AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING ARTICLE 2 OF CHAPTER 17 OF THE SOUTH BEND MUNICIPAL CODE TO FIX RATES AND CHARGES FOR THE DISCHARGE OF HAULED SEPTIC TANK WASTE AND SIMILAR HAULED LIQUID WASTES TO THE SOUTH BEND WASTEWATER TREATMENT PLANT STATEMENT OF PURPOSE AND INTENT The purpose of this ordinance is to add a new Section 17-27.1 to Article 2 Chapter 17 of the Municipal Code to revise the schedule of charges for hauled septic tank wastes and other similar hauled liquid wastes to bring them into line with the other local treatment plants, both publicly and privately owned, that receive hauled septic tank wastes. The City of South Bend previously adopted a rate for hauled septic tank waste in 1973 (which was not inserted in the Municipal Code) which averages about two and one-half cents ($0.025)per gallon. At other local facilities, the average rate is about six cents ($0.06) per gallon. Hauled septic waste can cause operational problems to the City's wastewater facility through plugging plant filter screens. It is, therefore, necessary to increase the rate at the South Bend facility to be comparable with other providers so that South Bend is not the most economically attractive site for hauled septic tank and other liquid waste. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS: Section I. Chapter 17, Article 2, Division 4 of the South Bend Municipal Code is amended to add a new Section 17-27.1 to read as follows: Sec. 17-27.1. Hauled Septic Tank Waste and Similar Liquid Waste Discharge Requirements and Rates (a) Generally. Hauled septic tank waste and similar liquid waste is amenable to treatment at the South Bend Wastewater Treatment Plant. Only hauled septic tank waste from residential locations will be accepted. Hauled septic waste from industrial and commercial locations is prohibited. (b) Permitting Requirements. Any septic tank waste hauler must have a valid permit issued by the State of Indiana, Department of Environmental Management in order to discharge at the South Bend Wastewater Treatment Plant. In addition, each septic tank waste hauler must complete a discharge application with the City of South Bend, Division of Environmental Services prior to receiving approval to discharge at the South Bend Wastewater Treatment Plant. (c) Rates and Charges. 1. Each hauler of septic tank waste shall be required to complete discharge records at the plant indicating the origin of location(s) for each tanker discharged. Charges shall be $0.06 per gallon on a full tanker basis. The hauler shall be charged the full tanker volume for each discharge, regardless of actual discharge volume, unless the City installs metering. At that time, charges shall be $0.06 per gallon as metered. 2. The rates and charges for hauled septic waste shall be subject to the same rate adjustments as unmetered sewage rate for Class I users as described in 17-21(b). Section II. This ordinance relates to the fees charged to septic haulers who discharge their waste at the South Bend Wastewater Treatment Plant. We have offered and endured this service for many years because these haulers had very few options for disposing of this waste which is drawn from residential septic tanks in the County. Recently, a private company has opened its doors in Elkhart which is better equipped to deal with this concentrated waste. By setting our rates at $0.06 per gallon, we provide a $0.01 per gallon incentive for the hauler to use the Elkhart facility. Niles Wastewater Treatment Plant has recently raised their rates to $O.US per gallon. I do not believe that the Mishawaka or Elkhart Plants offer the service.
