St. Vincent St . from the east right-of-way line of N. Georgiana St. for a distance of approximately 248 feet and a width of approximately 12 feet. Part situated in Hartman and Miller' s Plat in the city of South Bend, Indiana. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12 , the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I . The common Council of the City of South Bend having held a public hearing on the petition to vacate the following property hereby determines that it is desirable to vacate said property. The alley to be vacated is described as the first east-west alley north of E. St. Vincent St . from the east right-of-way line of N. Georgiana St. for a distance of approximately 248 feet and a width of approximately 12 feet. Part situated in Hartman and Miller' s Plat in the city of South Bend, Indiana . SECTION II . The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of gas, water, sewer, surface water control structures and ditches, within thp_ vagated right-of-way, unless such rights are released by the i aividuai utilities . a SECTION III . The following property may be injuriously or beneficially affected by such vacating: Lots : 22, 23, 24, 25, 26, 27, 28, 29, 35, 36, 37, 69, 70, 71 , 72 . SECTION IV. The purpose of the vacation of the real property is to: 1 . Stop cars from speeding down the alley. 2 . Stop fires, dumping, and parking in the alley. 3. Stop an access route for drug dealers on Georgiana St. 4. Stop open urination in the alley. 5. Stop the dumping of stolen cars . Create a safer environment for my child and family. SECTION V.
