AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING THE SALE OF PARK PROPERTY STATEMENT OF PURPOSE AND INTENT The City of South Bend, Indiana, for the use and benefit of its Park Department and/or Board of Park Commissioners (hereinafter, the "Park Department") owns certain real property located at Elbel Golf Course, and being more particularly described at Exhibit "A" hereto, (hereinafter, the "Real Property") . Pursuant to I .C. 36-10-4-9 (a) , said lands are under the exclusive control of the Board of Park Commissioners of the Park District of the City of South Bend (hereinafter, the "Park Board") . The Real Property is vacant land, adjacent to the property that formerly served as housing for the Elbel Golf Course golf professional . The Real Property is no longer needed for park purpose. At its meeting of April 18, 1994, the Park Board determined that the Real Property is not required for park purposes and authorized the sale of the Real Property upon the following conditions : A. That the Real Property be sold at a price not less than its appraised fair market value. B. That all proceeds of the sale of the Real Property be returned to the Park Board and used for park purposes . By Ordinance No. 8498-94, the Common Council approved the sale of the Real Property. Pursuant to I .C. 36-1-11, the Board of Public Works for the City of South Bend conducted a public sale of the Real Property and recommended acceptance of the bid of William J. Krizman. Said recommendation has been approved by the Mayor. Pursuant to I .C. 36-11-1-3, Common Council approval of the Sale of the Real Property is required. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS : Section I . The sale of the Real Property to William J. Krizman for the sum of $20, 000 and in accordance with the terms of the offering, is approved, subject to the following conditions : A. That no environmental testing will be performed or paid for by the City and that the Real Property will be sold as is . B.
