RESOI,'(J"FION NO. 59-2019 <br />&RESOLUTION OF THE CITE` OF SOUGH E J fI"IAN A., <br />BOARD OF PUBLIC WORKS FOR THE <br />.DISPOSAL OF SURPLUS .___.....�.... <br />�...�..._................._ PROPERTY <br />WHEREAS, I.C. 36-9-6-1 gives the Board of Public Works of the City of South Bend the right and <br />duty to have custody of, control of, use of, and dispose of in accordance with Indiana statutes, all real and <br />personal property owned by the City of South Bend (the "City"); and <br />WHEREAS, I.C. § 5-22-22-1 permits and establishes procedure for disposal of personal property <br />which is no longer needed by the City or which is unfit for the purpose for which it was intended; and <br />WHEREAS, I.C. § 5-22-22-8 states that personal property may be deemed worthless if the sale or <br />transportation of such personal property would cost more than its value and allows for the disposition of <br />such personal property at the discretion of the City; and <br />WHEREAS, the City and St. Joseph County, Indiana entered into an Interlocal Agreement dated <br />December 12, 2017 for the support of the Historic Preservation Commission (the "Interlocal Agreement"); <br />and <br />WHEREAS, Section 3.07 of the Interlocal Agreement provides that the property of the Historic <br />Preservation Commission (the "HPC") is acquired, held, and disposed of in the name of the City; and <br />WHEREAS, Section 4.07 of the Interlocal Agreement transferred all of the assets of the HPC to <br />the City; and <br />WHEREAS, Section 4.06 requires the City to provide storage space for the assets by December <br />2020; and <br />WHEREAS, the City has limited space in which to store all of the assets of the HPC; and <br />WHEREAS, City staff dedicated to the HPC along with the HPC disposition committee (the "HPC <br />Staff') have determined which assets are of the greatest interest and value to the HPC; and <br />WHEREAS, the HPC Staff contacted potential purchasers or donees for some of the remaining <br />assets (the "Property") and also determined that the cost of paying for additional storage for or disposing of <br />the Property would exceed its value. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend <br />that the Property as described on the attached Exhibit A is no longer needed by the City, is no longer useful <br />to the HPC, and has an estimated fair market value of Zero Dollars ($0.00); and <br />BE IT FURTHER RESOLVED that the Property be disposed of by donation or otherwise and <br />removed from the City inventory, effective immediately upon the adoption of this resolution. <br />Signature Page Follows <br />
