Also a eastwest alley bounded by Main Street on the west and Michigan Street on the east; part situated in Martin and Tutt Addition to the City of South Bend, Indiana STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-12,the Common Council is charged with the authority to hear all petitions to vacate public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: The first east-west alley north of W. Bronson St. from the east right-of-way line of S. Main St. to the west right-of-way line of S. Michigan St. for a distance of approximately 342 feet and a width of approximately 14 feet. Also,the first north-south alley east of S. Main St. from the south right-of-way line of W. South St. to the north right-of-way of the Penn Central Railroad. Part Situated in Martin and Tutt Addition to the City of South Bend, Indiana. hereby determines that it is desirable to vacate said property. SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of south Bend,Indiana to construct and maintain any facilities, including,but not limited to,the following: electric,telephone, gas,water, sewer, surface water control structures and ditches, within the vacated right-of-way, unless such rights are released by the individual utilities. SECTION III. The following property may be injuriously or beneficially affected by such vacating: Lots 1 through 15,20 through 23, Martin& Tutt Addition; Tract 1, Studebaker Corp. Replat; Lots 2, 3, 4 and 5,Bronson Survey Lot 36, Samuel Martins Addition Lot 24, Martins Addition SECTION IV. The purpose of the vacation of the real property is to: Construct Transpo Bus Terminal(Relocation from Downtown site) SECTION V. Also a eastwest alley bounded by Main Street on the west and Michigan Street on the east; part situated in Martin and Tutt Addition to the City of South Bend, Indiana - For your information, the Board of Public Works received favorable recommendations from the Department of Economic Development, Department of Sanitation, City Attorney's Office, Fire Department, Police Department, Division of Engineering and the Area Plan Commission concerning this vacation. Copies of the recommendations received from these departments are attached for your review. Therefore, the Board submits to you a favorable recommendation concerning this vacation.
