GAMMON Approved and signed by me is) �`` - Mayor ORDINANCE NO. g-566-9(/ AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 6 OF THE SOUTH BEND MUNICIPAL CODE ENTITLED "BUILDING' STATEMENT OF PURPOSE AND INTENT The City of South Bend has endeavored to promote the health, safety and general welfare of the City through permits, inspections, and licensing, and the City of South Bend has determined that the amending the permits, inspections, and licensing would be a benefit to the citizens of the City. NOW, THEREFORE, be it ordained by the Common Council of the City of South Bend, Indiana, as follows: Section 1: That Section 6-10(c) of Article 4, Plumbing Code, be amended as follows: (c) Schedule of permit fees. Permits issued for plumbing work within the City shall be subject to the following fee schedule: -Each-plumbing-fixture-or-trap-or-wet-ef-fixtures-on- one-(1)-trap;-ineiading-Mater;-drainage-piping- and-backf1ow-protection-therefor $-4.00 Each plumbing fixture or trap or set of fixtures on one trap, including water and drainage piping therefor $ 4.00 Each backflow protection 5.00 --Each-building-sewer 3:9e Each building sewer: Under 100' $10.00 100' or over 20.00 Each building water: Under 100' $10.00 100' or over 20.00 Each water softener 6.00 Each trailer park sewer 9.00 Each drain within building for rainwater systems 4.00 Each water heater and/or vent 6.00 Each gas piping system of 1 to 4 outlets 3.00 Each gas piping system of 5 or more, per outlet 1.00 Each industrial waste pretreatment interception, including its trap and vent, excepting kitchen-type grease interceptors functioning as fixture traps 7.00 Installation, alteration or repair of water piping and/or water treating equipment 5.00 Page 2 Repair or alteration of drainage or vent piping 5.00 Each lawn sprinkler system on any one (1) meter, including backflow protection devices thereof 5.00 Fire protection sprinkler system: 8-to-30-heads /6:88 ----30-to-58-heads 31.88 Greater-than-50-heads 44.00 Up to 30 heads $20.00 Plus each additional 10 heads thereafter up to 500. . 5.00 Plus each additional 50 heads over 500 5.00 Gas tanks and pumps 10.00 Each re-inspection 25.00 Each additional final inspection 50.00 That Section 6-10(d)(1)(e) be amended as follows: (d) Registration and permits for plumbing services. (1) Definitions. As used in this subsection, the following words shall have the following meanings: e. Plumbing contractor: A person who holds an Indiana license and who, for compensation, undertakes to or submits a bid to themselves or does himself or by others perform plumbing services and who is responsible for substantially all of the plumbing services within the entire project, or one who fabricates units of plumbing substantially completed and ready for installation. That Section 6-10(d)(2) be amended as follows: (2) Registration required: a. All persons performing plumbing services within the City shall be a plumbing contractor and shall register with the Department; provided, however, that the owner-occupant of a dwelling shall not be required to register when he or she is installing altering or repairing the plumbing of that dwelling. b. Registration shall be on forms provided by the Department and shall be accompanied by payment of a registration fee, as follows: Excavators sie ee Fire-Protection-Sprinkler-contractors /8:88 Sewer-cleaners 18780 Water-softener-dealer le ee Plumbing Contractors $25.00 Excavators (as defined in Sec. 6.10(d)(1)(b) 25.00 Sewer Cleaners 25.00 Page 3 c. Registrations shall be for a term of one (1) year beginning from the date of issuance. d. Lawn sprinkler contractors, water softener contractors, and fire protection sprinkler contractors shall comply with Article 11, Building Contractor Licensing Requirements. That Section 6-10 (3) (e) be amended as follows: (3) Permits required: e. All plumbing installations requiring a permit shall be inspected by the plumbing inspector three (3) times, once each for underground work, rough-on work, and final completion. A complete line test shall also be supervised by the plumbing inspector. The plumbing permit holder shall notify the plumbing inspector at least twenty-four (24) hours in advance of the time the work is ready for inspection. If the work does not pass inspection, a reinspection fee twenty-five dollars ($25.00) of ten-dollars-019:90) shall be charged for each future inspection of that stage of work. Section 2: That Article 6, Electrical Code, amended as follows: All references in this article to "he" or "his" be amended to read "he/she" and "his/her". That Section 6-19(c) be deleted in its entirety. That Section 6-22(b) be amended as follows: Section 6-22 . Electrical Examining Board (b) The Board shall consist of five (5) members to be appointed by the Mayor, as follows: Two (2) Class A Electrical Contractors, one (1) electrical engineer registered in the State of Indiana, one (1) representative from a public utility providing electricity to St . Joseph County, and the Etty Electrical Inspector. Members shall serve for terms of four (4) years, and shall hold office at the pleasure of the Mayor. Each member shall receive ten dollars ($10 . 00) for each meeting of the Board he attends, except for the Electrical Inspector, ' who shall serve without pay. That Section 6-23(a) be amended as follows: Section 6-23 . Electrical licenses. (a) Required. No person shall perform or cause to be performed any installation, maintenance, alteration or repair of any electrical Page 4 equipment within the City without obtaining in advance a license from Building Department. the eontroller- That Section 6-23(c)(4) be amended as follows: (4) Payment of a fifty-dollar ($50.00) examination fee. f4}--Payment-of-a-forty-dollar-f$48-88}-examination-fee.- That Section 6-23(d) be amended as follows: (d) Examination. To qualify for a new license, an applicant must pass a written examination to be given by the Board or an accepted earn-a-score-of-not-leas-than-seventy-fine-f?5}-percent-correct-on-a professional testing company or organization. written-examination-to-be-given-by-the-Board.- The examination shall consist of not less than twenty-five (25) questions testing the applicant' knowledge of the Indiana Electrical Code and the provisions of this article covering the areas of electrical work involved in the license applied for. The Department shall keep a complete record of each examination for three (3) years after the examination. An applicant who fails to pass an examination may be reexamined not earlier than the next scheduled examination upon submitting a new application in compliance with this article. An applicant who passes the examination shall not be required to retake the examination to obtain a license renewal , if he meets the renewal requirements of subsection (h) (2) below. That Section 6-23(e) be amended as follows: (e) Surety bond. Each applicant for a Class A. license must also provide a surety bond, payable to the City in the penal sum of five thousand dollars ($5,000 .00) , subject-to-the-approval-of-the controller and conditioned upon faithful compliance with the provisions of the building code as it pertains to the regulation of electrical work and apparatus and agreeing to pay all damages, costs and expenses caused by the negligence of the licensee through failure to comply with such provisions . That Section 6-23(f)(1) be amended as follows: (f) Issuance of certificate: (1) The Board shall examine the application, the accompanying documentation and other information provided, examination Building Department results, and shall recommend to the controller the granting or denying of the license applied for. Appeal from the denial , suspension or revocation of any license by the Board shall be made according to the procedures in section 4-16 of the Municipal Code. Page 5 That Section 6-23(f) (2) be amended as follows: Building Department (2) The Controller shall issue a license to any applicant approved by the Board, who has complied with all requirements of the application, including but not limited to the filing of a bond and payment of the prescribed license fee. That Section 6-23(i) be amended as follows: fii--bieense-feesi ----fI3--class-Ai New $1e87ee Renewal 25 .88 ----f23--Class-Bt New $5e-ee Renewal 15-ee (i) License fees: (1) Class A: New $100 .00 Renewal 75.00 (2) Class B: New and Renewal $ 75 .00 That Section 6-23(j) be added as follows: ( 1) Inactive Licenses: A. Any electrician previously holding a Class A license and is presently employed by a government agency as an inspector within a building department may maintain an inactive license. B. Term: The term of an inactive license under this article is from the date of issuance of the license and for twelve (12) months thereafter. C. License Fees: A. $25.00 That Section 6-25(a) be amended as follows: (a) All electrical wiring and equipment installations and alterations requiring a permit shall be inspected by the Electrical Inspector. The permit holder shall notify the Electrical Inspector at least twenty-four (24) hours in advance of the time the work is ready for inspection. If the work does not pass inspection, a reinspection twenty-five dollars ($25 .00) fee of ten-dollars-f$3e ee shall be charged for each future inspection of that stage of work. Page 6 SECTION 3: That Article 7, Mechanical Code, by amended as follows: All references to "he" or "his" in this chapter be amended to read "he/she" and "his/her" . That Section 6-36. 2(a) be amended as follows: Sec. 6-36.2. Heating, air conditioning and ventilating licenses. (a) Required. No person shall perform or cause to be performed within the City any installation, maintenance, alteration or repair of any heating, air conditioning or ventilating equipment or system Building Department . without obtaining, in advance, a license from the Controller:. That Section 6-36. 2(b) (6) be amended as follows (6) Payment of a fifty-dollar ($50 .00) examination fee. f6i--Payment-of-a-forty-dollar-($46700)-examination-fee7 That Section 6-36. 2(c) and 6.36. 2(d) be amended as follows : (c) Examination. An applicant who fails to pass an examination may be reexamined upon submitting a new application in compliance with this article. An applicant who passes the examination shall not be required to retake the examination to obtain a license renewal , if he meets the renewal requirements of subsection (g) (2) below. No license under this article is required for the sale, installation, use, maintenance, alteration or repair of window air conditioning units of two (2) horsepower or less or of electric baseboard cable or panel heating units . 2 . The performance of heating, air conditioning, and ventilating systems in a single family dwelling by the owner-occupant of the dwelling; provided, however, that this exemption does not apply to any person hired by the owner-occupant for compensation to assist or to perform such heating, air conditioning, and ventilating work on that dwelling. fi)--Bieense-Feesi- New $ ee ee Renewal 25..00 (i) License Fees : New $100 .00 Renewal 75.00 ( 1) Inactive Licenses : A. Each application for a permit for installation of heating, ventilating, air conditioning, and refrigeration equipment or systems shall be accompanied by fees in accordance with the schedule below. When the total capacity of any system in any single installation is provided by more than one (1) unit , the sum of the capacities of each unit and the total number of such units shall determine the fee. South Bend, Indiana 46601 RE: Proposed Ordinance Amending Chapter 6 Dear Sirs : Attached is an ordinance we are proposing to amend Chapter 6 of the South Bend Municipal Code. The major changes are as follows : First, we are trying unify the licensing fees with our present contractor registration fees. Second, we are proposing to register plumbing contractors. The purpose of this request is so we are more capable of monitoring the existing State licenses and to provide a list of contractors doing work in our area so we may notify them of any changes in procedures or policies in our Department . We are also trying to clean up some of the permit fees to keep them in line with the cost of the inspections and to unify them with other fees in their categories .
