AMENDMENT TO OWNER -ENGINEER AGREEMENT Amendment No. 1 1. Background Data: a. Effective Date of Owner -Engineer Agreement: _November 27, 2018 b. Owner: Citv of South bend Board of Public Works C. Engineer: DLZ Indiana, LLC d. Project: Washin on Street Im rovement Project 118-105 2. Description of Modifications: a. The Scope of Services currently authorized to be performed by Engineer in accordance with the Agreement and previous amendments, if any, is modified as follows: 1) Add Sub -Section B.i.a.15) and B.1.a.16) to Section A1.01 of Exhibit A as follows: 15. The Engineer shall relocate the curb line in the southeast quadrant of the intersection of Washington Street and Chapin Street to provide a tree lawn and improve Intersection Sight Distance. The changes in this quadrant of the intersection will extend the project limits along Chapin Street approximately 110 feet, and will result in additional changes to the existing drainage structures. 16. The Engineer shall re -align the north approach of LaPorte Avenue to Washington Street, which will result in additional geometric design and impacts to existing drainage structures. 2) Add Sub -Section 13.2. B.3. and BA. to Section A1.01 of Exhibit A as follows: 2, Develop Parking Options The Engineer shall perform the following scope of services for up to 4 conceptual parking options for the north side of Washington Street between LaPorte Avenue and Chapin Street: 1) Develop the options for parking along the north side of Washington Street based on potential drive closures and spacing of parking spaces, 2) Develop Exhibits to submit to the Owner for review, 3) Revise and re -submit per Owner review comments. Truck Turning Evalution The Engineer shall perform the following scope of services to develop and evaluate turning templates for both trucks and busses in each of the four quadrants of the Washington/Chapin Intersection and for a pick-up truck exiting the private drive in the northeast quadrant of the intersection: 1) Layout the turning templates in each quadrant, 2) Evaluate the impacts to the existing intersection geometrics, 3) Develop Exhibits showing the turning templates for Owner review. 4. Meeting Exhibits The Engineer shall perform the following scope of services to develop 2 colored Exhibits of two options for constructing the north side of Washington Street between LaPorte Avenue and Chapin Street to present at a neighborhood meeting: 1) Develop the options, 2) Render the options and submit to the Owner for review, 3) Revise per Owner comment and resubmit. 3) Add Stab -Section. F. to Section A1.01 of Exhibit A as follows: F, The Engineer shall perform the following scope of services for Bidding, Preconstruction and Construction Phase Services, as directed by the Owner: 1. After acceptance by Owner of the bidding documents and the most recent opinion of probable Construction Cost as determined in the Final Design Phase, and upon written authorization by Owner to proceed, Engineer shall: a. Issue addenda as appropriate to clarify, correct, or change the bidding documents. b. Provide information or assistance needed by Owner in the course of any negotiations with prospective Contractors. c. Consult with Owner as to the acceptability of subcontractors, suppliers, and other individuals and entities proposed by prospective contractors for those portions of the Work as to which such acceptability is required by the bidding documents. d. If bidding documents require, the Engineer shall evaluate and determine the acceptability of "or equals" and substitute materials and equipment proposed by bidders, but subject to the provisions of paragraph A2.02.A.2 of this Exhibit A. e. Attend the Bid opening, prepare Bid tabulation sheets, and submit to the Owner. f. The Bidding or Negotiating Phase will be considered complete upon commencement of the Construction Phase or upon cessation of negotiations with prospective contractors. 2. Upon successful completion of the Bidding and Negotiating Phase, and upon written authorization from Owner, Engineer shall: a. Participate in a Pre -Construction Conference prior to commencement of Work at the Site. Review and approve or take other appropriate action in respect to Shop Drawings and Samples and other data which Contractor is required to submit, but only for conformance with the information given in the Contract Documents and compatibility with the design concept of the completed Project as a functioning whole as indicated by the Contract Documents. Such reviews and approvals or other action will not extend to means, methods, techniques, sequences, or procedures of construction or to safety precautions and programs incident thereto. c. Evaluate and determine the acceptability of substitute or "or -equal" materials and equipment proposed by Contractor, but subject to the provisions of Paragraph A2.02.A.2 of this Exhibit A. d. Perform or provide the following additional Construction Phase tasks or deliverables: i. The Engineer will provide design support to the Owner's Resident Project Engineer, as required and as directed by the Owner. The Engineer will meet at the project site with the Owner or their Resident Project Engineer, as directed by the Owner, to assist in any matter that may arise during the construction of the project. Limitation of Responsibilities: Engineer shall not be responsible for the acts or omissions of any Contractor, Subcontractor or Supplier, or other individuals or entities performing or furnishing any of the Work, for safety or security at the Site, or for safety precautions and programs incident to Contractor's Work, during the Construction Phase or otherwise. Engineer shall not be responsible for the failure of any Contractor to perform or furnish the Work in accordance with the Contract Documents.
