AN ORDINANCE OF THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA
VACATING
Ohio Street from Fellows Street to Marietta Street and Rush Street from Keasey Street to the Penn
Central Railroad and certain north/south and eastlwest alleys situated between Fellows Street and
Marietta Street, and Sample Street and Keasey Street.
STATEMENT OF PURPOSE AND INTENT
Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear
all petitions to vacate public ways or public places within the City.
The following ordinance vacates the above described public right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, as follows:
SECTION I. The Common Council of the City of South Bend having held a public hearing on the
petition to vacate the following public rights-of-way:
The rights-of-way to be vacated are various streets and alleys located in the north half of Township 37
North, Range 2 East, in the City of South Bend, Saint Joseph County, Indiana, all more particularly
described as follows:
South Rush Street from the north right-of-way line of East Keasey Street to the extended north right-
of-way of the first east-west alley north of East Keasey Street for a distance of approximately 132
feet and a width of 48 feet.
The first east-west alley north of East Keasey Street from the east right-of-way line of South Fellows
Street to the west right-of-way line of South Rush Street, excluding the intersecting north-south alley,
for a distance of approximately 387.5 feet and a width of 14 feet.
The first north-south alley east of Fellows Street from the north right-of-way line of East Keasey Street
to the north right-of-way line of the first intersecting east-west alley north of East Keasey Street for a
distance of approximately 146 feet and width of 14 feet.
The first east-west alley north of East Keasey Street from the east right-of-way line of South Rush
Street to the west right-of-way line of South Marietta Street, excluding the north-south alley, for a
distance of approximately 358.9 feet and a width of 14 feet.
The first north-south alley east of South Rush Street from the north right-of-way line of East Keasey
Street to the north right-of-way line of the first intersecting east-west alley north of East Keasey
Street. Parts situated in Wenger's Fourth Addition to the City of South Bend.
Also,
South Rush Street from the extended north right-of-way line of the east-west alley north of East
of South Marietta Street.
The first north-south alley east of South Fellows Street from north right-of-way line of the first east-
west alley south of East Ohio Street to the south right-of-way line of East Ohio Street for a distance
of approximately 132 feet and a width of 14 feet.
The first north-south alley east of South Rush Street from the north right-of-way line of the first east-
west alley south of East Ohio Street to the south right-of-way line of East Ohio Street for a distance
of approximately 132 feet and a width of 14 feet.
The first north-south alley east of South Fellows Street from the north right-of-way line of East Ohio
Street to the south right-of-way line of East Sample Street, excluding the intersecting east-west alley,
for a distance of approximately 264 feet and a width of 14 feet.
The first east-west alley north of East Ohio Street from the east right-of-way line of South Fellows
Street to the west right-of-way line of South Rush St. for a distance of approximately 400.5 feet and
a width of 14 feet. Parts situated in Wenger and Krieghbaum's First Addition of the City to South
Bend.
hereby determines that it is desirable to vacate said rights-of-way.
SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and the
Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited
to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches,
within the vacated rights-of-way, unless such rights are released by the individual utilities.
SECTION III. The following property may be injuriously or beneficially affected by the vacation:

SECTION IV. The purpose of the vacation of the rights-of-way is to prepare a site for the development of
the Family and Children Center facility.
SECTION V. This ordinance shall be in full force and effect from and after its passage by the Common
Council and approval by the Mayor.

Dear Council Members:
Attached is an ordinance vacating certain streets and alleys in the Southeast neighborhood of
South Bend. The area in which these streets and alleys are to be vacated is bounded by
Sample Street on the north, Keasey Street on the south, Fellows Street on the west and
Marietta Street on the east. The Redevelopment Commission has purchased the land in this
area and is making it available to the Family and Children's Center for development of a
new Boys and Girls Club and other youth related activities.
I request your favorable support of this ordinance and would be glad to answer any questions
you might have.
