OLD BUSINESS a. reement between redevelopers and the Redevelopment Commission egarding the purchase of project land. This item was on the Agenda f September 16, 1977, and it was carried over to this meeting. The hair directed this item be placed on the Agenda for the ctober 21, 1977, meeting. 3 South Ben Regular M Redevelopment Commission ting - October 7, 1977 6. NEW BIUSINESS a. Mr. Brownell described Change Order #1 to Contract No. SECD2 /PR /CS -6/45 with Slatile Roofing & Sheet Metal Co., Inc. for an increase in contract price of $250.00 (for an amended contract total.of $7,300.00). The c anae order called for an addition of three rear steps. Mr. Kenneth S hailer explained that the present steps were wood, and the bottom step is falling off creating a safety hazard for the occupants. Mr. Robinson asked how the top two steps were. Mr. Schaller said that the stringer on the side was also worn. Mr. Robinson asked when it was inspected from the time of inspection and that this should be corrected. Mr. Schaller said that it was in November 1976. Mr. Robinson asked if it was proposed to place pre -cast concrete for the steps, upon which Mr. Schaller replied "yes ". Mr. Robinson moved approval, seconded by Mr. Donaldson, and carried. b. Mr. Brownell described Change Order #2 to Contract No. SECD2 /PR /CS -7/54 with Slatile Roofina & Sheet Metal Co., for an increase in contract price of $375.00 (for an amended contract total of $5,075.00). This change order called for repairing cracks in the walls of a bedroom and to paint the walls and ceilings two coats. Mr. Robinson asked if this was another chance order that was inspected in 1976, upon which Mr. Johnson replied, "Yes, this was in the original contract, which we had to rescind." Mr. Robinson asked: "Why weren't the inspections up to date since it coincided with construction? It seems as though no i provements have been made." Mr. Keith Cri.ghton said: "The change order problem is a necessity of rehabilitation no matter what type of program you have. There is no way around this, we are not dealing with new onstruction, we are not dealing with industrial, commercial work; we are dealing with homes and the people within them. It would be nice if I had the manpower to do inspections for a week or two weeks before they were advertised, but it is physically impossible. The fact is, I lost three employees this year. It is very difficult for us to help over 400 families a year with an inspection team of one or two in the field and try to do progress inspection, and a final inspection preparing specifications all in time. The change orders are an absolute inevitability in the program, in fact, there is no way around it." Mr. Robinson stated that he was contesting the fact that at one time the Commission was told that with the new innovation and the new ideas that were going to proceed, that we are not going to have any more problems. Mr. Crichton went on to say, "This year we have had, in terms, a number of change orders increasing in contract costs. We have had only 24, and this is out of a total of 00 contracts; I don't think that is too bad, do you ?" "Not in the ace of it, no ", replied Mr. Robinson. Mr. Wiggins moved approval, seconded by Mr. Donaldson and carried. 4 South Bend Redevelopment Commission Regular Meeting - October 7, 1977 6. NEW BUSINESS (CONT'D c. Mr. Brownell described Change Order #2 to Contract No. CS -3/10 with Plaia Construction Company, for an increase in contract price of $715.00 (for an amended contract total of $55,638.00). Change Order calls for installation of ceiling tile in the kitchen, 144 sq. ft. or $350.00. On the rear porch, installation of 3 risers, three cast steps, including 3 ft. metal handrail and replace the block support post footings ($421.00); for a total of $771.00 addition. There is also deletion of $56.00 for painting of the kitchen ceiling, for a net change order of $715.00. Mr. Wiggins asked if the leak occurred after he new bathtub was installed? Mr. Johnson replied, "no, the plumber had previously prepared the necessary drain under the tub to stop the leak." At this time Mr. Crighton spoke, "the reason for these many change orders is because the bidding procedure was changed. At times we were lucky to get six or seven a month awarded, and we had over eighty awarded in three months; that makes a rather substantial difference in he number of contracts that we are handling on a day to day basis. Our volume has increased, more than tripled." Mr. Wiggins moved approval, seconded by Mr. Donaldson, and carried. d. Mr. Brownell described Change Order #2 to Contract #CS -3/10 with tickler Plumbing for an increase in contract price of $115.00 (for an amended contract of $9,127.00). The change order asked for replacement of a water closet. Mr. Robinson moved approval, seconded by Mr. Wiggins, and carried. e. Mr. Brownell described Change Order #1 to Contract #NECD /2, with Owens Heating Company, for an increase in contract price of $100.00 (for an mended contract total of $8,800.00). This change order asked for I substitution of an oil furnace to replace a gas furnace at a cost f an additional $100.00, due to the fact that a gas furnace cannot be nstalled without the insulation. Mr. Wiggins moved approval, seconded v Mr. Cira and carried. f. Mr. Brownell described Change Order #1 to Contract #NECD /PR /CS -2/15, with Owens Heating Company, for an increase in contract price of $100.00 (for an amended contract total of $6,346.80). An oil furnace was to replace as furnace (as mentioned in 6.e. above). Mr. Robinson moved approval, seconded by Mr. Wiggins and carried. Ir. Brownell described Change Order #NECD /3B, with R. A. Stickler Plumbing, 'or an increase in contract price of $177.00 (for an amended contract total of $5,637.00). The change order is for removal of subfloor under :he bathtub and around the water closet. This will cost $89.00 and the iew soil line will cost $88.00, a combined total of $177.00. Mr. Wiggins loved approval, seconded by Mr. Robinson and carried. 5 South Be Regular Redevelopment Commission ting - October 7, 1977 6. NEW BUSINESS (CONT`D h. Pr. Brownell described Change Order #1 to Contract #NECD /3B, with F. A.Stickler Plumbing for an increase in contract price of $48.00 (for an amended contract total of $3,371.00). Change order called for replacement of tank fixtures in water closet. Mr. Robinson moved approval, seconded by Mr. Wiggins, and carried. i. Mr. Brownell described Change Order #1 to Contract #NECD /3B, with F. A. Stickler Plumbing, for an increase in contract price of $360.00. he change order called for removal of the subfloor and replacement of lead lines, and installation of water closet and lavoratory; it was iscovered there were lead drain lines. The subfloor would cost 30.00, to clean the main sewer would cost $50.00, to remove all lead drain lines would cost $35.00, to replace the drain lines would cost $135.00, replace subfloor $80.00, and to replace water closet and lavoratory cost $30.00, for a grand total of $360.00. Mr. Robinson uestioned the subfloor. "The removal cost $30.00, and to replace it cost $80.00, does this include new plywood ?" Mr. Richard E. Pfeifer xplained that this was a new subfloor they would be installing. Mr. Donaldson moved approval, seconded by Mr. Wiggins and carried. j. Mr. Brownell described Change Order #1 to Contract #NECD /3B, with R. A. Stickler Plumbing, for an increase in contract price of $27.00 (for an amended contract total of $4,243.00). Change order called for eseating of a water closet which is leaking. Mr. Donaldson moved approval, seconded by Mr. Robinson, and carried. k. Mr. Brownell described Change Order #1 to Contract #NWCD /3B, with F. A. Stickler Plumbing, for an increase in contract price of $63.00 (for an amended contract total of $6,471.00). The subfloor had rotted under the water closet and it needed replaced at a cost of $63.00. Mr. Wiggins moved approval, seconded by Mr. Robinson, and carried. 1. Mr. Brownell described Change Order #1 to Contract #NWCD /3B, with Brittain Construction Company, for an increase in contract price of $703.00 (for an amended contract total of $6,408.00). Change order calls for hauling four yards of dirt for grade, a tuck point of 100 1 vial feet of foundation, installation of galvanized window, and twelve square feet of walkway, and installation of ten feet of ten inch chimney flue. Mr. Robinson questioned the original bid. "What are these contractors responsible for? If he is going to bid on a job, he should know what he is bidding on. It is his business to know what he is bidding on. I can approve part of this change order, the rest I cannot. It is the responsibility of the contractor to know what he is buying and if h can't do it, he shouldn't be saying anything." Mr. Brownell read he letter from Mr. Richard E. Pfeifer: The specification called for he removal of two 30 x 7 ft. exterior porches and the installation of 9 South Beno Redevelopment Commission Regular Meting - October 7, 1977 6. NEW BOSINESS (CONT'D t ree steps. Upon removal of the porches, it was detected that the g ade was four to eight inches lower. The unexposed foundation needed t ck pointing, and there is a basement window on grade that required a w ndow well, and 12 sq. ft. of walkway is needed to compensate the d stance of the old porch and new steps. It was also detected that ten feet of the 10 in. chimney flue must be installed due to the condition of the breaks of the unexposed portion of the chimney. M . Brownell explained that part of it they weren't aware of. M . Robinson gai'd that he could understand the tuck pointing, the basement window, and the other things, what he couldn't understand was the four y rds of dirt and all the other things. "The contractor should have realized this when he put in his bid, this is what I am debating; and I don't feel we should allow that portion of it." Mr. Nimtz said - he specifications may have called for the installation of the walkway, I presume that if they were going to take off the porch, they should have realized the walkway was to be in there. As to the grade, I do not know, if you can't see it, and if you don't look under there, you d n't know what the grade is, but the specifications should have called f )r the walkway, that I will agree on. Mr. Wiggins mentioned that the oily real contention was the hauling of four yards of grading. He agreed with Mr. Robinson on his points of view. Mr. Davis made this p int to Mr. Nimtz, "Of course you realize, if they don't haul the black dirt in, that there will be water standing around the house, which is eventually going to fall apart." Mr. Robinson felt that everytime a contractor finds something wrong, they come back to the Commission f r some more money, and I feel it is ridiculous. Mr. Wiggins moved a proval for $558.00 (with the exception of the hauling of the dirt), s conded by Mr. Cira, and carried. m. M-. Brownell described Change Order #1 to Contract #NWCD /3B with B ittain's Construction Company, for an increase in contract price of $ 20.00 (for an amended contract total of $3,323.00). Mr. Richard E. Pfeifer explained that the doors were detected, but due to high bids t ey were cut off. The doors are now in bad shape, and the people d nit have any way of locking the doors. Mr. Wiggins moved approval, s conded by Mr. Donaldson, and carried. n. C mmission approval was requested for the following contracts (including acknowledgement of bid amendment to contract #3). Stickler Plumbing $ 3,855.00 $ 3,398.00 A bid homes Mr. W amendment was made because of a deceased owner of one of the (Located at 1143 South Bend Avenue, South Bend, Indiana), being contracted. ggins moved approval, seconded by Mr. Cira, and carried. 7 South Bond Redevelopment Commission Regular Meeting - October 7, 1977 Mr. Nim z took a moment to explain that this was the last meeting Mr. Keith Crightor would be attending. He said "The chair would like to say that althoug we have had our differences, and you have been on the "hot seat" from us many times, now you are on the seat for the contractors and house holders, the Chair thinks you have done a terrific job as a public servant. We have had no criticism that I know of. Mr. Wiggins has been a member of the Commission for man years, and there has been no criticism of your performance and your fairness, and your conscientious work in this position. All I can do is direct Mr. Wig ins to prepare a resolution to put on the record. Seriously, we wish YOL well in your new position, and I do sincerely want to say that I think you have done a terrific job, and you have had a very difficult position." Mr. Keith Crighton: "Thank you very much. I appreciate your sentiments, and my hope is that the Bureau of Housing will continue along the present vein. We have just completed our third most successful year, and it looks like the lines of neighborhood preservation are in such a state that we look for a much better future." Mr. Wiggins: "I feel Mr. Crighton has done an excellent job and is to be commended, and I wish him well in his new venture." "Thank you" said Mr. Crighton. Mr. Brownell said: "I would like to say that we have had good cooperation between the departments and with your staff. I have enjoyed the work, and I wish you well." 6. NEW BUSINESS (CONT'D o. South Ben Redevelopment Commission Regular Meting - October 7, 1977 A questioi was asked by Ms. Jeanne Derbeck: "Why has the agreement between redevelopers and the Redevelopment Commission regarding the purchase of project land been tabled ?" "Do you want to have the public hearing first ?" Mr. Nimtz's reply: think we ought to hear the evidence before a decision is made." Ms. Derbe k asked, "Is this decision then considered crucial ?" "Yes ", replied Mr. Nimtz Mr. Joseph D. Anderson replied with regard to the same item: "Has that agre ment been signed by all the parties, and is that proposed contract a matter f public record, at present, available to me ?" Mr. Butler stated that the docum nt has gone down to HUD, and that he gathered that it is a document that can e made available. Mr. Anderson asked: "Would you agree to make one available to me ?" "Sure, if it is alright with the Chair ", said Mr. Butler, and upon whici Mr. Nimtz said he had no objection. Ms. Jeanne Derbeck asked: "Could a copy of the agreement be made available to the press ?" "I will see if we can get copie3 made," replied Mr. Butler. Mr. Anderson asked Mr. Butler: "In your opinion, Joes this proposal agreement, despite the fact of its tardiness, meet the requirements 'of the South Bend Common Council, as set forth in their meeting ?" "No, it has been submitted to HUD for their approval because it was a HUD requireme t initially ", replied Mr. Butler. "When was it submitted to HUD, Kevin ?" a ked Mr. Anderson. "Last Friday, a week ago today ", replied Mr. Butler. "This postponement is for when ?" asked Mr. Anderson. "Let me say this, replied Mr. Nimtz, the public hearing on this whole matter is set for 10:00 A.M., we will recess this meeting and proceed to the 13th floor in the Board of 3ublic Works room, and I anticipate that they may not complete the hearing t is morning, and we may recess that public hearing until a later date. Particularly, Mr. Jannotta, our research consultant on real estate cannot be here today, al hough he has submitted a report. I anticipate that we will recess the meeting tD a later date and pending the completion of the public hearing, if that is c rrect or true, then this resolution or agreement will be on the Agenda for October 21, 1977. I have directed now that it be placed on the Agenda for October 21, 1977. I cannot say whether we will act on it that date, because I don't k ow the status of the public hearing as of that date, and whether we will have completed all the testimony and material on the project." "You are prese tly contemplating the carry over of this 10:00 meeting for the convenience of the commission ?" asked Mr. Anderson. Mr. Nimtz then answered "Yes, that is right, for the convenience of everyone who might want to present any additional views or testimony." "Well, let us assume, Mr. Nimtz, that you choose a later date for a continuation, which date is convenient we have arranged for today. Will that same courtesy be afforded us ?" "We will certainly attempt to hear everybody, yes ", replied Mr. Nimtz. "Thank you ", replied Mr. Anderson. 8. NEXT (COMMISSION MEETING The next regular commission meeting will be October 21, 1977, at 10:00 A.M.
