Engineer presented the roll of property owners affected by and interested in the condemnation of property under Condemnation.Resolu.tion No 1, passed April 13, 1901. Same was filed and approved. The board fixed the assessments and awards under such res- olution as follows: Elisha Peck and.Hannah Peek, award,$1200.00 Margaret 0oller, ass- essments- A 25-00 Edward Luther, assessment,$25.00 Clerk instructed to deliver to each person named on said roll a written notice showing the amount of the assessment or award against such person. Such notice shall be delivered personally and in case the person cannot be found the Clerk shall leave a copy of such notice at the -last usual place of residence of such person. Resolved that -on July l6th at 7:15 P.M. this board will give a hearing as to the amount of such awards and assessments. IMPROVEMENT RESOLUTION NO 33. Resolved by the Board of Public Works of the City of South Bend,Indiana That an improvement be made of the kind, sizes location and terminal points as follows: The construction of a sewer on Madison street from a point about 115 feet west of the west line of Lafayette street to the manhole in the Marion street sewer at the intersection of Marion and Madison streets. Said improvement shall be known and designated as'T,,Xddison Street Sewer" and shall be constructed according to the plans and specifications prepared by the City Civil Engineer, filed herewith. Notice of.this resolution and proposals for bids for the execution of the above work shall be published on the 5 day of July and on the 12 day of July 1901, in the South Bend Daily Tribune and in the South Bend Daily Times This Board will give a hearing on this resolution at its office in the City Hall on the 23 day of July 1901, at 7:15 P.M., and w ill receive bids up to 10A.M* on the 30 day of July, 1901. 51.1 Engineer reported specifications for a sewer on Madison street between Lafayet. and Marion streets. President. First hearing on cement sidewalk and curb improvement on Harris Street, under Imp- rovement Resolution No28. The Engineer filed the estimated cost,F68.50 No remonstrators appeared. The Board find that the benefits, including the benefits to the City, are equal to the estimated cost of the improvement. Improvement Resolution No 28 is hereby confirmed. Hearing as -�o the amount of assessments and upon the final estimate for the Ohio street sewer, under Improvement Resolution No 1. No remonstrators appeared. The Muessel Brewing Company presented a remonstrance against the proposed vacation. Same was filed. The board declare the following property vacated: All that part of St. Joseph street lying between the South line of Washington street and the north line of Vistula Avenue, excepting a strip eight and one half(8 1/2) feet wide along the east line of St. Joseph street between said terminal points. Resolved that notices as to the amount of assessments be published in the South Bend Daily Tribune and in the South Bend Daily Times for six successive days beginning on the 9th day of Ju?ly 1901, stating that this board will give a hearing as to the amount of these as-sessments on the ,23rd day of July 1901 at 7:15 P.M. Improvement Resolution No. 30 confirmed. First hearing on the paving of the alley east of Michigan street between Vistula Avenue and Jefferson street, ,under Improvement Resolution No. 29 Remonstrance against above improvement filed by majority of property owners. The Engineer filed the estimated cost, $874.87 The Board find that the benefits, including the benefits to the City, are not equal to the estimated cost of the improvement. Improvement Resolution No. 29 is here— by rescinded. First hearing on the improvement of west Division street, under Improvement Resolution No. 31 Remonstrance was filed against the improvement. The engineer filed the estimated cost, $2460.00 The board find that the above Improvement Resolution should be modified as follows: The construction of cement curbing on west Division street from the west line of Laurel street to the east line of Olive street. As modified such Improvement Resolution is hereby confirmed. As modified the board find that the benefits, including the benefits to the City will be equal to the estimated cost of the improvement. Hearing as to the amount of assessments and upon the final estimate for the Saint Peter sewer, under Improvement Resolution No. 19.-No remonstrators appeared. The assessment roll, filed on July 9th and the final estimate, allowed on July Oth, are hereby confirmed. Nearing as to the amount of awards and assessments under Condemnation Resolution No. 1, passed on April 1311 1901. Elisha Peck and Hannah Peck and their attorney appeared. Margaret Goller and Edward Luther also appeared, all parties remonstrated against their respective assessments and awards.
