLUTION NO. 41. Resolved by the Board of Pubile Works of the City of South Bend, Indiana, That an improvement be made of the kind, size, location and terminal points as follows; Grading West Division street from the Section line between Sections 10 and 11, Twp 37- North Range,2 East to the East line of Olive street. Said improvement shall be known and desig- nated as"W. Division street grading" and shall be constructed according to the plans and specifications prepared by the City Civil Ehgineer, filed herewith. Notice of thisares- olution and proposals for bids for the execution of the above work shall be published on the 17 day of September and on the 24 day of September 1901, in the South Bend. Daily Tri- bune and in the South Bend Daily Times. This Board will give a hearing on this resolution at its office in the City Hall on the lst day, of October 1901, at 7:15 P. Co. move a telepraph pole which stands in the middle of the alley east of Walnut street and the fence of that Company which obstructs the end of the same alley. President. 901. 7:15 P. M. Hearing on the Francis street cement walk and curb under Improvement Resolution No. 16. The f ollowin,-3 persons appeared and remonstrated against the acceptance of the work and against the assessment roll: -William Turnock, Daniel Weiss, Caroline Rodifer, Rose McCafferty, James Mccafferty, Helen McMichael, estate, George Bauerfeind, Warren C. Dodge estate. No other remonstrators appeared. The Board find that a personal inspecti- on by them is desirable and accordingly again postpone the confirmation of the assess- ment roll and final estimate until Tuesday September 24th, 1901 at 7:15 .P. M. Hearing on the assessment rolls and final estimates for the A and D street imp- rovements under Improvement Resolutions No. 6 and 24 respectively. A remonstrance was fil- ed against the A street assessment on the following ground, that the grade of A street was such that water collected and flooded the street and sidewalks. The Engineer reported that this condition was due to want of proper facilities for carrying off the *cater and that a sewer on the street would solve the difficulty. The contractor is not responsible for the above condition and the Board therefore find that the assessment rolls, filed on Sept- ember 3rd, 1901, and the final estimates, allowed on September 3rd 1901, should be confir- med. President. 150 r zu. ivui. Petition for cement sidewalk on the west side of Diamond Avenue between Laporte and Michigan Avenues. Same filed for 1902 when both sides will be included-. Street. Commissioner reported that the Lake Shore & Michigan Southern Railway Co. claim that the telegraph pole in the alley east of Walnut street is in their right of way and that Company refuse to remove it. The alley, according to the claim of the Companys:, and the fence, are upon their priv Ate property at this point. Referred to the Engineer'to verify this claim. Board find that the Lake Shore & Michigam Southern Railway Company own the prof perty commonly supposed to be within the line of Division street in front of Lot 70 Com missioners Sub. Neither is this property within the limits of Walnut street. The.Company are under no obligations to put a sidewalk here -and have refused permission to the,City to do. so. President. HOW The ommision of pages 151 to 159 inclusive, is due to the'carlesshess of a stra- nger who tore the same in attempting to operate the maoh'ine. Rte;aident *. Conmunication received from the Lake Shore and Michigan Southern Railway Co. that they had not refused to move the°pole from the alley east'of Walnut street but that they had referred the matter for investigation aria if the alley was found to be a public highway the pole would be removed. Also that the Company would lease enough ground to the City in front of Lot 70 Commissioners Sub. for a sidewalk at a nominal rental of 1.00 per year. Michigan Central Railway Company notified that their tracks on Emerick street were above grade but that as Emerick street would probally be paved in the spring the bringing of the tracks to grade might well be deferred until that time. The Company was requested to put in a pipe at Madison street to drain off the water from sidewalks. Contract for telephone franchise of St. Joseph County Telephone Co. signed and submitted to Common Council for ratification. President. nrt ember 24. 1901. Resolved by the Board of Publie Works that on Monday September 30th, 1901, at 11 A. M. this Board will meet -,with a commiVtee of Division street property ownersnto con sider matters pertaining to the double track proposition of the R. R. Co• Such committee to consist of three persons and no more. Engineer instructed to secure a lease from month to month at $1.00 per year from the Lake Shore and Michigan Southern Railroad Company for purpose of putting a side— walk in front of Lot 70 in Commissioners Subdivision. Bids for the establishment of a garbage crematory system asked of the following firms, same to be received November lst, 1901. Dixon Crematory Co. — Toledo, Ohio• Pearse and Chapelle _ — Ottawa, III. Smith Improved Crematory Co. — Bridgeport, Conn. Davis Crematory Co, — Lancaster, Penn. Smead Cremating and Power Co, — Toledo, Ohio• International Sewage Disposal Co, — Boston, Mass. Resolved further that the proposals shall not promise a contract to any bidder but that the Board shall receive the same for information only, reserving the right to reject any or all bids at its pleasure. The following remonstrators appeared and remonstrated against the confirmation of the assessment roll and final estimate. Wills notified that the board would be pleased to negotiate a contract for the purchase of the Campeau property and the erection of afire station for the City,: - Further proceedings under Vacation Resolution No.4 for the vacation of part of Saint Joseph Street having been dropped, and the Board being Of the opinion that such vacation is unnecessary, it is accordingly ordered that the action taken by the Board on July 6, 1901, at 7:15 P. Barrett to a dedication of a strip of ground along the west bank of the Saint Joseph river between Marion street and Leeper bridge for park and boulevard purposes, and for the extension of Marion street to the river. Bill will be held against that Company. Petition for establishment of a.grade on Accomodation street and privilege to C. E. Keltner for grading part.of the street, referred to the Engineer. Remonstrance of 12 persons filed against grading the alley between Diamond and Brick Avenues. No action taken as the grading of this alley has not yet been petition- ed for. Petition of Emma Smith for a free water tap on South street, referred to Water Works SupOr intendent . Engineer requested to prepare such plans for systematic improvement of the fire engine house grounds as the park superintendent desired. President. Mk ember 30. 1901i. Lease for a strip of ground front of Lot 70 Commissioners Sub. for a sidewalk forwarded to the Lake Shore and Michigan Southern.Railroad Co. for execution. Lake,Shore and Michigan Southern Railroad Company met the Board and held a con-' veraation regarding that Company's grade west of the Grand Trunk Crossing. It was decided to have the Company's engineer go over the matter with the City Engineer. Committee of Division street property owners met the Board and matters pertain- ing to Division street were considered. No conclusions were arrived at. Petition filed for the construction of a sidewalk on t__e west side of Witwer street from Dubail to Midway street. Remonstrance filed against the construction of a Central Fire Station on the Compau property at the corner of Lafayette and Wayne streets. Remonstrance bore 32 sig- natures. Deed from Jonh Wunderlich and wife to the City for alley purposes received and turned over to the County Recordee for record. Clerk instructed to look up -the Council proceedings and ascertain whether the alley east of Walnut street and south of the Lake Shore and Michigan Southern Railroad tracks has ever been extended from that Co's right of way north to Division street. If not the present telegraph pole, supposed to be in the way of the public, property of the Company. is on the private President.
