Thoma,3 Beardsley, nextbidder, at $20.65 each complete connection on the East side of the. street and $16.45 on the west side. Engineer instructed to report a grade for High street from Midway street to Sample street, also to prepare specifications for grading said street. On petition of all the property owners and by consent of the contract®r, C. H. Defrees, the specifications for the Lafayette street brick pavement improvement under Imp- rovement Resolution No-4 are changed and sand filler instead of pitch shall be used. Contracts signed for the following improvements:- Calvert H. Defrees for Napier street under Improvement Resolution No. 30. Harry N. Barnes for Test Division street, under Improvement -Resolution No 31 Wm McSherry for "D" street, under Improvement Resolution'No. 28 Ransom Z. Snell for west Washington street under Improvement Resolution No. 34 and for Laurel street, under Improvement Resolution No. 35 Contract for the Madison street sewer under Improvement Resolution No. 33 award- ed to James Nelson. Assessment rolls and final estimates filed for the following improvements:lst• Frances street, under Improvement Resolution No. 16 2Nd, Eddy street, under prior procee- ��M the Council. 3rd, Singer sewer, on Circle avenue, College and Division streets• on street brick pavement, under prior proceedings of the Council. 5th, Water connections on West Navarre street under prior proceedings of the Council. Resolved that notices as to the amount of assessments be published in the South Bend Daily Tribune and in the South Bend Daily Times for six successive days beginning on the 2nd day of Aug- ust, 1901, stating that this board will give a hearing as to the amount of assessments on the 13th day of August, 1901, at 7:15 P. M. Resolved further that the entire work under the contracts for the above improvements be accepted and approved and the final estimates therefor allowed. Ndtice of this resolution shall be published in the South Bend Daily Tr- ibune and in the South Bend Daily Times on the 2nd day of August, 1901, stating that this board will give a hearing on this resolution on the 13th day of August, 1901, at 7:15 P.M. Bids opened for East Washington street -and East Colfax Avenue sewers and, for the Ford, Wenger and Hill street improvements, and referred to the Engineer for tabulation. Voucher No. 474 in favor of Elisha Peck and Hannah Peck for-4 1200.00 drawn and signed. Clerk instructed to present said voucher to said Elisha Peek and Hannah Peck per- sonally and to inform them each at the time that such voucher will be honored by the City comptrol"er anJ Treasurer at Night,. Such voucher is the a7v.1rd to said Peaks in the proceed ings under Condemnation resolution Noel, passed on Apri1.13, 1901, for the appropriation of property of said Pecks for Foote street. Park Superintendant authorized to expend $125.00 for repairs and alterations. President. Retail Clerks Union No. 37 granted permission to hold a social at Howard Park on August 13th and the invitation extended to the Board to attend the same accepted with pleasure. Permission granted to M. E. Church Mission to use Howard Park for a lawn social on August loth, 1901. Clerk instructed to give to August Klettke a deed for Cemetery Lot 37, Block 7, Range 1 East. President. 0 First.hearing on.Vacation Resolution No. 5 passed on July 23, 1901. No remonstra- tors appeared. The Board declare the following property vacated: -"All that part of Baker street which lies east of the east line of College street and running east.ninety one and one fourth(91 1/4) feet from said east line to the west line of a sixteen(16) foot alley on the east side of Lot 40 in College Grove Addition to the City of South Bend, which all- ey the Indiana, Illinois and Iowa Railway Company propose to open". Vacation Resolution is hereby confirmed. The roll of interested property owners, who might have been injurouisly or beneficially affected by the above vacation, being already in the hands of this Board, this board hereby determine the questions of benefits and damages as follows:- The board find that no person has been damaged by the vacation and that the Indiana, Illinois and Iowa Railway has been benefitted by the vacation. But inasmuch as said Railway Company has dedicated a piece of land to the City of South Bend for public use and highway purposes ; the Board find that no assessments for benefits should be made against said RailwaytCom- parry. Said Railway Company have dedicated as heretofore mentioned the following described property:- A perpetual easement over and upon sixteen feet(16) off of the east side of the entire length of Lot Number Forty (40) in College Grove Addition to the City of South Bend for highway porposes for the use of the public generally. Ordered that the request for the opening of said street be referred to the Engineer and that the request for grading be filed for work of 1902. Clerk instructed to notify the L. S. & M. S. R. R. Co. to plank their Leer street crossing. Contract for Napier street water connections awarded to B. Thomas Beardsley, at $15.50 south side and 14.00 north side. Sewer connections to L. H. Webster at $7.00 Clerk instructed to notify the Indiana, Illinois and Iowa R. R. Co. to bring their tracks to the established grade at their Division street crossing. Also to notify, the Lake Shore and Michigan Southern Railway Company to bring their tracks to the est4l ablished grade at Arnold and Division streets* President. Contract signed for Napier street water connections with B. Thomas'Beardsley. Plat of M. L. Wenger's 6th Addition to the City of South Bend approved and copy filed. Contract signed for Napi er street sewer connections with L. H. Webster. Engineer reported grade for alley east of Michigan street from Wayne street to the second alley south of Wayne street. Same approved and filed. Engineer reported drawings and specifications for grading the first alley east of Michigan street from Mayne street to the second alley south of Mayne street. IMPROVEMENT RESOLUTION NO.. 40• Resolved by the Board of Public Works of the City of South Bend,Indiana,:-That an improvement be made of the kind, sixe, location and terminal poinks as follows: GradL- ing the first alley east of Michigan street from Wayne street to the second alley south of Wayne street. Said improvement shall be known and designated as"Michigan street alley" and shall be constructed according to the plAn.s and specifications prepared by the City Civil Engineer, filed herewith. N6tice of this resolution and proposals for bids for the execution of the Above' --work shall be published on the 13 day of August and on the 20 day of August 1901, in the South Bend Daily Tribune and in the South Bend Daily Times. S. and M. S. R. R. Company filed a remonstrance against the amount of its assess- ment on the ground that it was not benefitted in any such amount. No other remonstrators appeared. The Board however find that the assessment against said Company should be con- firmed. The assessment roll, filed on August 3st, 1901, and the final estimate allowed on,August lst are hereby confirmed. - Assessment roll and final estimate hearing for the West Navarre street water connections from Michigan street to Portage Avenue'. No remonstrators appeared. The asses- sment roll, filed on August lst, 1901 and the final. estimate, -allowed on August 1st, 1901 are hereby confirmed. Hearing on the assessment roll and final. es 4-mate- for the Frances street cement work under Improvement Resolution No. 16. No remonstrances were presented against the. amount of assessments but property owners filed a remonstrance against the acceptance of the work on the :ground that the work was defective. The board find the work to be defec- tive, and find that that the final estomate should not be confirmed. The confirmation of both final estimate and assessment roll is therefore postponed until August 27th 1901 at which time such defects shall have been corrected. Hearing on the assessment roll and final estimate for the west Washington stye- street brick pavement improvement. No remonstrators appeared. The assessment roll, filed ' on August 1st, 1901, and the-(finalestimate allowed on August 1st.1901 are hereby confirmed. Hearin; on the assessment roll and final estimate for the Eddy street cement and grading improvement under prior proceedings of the council and proceedings of this board. No remonstrators appeared as to the amount of the assessments but a remonstrance was made against the acceptance of the final estimate on the ground that some of the work was defective. The board find that the work is not satisfactory and that the final estimate and assessment roll should not be confirmed. The confirmation of both final estimate and assessment roll is therefore postponed until August 27th, 1901 at which time such defects shall have been corrected. President. 132 August 152a 1901. Resolved that the office hours of th&s board during which this board will be in session shall be from 10 to 12 A. M. on Mondays, Tuesdays, Thursdays and Fridays. Petition for removal of a tree from the alley between lots 1 and 2 in Weaver's,._ Subdivision was met by a remonstrance. President of the Board reported having examined the matter and having found that the _tree was an ornament to the street and not -wholly . in the alley and of no substantial damage to petitioner. , Ordered that the matter be dropped. Following contracts were signed: L. H. Webster for the Laurel street sewer under Improvement Resolution No. 37. Robert, Hoban and Roach for the east Washington street pipe sewer under Improvement Resolution No. 39, and the east Colfax Avenue pipe sewer; under Improvement Resolution No•38. T. C. Barnes and Son for Wenger street, under Imp!- rovement Resolution No. 41• T. C. Barnes and,Son for Hill street, under Improvement Resolution No. 40. Street Commissioner reported that Poland street from Webster to Union is too high and must be graded upon petition of property owners to put same in good condition Clerk instructed to communicate with Isaac Gorsuch regarding the dedication of the south half of Ford street, and to request that such dedication be made to correspond with the Studebaker dedication. Royal Neighbors granted permission to use Howard Park for a lawn socia , on Wednesday August, 21tt;1901• Street CommissionerIlinstructed to arrange for moving the Regan house out of the way of the excavating for the east abutments of the Sample street bridge. Also instruct- ed to put in two sewer inlets on Chapin street near intersection of Hustonst_reet as loc- ated bt Engineer. President. 133 Contract signed with Ralph Smith for the repair and relettering and repaainting of the bridge signs. Electric midnight light ordered for corner of William and Washington streets. Report of Council commottee on they opening of Marion street referred to Engineer to be turned over to abstractor for dedication deeds. President. PresidLent. 137 Engineer instructed to examine the curbs at Corner of Hill street and Cedar street and ascertain whether the same are at proper grade. City Treasurer instructed to mark paid the assessment against the L. S. & M. S. R. E. Co. on account of the Singer sewer according to contract between the City and said Company signed October 11, 1900 whereby said City agreed to save said Company harmless for all I costs and claims on account 0 f said sewer. The Board find th thatt,the Eddy street work has been put in acceptable condition and as all remonstrances,. as to the work have been withdrawn the assessment roll filed on August lst, 1901 and the final estimate allowed on August lst, 1901 are hereby confirmed. The Board further find that the Frances street work is not yet satisfactory. The confirmation of the assessment roll and final estimate for the Frances street work is postponed until September 3, 1901: Hearing on the assessment rolls and final estimate for the Bartlett street imp'- rovement, under Improvement Resolution No. 25; and for the Howard Avenue imp rovementf under Improvement Resolution No. 21; and for the Dore Avenue sewer, under Improvement Resv- olution No.26 No remonstrators appeared. The assessment rolls, filed on August 13, 1901$ and the final estimates, allowed on August 13, 1901, are hereby confirmed. First hearing on the grading of the first :alley East of Michigan street, under Improvement Resolution No.40. The Engineer filed the estimated cost,$28.00 No remonstrato- rs appeared. The Board find that the benefits, including the benefits: to the City, are equal to the estimated cost of the improvement. Improvement ResolutionlNe.40 is hereby confirmed. President.
