St. Louis Blvd. South Bend, IN 46617 RE: Encroachment into Public Right -of -Way — Class Reunion Sculpture Dear Ms. Roush: The Board of Public Works, at its meeting held on February 11, 2020, approved your request for the installation of three (3) trees, a shovel handle sculpture, and rock for the Notre Dame Class of 1970 at the northeast corner of W. Angela Blvd. and Riverside Dr. This encroachment was approved subject to the improvements not becoming a safety hazard. Enclosed please find a copy of the permit. The encroachment will be permitted to remain and continue until such time as the Board of Public Works of the City of South Bend shall determine that such encroachment is in any way impairing or interfering with the highway or with the free and safe flow of traffic thereon. Said encroachment shall not in any way prejudice or preclude the City's rights with respect to the future use of that portion of the right-of-way. It is the intent of the parties hereto that the APPLICANT shall indemnify the CITY under this indemnification clause to the fullest extent permitted by law, except that APPLICANT shall not indemnify CITY for any damage or expense caused by the sole negligence of the CITY. The area is clear of any obstructions. The area is about .10 of an acre (4,715 square feet). Art installation The concept of the art installation is to create a space that acknowledges the importance of gatherings (reunions) in a setting of nature to allow for personal reflection and for enjoyment of the environment. The proposed name of the plot is Reunion Park and the theme is "Rock, Paper, Shovel", and the theme connotes a place for playfulness. Concept of the Park The shape of the park is bounded by a walking path in the shape of a bow adjacent to the round -about symbolizing a shield. Both symbols recognize the presence of archetypes of Native Americans who once occupied the river banks of the St. Joseph River. The celebration of human interaction in work (shovel), play (tip of the shovel is notched like an arrow) and solitary reflection (alignment of the symbols) are captured in the simplicity of the art arrangement. Description of the installation 1. Sculpture. Near the center point of the arc, a sculpture of a shovel handle will be embedded in a concrete pad. The handle of the shovel has dual meanings. The shovel is playful indicating that there was work completed in planting and tending to the park. The handle also symbolized the shaft of an arrow pointing in the direction of the trees and the rock on the promontory of the plot. The notch on the top of the shovel handle is aligned to show the importance of balance and direction of purpose. The shovel handle is mounted into the cement via a chain link fence mount, and it symbolizes combining language of connection and with continuity (functionally allowing repairs). 2. Plaque will be placed near the embedded shovel handle (see diagram 2 for placement). The plaque will read Reunion Park "Rock, Paper, Shovel" Notre Dame Class of 1970 The theme of "Rock, Paper, Shovel' is a play on the game of "rock, paper, scissors" to convey that the park is for the dual purpose of playtime and reflective time at a gathering place. The plaque placed so as to intrigue the passing visitor to stop and wonder about the messages being conveyed by art in the park. Presentation on the art installation at Riverside and W. Three trees will be spaced to represent the feathers on the shaft of the arrow (Diagram #1) * 1 The trees represent feathers on an arrow as archetypes of strength and purpose guiding the lives of past, present and future students of Notre Dame and those who visit Reunion Park. The proposed trees are Black Gum and each is approximately 2.5 inches in diameter. These trees will display striking colors in the fall. The placement of the trees are important in the overall geometric design of the installation. 4. Rock (indicated by a rectangle on point #5) symbolizes the tip of the arrow The rock is head -shaped (in reference to thinking) and allows up to three visitors to sit together. It's placement will be on the point of the promontory overlooking the St. Joseph River. The rock will be in line with tree (#1), the shaft of the shovel handle, and the center of the round -about. The line of sight from the tip of the shovel handle to the rock is pointing to the Golden Dome on the ND campus. 5. Linear relationship (Diagram #2) A viewer's eye is guided from the tip of the shovel handle to the tree #1 to the rock (5) to the unseen Golden Dome (#6) on the campus of Notre Dame as illustrated in the diagram. 6 5 1.
