Ehlers & Associates, Inc. letter dated June 16, 1976: This letter is over the signature of Mr. Dudley A. Thompson re- questing if there is a possibility of placing an under canopy sign on the corner of Jefferson and Michigan on the Plaza. Their firm represents Lincoln National Life.. Mr. C. Wayne Brownell, Executive Director, Department of Re- development, suggested the letter be received and referred to Mr. Edwin R. Bauer and the Sign Committee. The Chair directed the letter be received and referred to the Sign Committee. 5. OLE BUSINESS None. 6. NE BUSINESS a. Commercial Lease with South Bend Public Transportation Corp.: Authorization was requested to enter into Commercial Lease with the South Bend Public Transportation Corporation, for period from July 1, 1976, to and including December 31, 1976, for use of Disposition Parcels 4 -65 and 4 -87 as a` central bus transfer location, and to pay as rent for said leased pre- mises the sum of $2.00, Project Indiana R -66. The previous Commercial Lease was for period from January 1, 1976, to an including June 30, 1976, in same rental amount. Mr. Wiggins made the motion the Commission be authorized to enter into said Commercial Lease with the South Bend Public Transportation Corporation for the period of July 1, 1976, to and including December 31, 1976, for a rental amount of $2.00 for said period. Motion was seconded by Mr. Robinson and carried. Mr. Dave Anderson, WNDU -TV Reporter, raised the question on why the lease is only for six months and why the stipulation that they pay the $2.00? The Chair advised that we have been reluctant to get into any long -term lease on this parcel be- cause it is a disposition parcel, and we want to keep ourselves fluid for any possible developments concerning superblock and anything else that might develop. It is also his understanding that the exact position or place for a bus terminal has not been fully established or determined for the downtown area. Commissioner Wiggins confirmed the statement that this is all fluid. Resolution No. 525: This Resolution authorizes the execution of RESOLUTION he Redevelopment Agreement for the disposition of land and the NO. 525 xecution of Quit Claim Deed for the transfer of title thereto in ADOPTED, onnection with land to be disposed of in the LaSalle Park Project, R -57 ndiana R -57, with Whitfield Hunt, for Parcel No. 25 -5, which is a substandard lot, in acquisition amount of $140.00. Ir. Wiggins made the motion for the adoption of Resolution No. 525, seconded by Mr. Robinson and carried. r. Wiggins asked how we are coming along with the LaSalle Park roject, Indiana R -57? Mr. Brownell advised he believed that Mr. eorge Patton (Commission Counsel handling litigation matters) has ad five cases dismissed. Mr. Patton added we have approximately 0 more cases to go; they are all in the hopper. All these cases re five to six years old. r. Wiggins further stated that the R -57 Project has been carried n for a long time; a lot longer than he thinks it ought to be ecessary and that he would like to see it closed out as expedi- iousiy as we can. Mr. Brownell advised we have one delaying actor: We need the funds from the Community Development grant or this coming year before we can close out R -57 in addition to here cases pending. Their grant hasn't been approved yet, but t is in the process of having the details ironed out that have to e modified or changed or amended altogether. Mr. Wiggins further sked if there is a real possibility that this can be closed out y this fall, and Mr. Brownell advised it should be closed before all, and that he and Mr. Patton had a little chat about that a ouple of days ago. c. hange Order No. 2 to Rehabilitation Contract No. NW-CD/0-3. North- CHANGE est Community Development Program: Commission approval was re- ORDER NO. 2 nested of this Change Order, with Slatile Roofing & Sheet Metal, TO REHAB. Inc., for an extension in contract time from May 21, 1976, to CONTRACT NO. June 30, 1976, with no change in contract amount, for rehabilita- NWCD /03 ion work at 506 LaPorte Avenue, in the Northwest Community De- APPROVED, elopment Program. NWCD PROGRAM The Rehabilitation Contract is dated April 14, 1976, and the exten- sion is based on Mr. Gabbard's statement, who is with Slatile Roofing Sheet Metal, Inc., that he had not been able to contact his elec- -4- 6. NEW BUSINESS (Cont'd trical subcontractor .concerning -an upcoming change order relating to the contract. Per Mr. Richard E. Pfeifer's memorandum, (who is Chief Inspector of the Northwest Bureau of Housing), if this time extension is approved, the contractor states he can complete this structure within the specified time limit. Mr. Keith P. Crighton, Director, Bureau of Housing, added he had no other comments, other than Slatile has been performing reason- ably well, and that he is trying to be as flexible as possible with his subcontractor. The subcontractor had jury duty for two weeks this month and lost that time. One house is involved on this contract. Mr. Wiggins moved for the approval of Change Order No. 2 to Re- habilitation Contract No. NWCD /03, with Slatile Roofing & Sheet Metal, Inc., for an extension in contract time from May 21, 1976, to June 30, 1976, with no change in contract amount, in the North- west Community Development Program. Motion was seconded by Mr. Donaldson. Mr. Richard Pfeifer in his memorandum advised that the specifica- tion called for the installation of 100 amp service with circuit breakers. It was brought to his attention by the electrical con- tractor that this structure already has 100 amp service that is in good working order. However, the structure does not meet our project specifications; i.e., insufficient plugs, lights, switches, ground fault installations. This electrical work totals $690.00, leaving a balance of $123.00 that was in the original specifica- tion for the electrical system work in amount of $813.00. Staff feels this balance should be applied to the insulation and enclos- ing of the east wall in the utility room, and recommends the con- tract be amended to include the items on the change order and it be approved. The additions include 19 items amounting to: $813.00. Motion was made by Mr. Robinson that we grant his request, seconded by Mr. Wiggins and carried, for the approval of Change Order No. 3 to Rehabilitation Contract No. NWCD /03, with Slatile Roofing & Sheet Metal, Inc., with no changes in time or contract amount, in the Northwest Community Development Program. - 5 - 31 Commissioner Robinson said he can't see why it would take six weeks - -even if he would have to go and get a new electrical con- tractor- -why he needs six weeks extension just to do electrical work in a house. Commissioner Wiggins said he has already had most of the extension time; he only has two weeks left. Motion carried. d. Change Order No. 3 to Rehabilitation Contract No. NWCD /03, North- CHANGE west Community Development Program: Commission approval was re- ORDER NO. quested of this Change Order, with Slatile Roofing & Sheet Metal, TO REHAB. Inc., which also relates to the above Contract item, for changes CONTRACT in specification items with no changes in time or contract amount, NWCD /03 for rehabilitation work at 506 LaPorte Avenue, in the Northwest APPROVED, Community Development Program. Keith P. Crighton, Director, Bureau of Housing, advised the ids received on Contracts #SECD /19, #SECD /36, #SECD /33, #SECD /34 nd #SECD /37, were either over our $8,000 limitation or they were oo far over our cost estimates, and the Advisory Board felt they hould be re- evaluated. In other words, some of the items included n the inspection would be deleted; however, none of the items would e deleted that relate to health and safety code requirements for outh Bend. Commissioner Wiggins asked if this contemplates a revision of the cost estimate, and Mr. Crighton advised their cost estimating pro- cedure is accurate. It varies slightly between contractors of different size; obviously an operation is going to have a slightly lesser cost estimate - -a slightly lesser bid than someone with a 10 -man crew - -but the cost estimator that we have on our staff is following standard procedure and we have had relative success with it lately. In the specified contracts, we will not be changing the cost estimate, but will be deleting items from the specifica- tions. Mr. Wiggins moved for the compliance with the Southeast Advisory Committee's request, seconded by Mr. Donaldson and carried, which is to reject the bids received on Contracts #SECD /19, #SECD /36, #SECD /33, #SECD /34 and #SECD /37, and the specifications are to be re- evaluated and revised. The contracts are to be re- submitted for bid as soon as the necessary corrections have been made. 6. NEW INESS (Cont'd f. C )ntract #SECD /30, #SECD /31, # SECD /32 and #SECD35' Southeast C )mmunity Develo ment Program: Per recommendations of the S utheast Advisory Committee, Commission approval was requested t approve the bids for contract award to Slatile Roofing & Sheet I tal Company, subject to Common Council and Legal Counsel approval, i the Southeast Community Development Program. This item is part of the bid tabulation, as shown above in Item 6e. The other ones had too great a discrepancy ?tween the items and quite possibly the contractor just saw a more (pensive way of correcting something on the work needed, but that did not know. This is the second bid set on these rehabilitation, )ntracts. These were bid once before and rejected. Now this is the ?cond time around - -the same bidder only - -did not have any more takers i the first time around. The contractor revised all the bids the �cond time. Wiggins moved for the approval as recommended by the Southeast Advisory Committee, and award the Rehabilitation Contracts #SECD /30, # ECD /31, #SECD /32 and #SECD35, to the low and only bidder, Slatile Roofing & Sheet Metal Company, in bid amounts as noted above, subject to Common Council and Legal Counsel approval, in the Southeast Com tmunity Development Program. Motion was seconded by Mr. Robinson and c rried. g. Change Order No. 2 to Rehabilitation Contract No. 275 Southeast C de Enforcement Program, Project E -7: Commission approval was re- q ested of this Change Order, with Barany Sheet Metal & Heating C mpany, for a decrease in contract amount of $4.00, with an amended c ntract total of $6,547.00, for rehabilitation work at: 1816 South St. Joseph Street, in Southeast Code Enforcement Program, Project E 7. CHANGE ORDER NO. 2 TO REHAB. CONTRACT 27 APPROVED, SE CODE EN- FORCEMENT PROGRAM, Mr. James L. Johnson, Jr., Chief Inspector, advised in his memoran- E -7 dim that the specifications called for installing four plugs in the dining room, repairing one plug on the west wall, installing two plugs ii the living room, and installing two plugs in the kitchen. When tie electrician began wiring the structure, he found that the installa- tion of these plugs to be in error. Therefore, the plugs have been r paired and two additional circuits have been added to the existing s rvice, with a reduction in the contract price of $4.00. Staff re- c mmends approval of the change order. - 7 - 6. Mr. Wiggins moved for the approval, seconded by Mr. Robinson and carried, of Change Order No. 2 to Rehabilitation Contract No. 27, with Barany Sheet Metal & Heating Company, for a °decrease in con- tract amount of $4.00, or an amended contract total of $6,547.00, n the Southeast Code Enforcement Program, Project E -7. h. han a Order No 3 to Rehabilitation Contract No. 16, in Southeast ode Enforcement Program, Project E -7: Commission approval was equested.of this Change Order, for an increase in contract amount f $75.00. The Contract was awarded to Ted Combs Decorating & onstruction Company in contract amount of $7,647.69 and with hange order increase the amended contract total is: $7,722.69, or rehabilitation work at 1121 South Carroll Street, in the loutheast Code Enforcement Program, Project E -7. he specifications called for replacing the front porch tongue nd groove deck and paint two coats. Mr. Johnson, Chief Inspec- or, in his memorandum stated after the existing deck was removed y the contractor, he found four 2" x 6" floor joists broken and ubmitted a request for this change order. A Chief Inspector's roceed Order was issued on June 9, 1976, in order to facilitate ompletion of the contract. Slatile Roofing & Sheet Metal Company ,as contracted to do the work on the change order. The total con - ract price of $1,495.00 will be increased $75.00. Staff recommends his change order. CHANGE ORDER NO. 3 TO REHAB. CONTRACT 16 APPROVED, SE CODE EN- FORCEMENT PROGRAM, E -7 ommissioner Wiggins questioned why the contractor is shown as Ted ombs Decorating & Construction Company and in the body of the etter it says that Slatile Roofing & Sheet Metal Company was con - racted to do the work for the change order. Mr. Crighton explained hat Ted Combs has the contract, but because of unresolved differ - nces between Mr. Combs and the homeowner, Mr. Combs opted to pull ut in doing the remaining work; Slatile is finishing up the contract, lthough Mr. Combs' bond, insurance, etc., is still in effect on this ontract No. 16. Commissioner Wiggins inquired if this now is satis- actory to the homeowner, and Mr. Crighton advised so far it is. r. Robinson made the motion that the increase be granted, seconded y Mr. Wiggins and carried, for the approval of Change Order No. 3 o Rehabilitation Contract No. 16, for an increase in contract amount f $75.00, or an amended contract total of $7,722.69. i. Change Order No: 4 to'Rehabilitation Contract No. SECD /HR /CS -1/14, n the Southeast Community Development Housing Program: Commission approval was requested of this Change Order, for an increase in con- tract amount of $200.`00, (Contract: $39,391.00), or an amended con- tract total of $39,591.00, for rehabilitation work at: 1525 Swygart Avenue, on Contract No. 14 to be increased by $200.00 bringing the otal to $4,316.00, and contract completion date be extended until June 30, 1976, in the Southeast Community Development Housing Pro - ram, with Slatile Roofing & Sheet Metal Company. - 8 - CHANGE ORDER NO.4 TO REHAB. CONTRACT SECD /HR/ CS -1/14 APPROVED, SECD HOUS- ING PROGRAM 6. NEW BUSINESS (Cont'd r. Johnson, Chief Inspector, in his memorandum advised the speci- ications called for.covering the entire structure with asphalt hingles and repairing two second .floor bedroom ceilings. Since he time of the initial inspection, further deterioration of the oof has damaged two additional bedroom ceilings; therefore, staff ecommends this Change Order for approval. The contractor is re- uesting that the completion date be extended until June 30, 1976. r. Crighton advised the above is on the Housing Allowance Referral ontract, with 17 houses on the contract. r. Wiggins moved for the approval, seconded by Mr. Robinson and arried, of Change Order No. 4 to Rehabilitation Contract No. ECD /HR /CS -1/14, with Slatile Roofing & Sheet Metal Company, or an increase in contract amount of $200.00, or an amended con - ract total of $39,591.00, (the $200.00 increase being on Contract o. 14, amending the contract amount to $4,316.00) and contract ompletion date to be extended until June 30, 1976, in the Southeast ommunity Development Housing Program. j. han a Order No. 1 to Rehabilitation Contract No. SECD /PR /CS -1 /05, n the Southeast Community Development Housing Program: Commission approval was requested of this Change Order, with Bailey Electric Company, for an increase in contract amount of $321.50, or an mended contract total of $3,841.50, for rehabilitation work at: 14 East Indiana Avenue, in the Southeast Community Development .using Program. r. Johnson, Chief Inspector, in his memorandum advised the speci- ications called for covering the entire structure with asphalt hingles, including the front porch. The contractor found bad heathing while covering the front porch; therefore, staff is ecommending approval of the change order to add eight sheets f plywood sheathing for the front porch roof in amount of 321.50. Crighton advised this is an item that really cannot be accounted unless you have constructive testing. r. Robinson moved for the approval, seconded by Mr. Wiggins and arried, of Change Order No. 1 to Rehabilitation Contract No. ECD /PR /CS -1/05, with Bailey Electric Company, for an increase n contract amount of $321.50, or an amended contract total of 3,841.50, in the Southeast Community Development Housing Program. r. Dan Caesar, WSBT -TV Reporter, asked various questions relating o all of these contracts, as to whether the contractors themselves ctually do the work, or do they subcontract'it out in some cases; hether the general contractors are paid when they themselves do no ork but subcontract it out; and whether any of them actually do ny of the physical work themselves in the rehabilitation of these omes? Mr. Crighton advised that approximately 60% of the contrac- ors do the work themselves; 40% contract it out and act in the apacity of business managers more or less. Relating to the ques- ion Mr. Caesar raised on 6g, on which the contractor is Barany 0 CHANGE ORDER NO.1 TO REHAB. CONTRACT SECD /PR/ CS -1/05 APPROVED, SECD HOUS- ING PROGRA a BUSINESS (Cont'd Sheet Metal & Heating Company, Mr. Crighton advised Barany sub - contracts the electrical work, but does do his own plumbing and heating. Some of the contractors who own their firms actually do some of the work personally. Barany does not. He is a business manager; he has his own carpentry crew, own plumbing and heating crews; but he does subcontract the electrical work. The general contractor can have his own work crew, or he can just serve as a business manager and subcontract out to regular firms to work with him, and he handles the paper work for the subcon- tractors. Mr. Caesar further asked, "Is it permitted for Redevelopment to subcontract work out itself and eliminate the middleman ?" Mr. Crighton advised, "No. You cannot do that in the State of Indiana." The Chair further stated, "Of course, as I view the construction industry, Lloyd, [Commissioner Robinson], you are probably more close than anybody to this thing. This is happen- ing over the country whereby large or certain contractors are just really managers and they put the project together and all they do is supervise them; they actually have no work crew of their own. The only employees they have is just supervisors or engineers or accountants, so actually they have no laborers other than supervisors and they merely manage the project. Isn't that right, Lloyd ?"
