AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA,AMENDING CHAPTER 2,ARTICLE 6, SECTION 2-84.7 (b) OF THE
SOUTH BEND MUNICIPAL CODE ADDRESSING TAX ABATEMENT FEES
STATEMENT OF PURPOSE AND INTENT
On December 28, 1992, the Common Council passed Ordinance No. 8333-92
which established a "Schedule of Fees" which must be paid when filing a petition for real
or personal property tax abatement consideration.
The following ordinance would dedicate all of such fees except the City Clerk's fee
of$250.00 to the Department of Community and Economic Development to help offset the
significant amount of staff time spent on the review and processing of petitions for tax
abatement and the administration of the City's tax abatement program.
It is believed that this ordinance is in the best interests of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA, as follows:
Section I. Chapter 2, Article 6, Section 2-84.7 (b) of the South Bend Municipal
Code is amended by adding the following to the end of the last paragraph:
Fees collected under this Section shall be deposited as follows:
Clerk's Office fee of$ 250.00 to the General Fund: and
All other fees to Fund 212 to be used by the Department of Community and
Economic Development.
section II. All fees collected pursuant to the current provisions of Chapter 2,
Article 6, Section 2-84.7 (b) of the South Bend Municipal Code in calendar year 1994,
shall be deposited as set forth in Section I of this ordinance.
,Section III, This Ordinance shall be in full force and effect from and after its
passage by the Common Council , approval by the Mayor and legal publication.

First District The following proposed ordinance would formally establish where tax
abatement fees should be deposited. The initial City Clerk's fee of $ 250.00
Cleo Washington would be deposited into the General Fund, and all other fees would be
Second District deposited into Fund 212. In this way, the Department of Community and
Roland Kelly Economic Development would be able to offset some of the staff time costs
Third District needed to properly implement the tax abatement program.
Ann Puzzello I will be recommending that this proposed ordinance be sent to the Community
Fourth District and Economic Development Committee of the Council for further review and
recommendation.
