Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: LEGAL DESCRIPTION The East 44.00 ft. of Lot 3 as shown on the recorded plat of "CITY SUBDIVISION OF THE EAST HALF OF LOT 23 OF DENNISTON AND FELLOWS ADDITION", as recorded in Book 4, on Page 4 in the Office of the Recorder of St. Joseph County, Indiana. be and the same is hereby established as; B-RESIDENTIAL E-HEIGHT AND AREA. South St. South Bend, IN 46601 3) Name and address of contingent purchaser(s) , if applicable: N/A 4) It is desired and requested that this property be rezoned from C - Commercial , Height & Area to B - Residential , E Height & Area 5) This rezoning is requested to allow the following use(s) : Construction of a single family house. 6) Attached is a copy of (a) legal description of the property; (b) a list of names and addresses of all property owners within 300 feet of the petition property; (c) five (5) site plans; and (d) addressed, stamped envelopes for all property owners within 300 feet of the petition property. 7) By signing this petition, I and any contingent purchaser understand that if the Council approves this petition to rezone, it may be approved subject to the submittal of a final site plan. A final site plan must be submitted to the Area Plan Commission within one (1) year of the Council's action. Failure to submit a final site plan within that time period, causes the zoning of the petitioned property to revert to the initial zoning classification. The Area Plan Commission at its public hearing on August 16, 1994, took the following action: Upon a motion by Bruce Huntington, being seconded by Lee Slavinskas and unanimously carried, the proposed ordinance and site development plan of Habitat for Humanity to zone from "C" Commercial, "E" Height and Area to "B" Residential, "E" Height and Area, property located at 410 South Street, City of South Bend, is sent to the Common Council with a favorable recommendation as tendered. Most of the surrounding area is zoned residentially. The proposed rezoning is in keeping with the surrounding area. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. EXISTING LAND USE: The property is currently vacant. SURROUNDING LAND USE AND ZONING: Located to the north are apartments zoned "B" Residential; to the east and south are residences and vacant lots zoned "B" Residential; and to the west is a commercial structure zoned "C" Commercial. ACCESS: Access to the site is from South Street. WATER SOURCE/SEWAGE DISPOSAL: Water and sewer area-available to the site. DRAINAGE: SITE DATA: The total site to be rezoned is 4,374 square feet. ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no public wells, wetlands, flood or environmental hazard areas are present. SITE PLAN: The site plan is final. Our support for this proposed rezoning is with the following conditions: • The proposed house to be located at this site shall be a two-story house, thus matching the existing houses along this street. • The house must include the architectural elements that are found on the existing houses that make up this neighborhood -- this would include: window/door trim, a steeply pitched roof(6/12 at minimum), standard window fenestration, colors, narrow sided clapboards (wood or vinyl), appropriate porch design, etc. We look forward to working with Habitat for Humanity in this neighborhood and welcome the most recent houses that were built over the past week.
