AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY
The alleys to be vacated are described as the first east-west alley north of E.
Jefferson Blvd. from the east right-of-way line of S. St. Peter to the east right-of-
way line of the first north-south alley east of S. St. Peter, and the first east-west
alley south of E. Washington Ave. from the west right-of-way line of S.Notre
Dame Ave. to the east right-of-way line of the first north-south alley west of S.
Notre Dame Ave.
Also, a right-of-way described as: Beginning at the northeast corner of Lot 315 in
part of Cottrell's 1st Addition to Lowell in the City of South Bend,Indiana.
STATEMENT OF PURPOSE AND INTENT
Pursuant to Indiana Code Section 36-7-3-12,the Common Council is charged with the
authority to hear all petitions to vacate public ways or public places within the City.
The following Ordinance vacates the above described public property.
NOW,THEREFORE,BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, as follows:
SECTION I. The Common Council of the City of South Bend having held a public
hearing on the petition to vacate the following property:
The alleys to be vacated are described as the first east-west alley north of E.
Jefferson Blvd. from the east right-of-way line of S. St. Peter to the east right-of-
way line of the first north-south alley east of S. St. Peter, for a distance of
approximately 179 feet and a width of approximately 14 feet; and the first north-
south alley east of S. St. Peter St. from the south right-of-way line of E.
Washington St.to the north right-of-way line of the first east-west alley north of
E. Jefferson Blvd. for a distance of approximately 198 feet and a width of
approximately 14 feet; and the first east-west alley south of E. Washington Ave.
from the west right-of-way line of S.Notre Dame Ave. to the east right-of-way
line of the first north-south alley west of S.Notre Dame Ave. for a distance of
approximately 165 feet and a width of approximately 8 feet;
Also, a right-of-way described as: Beginning at the northeast corner of Lot 315 in
part of Cottrell's 1st Addition to Lowell in the City of South Bend,Indiana;thence
east seven(7) feet;thence south ten(10)feet along east line of vacated alley;
thence west fourteen(14)feet;thence northwest to a point that is forty-two (42)
feet west of the northeast corner of Lot 315;thence east forty-two (42) feet along
the north line of Lot 315 to the point of beginning.
Parts situated in Cottrell's First Addition to Lowell in the City of South Bend, St.
Joseph County, Indiana.
hereby determines that it is desirable to vacate said property.
SECTION IT. The City of South Bend hereby reserves the rithts and easements of all

SECTION III. The following property may be injuriously or beneficially affected by
such vacating:
Lot#'s 312, 313, 314, 315, 316, 317, 318, 319, 320, 321, 322, and 323.
SECTION IV. The purpose of the vacation of the real property is to:
Allow Teachers Credit Union to maintain the alleys.
SECTION V. This ordinance shall be in full force and effect from and after its passage
by the Common Council and approval by the Mayor.

RE: Vacation of Property
Dear Members of the Council:
In accordance with Municipal Code Section 18-53.8, a favorable recommendation is being
submitted to the Common Council concerning the Vacation of Property on the following:
The first east-west alley north of E. Jefferson Blvd. from the east right-of-way line of S. St.
Peter to the east right-of-way line of the first north-south alley east of S. St. Peter, and the first east-
west alley south of E. Washington Ave. from the west right-of-way line of S. Notre Dame Ave. to
the east right-of-way line of the first north-south alley west of S. Notre Dame Ave.
Also, a right-of-way described as: Beginning at the northeast corner of Lot 315 in part of
Cottrell's 1st Addition to Lowell in the City of South Bend, Indiana.
For your information,the Board of Public Works received favorable recommendations from
the Department of Economic Development, Department of Sanitation, City Attorney's Office, Fire
Department, Police Department,Division of Engineering and the Area Plan Commission concerning
this vacation. Copies of the recommendations received from these departments are attached for your
review.
Therefore, the Board submits to you a favorable recommendation concerning this vacation.
